My interest has more to do with the progressively attenuating distinction between so-called “Public International Law” and “Private International Law” in a world where a private corporation can make policies that end up being internationally ”binding”, setting some parameters on behavior and rights of states (e.g. rights of states to agree or oppose an application for a string listed as a UNESCO regions & like situations). Let’s say that the WT5 Final Report’s recommendations eventually become approved by the Board; is that the act that makes that norm “binding” on states or is it a mix of that plus the fact that by participating in ICANN through GAC, states legally validate (for Public International Law purposes) as a consistent state custom with opinio juris? I could envision a panel with interesting perspective on different sides of the debate...
