Call for Comments by Monday, 5 July: ALAC Statement on Initial Report of the Expedited Policy Development Process (EPDP)
Good afternoon. Thankyou, Noted, However, at such short notice, I am not able to comment in the format required by the document. I have every confidence that the ALAC participants in the EPDPs are doing their very best to make the best of a very difficult job. Notwithstanding, my considered position in this matter is to abstain. While I recognise that ALAC's participation in EPDP to date has been inspired by patient wisdom, seeking pragmatic compromise, I consider that commenting on the EPDP report at this time is no longer where we should be at. I have participated in aspects of ICANN's privacy policy in several capacities, for the past twenty years and have regrettably come to the conclusion that ICANN's Multi-stakeholder Model has – in this respect - failed. I see no merit any longer in sending back comments which are tweaks to questions that will without doubt be rejected by the EPDP and GNSO. Worse, I have observed over the years that a number of the contracted parties are simply 'playing the clock' (to adopt an expression from football) and have no intention of allowing ICANN to adopt a GDPR-compliant policy. The MSM adopted by the empowered community in the context of the Transition was not done to permit permanent procrastination of policy issues for the commercial interest of a 'consensus' within the GNSO. Enough is enough. I think that the ICANN Board should close down the EPDP and simply refer the matter back to ICANN Legal to resolve on the basis of their, by now, no doubt detailed knowledge of privacy policies and legislation world-wide, including GDPR. As things stand in this and other PDPs, ICANN's version of the MSM will bring the Multi-Stakeholder Model, into disrepute internationally. I agree with CW - with the caveat that the ESTA problem will only be postponed to ICANN73 in Puerto Rico, although the sanitary situation could be more favourable. I think that the fact that “Seattle is home to a large (and growing) number of domain name companies” is rather speaking against an in-person meeting, simply because we cannot say that the other stakeholder groups will enjoy an equally favourable situation. Trying to see the situation from the outside, I would argue that if ICANN is a domain name industry gathering it would make sense to hold an in-person meeting in Seattle, while if ICANN is the place where the multi-stakeholder community meets it would not make sense. My point is that we have sufficient bias during normal times in terms of multi-stakeholder participation that we do not need an additional one where large part of the world outside the highly vaccinated areas (probably just NA and EU) would not be able to attend. And this not to speak about the fact that under these circumstances the presence is likely to be limited to the professionals of the domain name market. I am curious to see how the situation evolves and what will be the justification for ICANN to decide in one direction or the other, and also keep an eye on the record of in-person participation for different geographical areas and/or stakeholder groups. Basically, this falls's meeting will be via Zoom, as the last several have been. The Board is still working on the assumption that we will be able to do the February meeting partially in person (thus "hybrid"). But that's subject to change as conditions continue to unfold. True, others have moved on. But some of us are still in the middle of the pandemic. And as Sarah said, visa and travel has become more complicated. Some questions we should ponder on: Is ICANN going to cover costs on testing and isolation? Is it going to have restrictions on vaccination? Because it would be sad if a participant is affected from the convening. Remember it is bringing participants from different countries, with different variants. Ps. 1. Covid 19 : irrespective of more generalized vaccinations and testing, it is likely that many participants will have to quarantine for several days on arrival and/or on returning home. At present this is typically 10 days for some countries.
Who knows what the situation will be world-wide in October?
2. Balanced participation: Apparently in support of their case, their blurb notes that “Seattle is home to a large (and growing) number of domain name companies”. So be it, but there are also an even larger number of domain name companies which are NOT in Seattle.
3. US Visas : most non-US participants will have to get a new ESTA travel permit ; e.g. mine has certainly expired.
ALAC and CPWG may reach their own conclusions about achieving balanced AC/SO participation in these circumstances. In my view, an in-person ICANN72 dominated by local domain name companies hardly inspires confidence in the light of At Large's declared objectives for the future.
