Draft GNSO Council Response to 11 March ICANN Board Letter on Rec 7 and Thick WHOIS
Hi all, Following our 16 April GNSO Council meeting, I had the action item to circulate a draft response to the 11 March letter from the ICANN Board on EPDP Phase 1 Recommendation 7 and the Thick WHOIS transition policy. That draft is attached for your review. I have coordinated this with Pam and Rafik and they are good with it. I note that John and Marie volunteered last week to participate in the drafting, so please provide any comments or feedback to this first draft. To summarize, this draft response (1) acknowledges the Board’s view that Rec 7 did not explicitly replace or retire the Thick WHOIS transition policy, (2) agrees that there is a conflict between Rec 7 and the Thick WHOIS policy, (3) acknowledges the role of the GNSO Council in kicking off an appropriate policy development process to address the conflict, and (4) says ICANN Org and the IRT should implement Rec 7 as written and approved pending the results of the new PDP work to address the conflict. On procedural grounds, the GNSO Council needs to ensure that Consensus Policies approved by Council and the ICANN Board are implemented appropriately and consistent with the policy recommendations. Hi all, As the GNSO Council works to finalize our response to the ICANN Board’s 11 March letter on Rec 7 and Thick WHOIS, Rafik has agreed to manage the process moving forward. Because Verisign is uniquely impacted by the Thick WHOIS transition policy, I feel it’s best to recuse myself from substantive discussion on this topic. As the Vice Chair and Council Liaison to the EPDP, Rafik is particularly qualified to manage the Council’s discussion on next steps to address the conflict between Rec 7 and the Thick WHOIS transition policy. I am available to answer any questions and I may provide further input on behalf of the RySG, but I am now handing off typical Chair duties on this topic to Rafik. Rafik, I do not support the edits, proposed by John for two reasons: 1. It is not helpful to remove justifications of the conclusions and explanation of the division of the roles in ICANN ecosystem from the letter. 2. It contains factually incorrect reasoning: I don't believe that a contractual agreement between two parties could justifiably be termed 'a legal requirement'. Two parties could easily contractually agree to something that is not legal, so there must still be a legal basis for a contractual requirement. A contract is not a law. Following our 16 April GNSO Council meeting, I had the action item to circulate a draft response to the 11 March letter from the ICANN Board on EPDP Phase 1 Recommendation 7 and the Thick WHOIS transition policy. That draft is attached for your review. I have coordinated this with Pam and Rafik and they are good with it.
I note that John and Marie volunteered last week to participate in the drafting, so please provide any comments or feedback to this first draft.
To summarize, this draft response (1) acknowledges the Board’s view that Rec 7 did not explicitly replace or retire the Thick WHOIS transition policy, (2) agrees that there is a conflict between Rec 7 and the Thick WHOIS policy, (3) acknowledges the role of the GNSO Council in kicking off an appropriate policy development process to address the conflict, and (4) says ICANN Org and the IRT should implement Rec 7 as written and approved pending the results of the new PDP work to address the conflict.
On procedural grounds, the GNSO Council needs to ensure that Consensus Policies approved by Council and the ICANN Board are implemented appropriately and consistent with the policy recommendations.
