Dear Yik-chan Chin 钱忆亲: Thankyou for your question. First, responding to your example: HK is one of the two letter ISO 3166 codes that has already been delegated as a ccTLD. All other 2 letter codes are excluded from gTLDs. So, Haokao town could apply for <.Haokao> without any duplication with Hong Kong. Secondly, and more generally, this is unfinished business. There are indeed quite a few duplicate names world-wide. In the Sub-Pro PDP this has been used as a justification for granting none or very limited protection to non-Capital City names, with which I disagree. There are thousands of non-Capital City names that should be equally eligible for protection, and which are not duplicates. If more than one application emerges for the same non-Capital City name, ICANN will have to develop a procedure for dealing with that. It is not beyond the wit of the community to do that! Hello Dr Chan, I have replied to your comment in the googledoc itself. As Christopher said,.HK is the ccTLD for Hong Kong, and so, it doesn't fall within the rules for New gTLDs. ccTLDs are solely a matter for the ccNSO and its respective member countries. As for competing applications for the same non-capital city name strings, there are existing rules in the 2012 Applicant Guidebook (AGB) that govern how such competing applications are to be dealt with. The 2012 AGB will be updated as part of the implementation of consensus policies derived from the SubPro PDP Final Report and other relevant PDPs The challenge is that not all such policies are necessarily supported in totality by all parts of the ICANN community -- indeed, that is why this ALAC Advice to the ICANN Board is contemplated for areas what At-Large believes is either unacceptable or deficient and requires the Board's consideration or intervention. First, responding to your example: HK is one of the two letter ISO 3166 codes that has already been delegated as a ccTLD. All other 2 letter codes are excluded from gTLDs.
So, Haokao town could apply for <.Haokao> without any duplication with Hong Kong.
Secondly, and more generally, this is unfinished business. There are indeed quite a few duplicate names world-wide. In the Sub-Pro PDP this has been used as a justification for granting none or very limited protection to non-Capital City names, with which I disagree. There are thousands of non-Capital City names that should be equally eligible for protection, and which are not duplicates.
If more than one application emerges for the same non-Capital City name, ICANN will have to develop a procedure for dealing with that. It is not beyond the wit of the community to do that! I have some suggestions, if necessary in due course.
