While this law takes effect from 1 January 2020, given its similarities to the GDPR and the fact it has been adopted in ICANN's place of incorporation, I would suggest we should consider the impact of this piece of legislation on the work of the EPDP as well. Ayden This EPDP has a very narrow focus to confirm or not the Temporary Specification. I do not support anything broader. I would hope that ICANN do things differently this time for a legislation with an effective date so well ahead, by not resorting to any emergency mechanisms, neither a Temp Spec or an EPDP. Rubens

Sure, but the focus of this ePDP and the temp spec is very specific. If we lose sight of that we’ll have a much bigger headache. I’m sure there’ll be plenty of analysis of the new Californian law, as well as plenty of legal challenges, so ICANN should (hopefully) have time to react if necessary Regards Michele -- Mr Michele Neylon Blacknight Solutions Hosting, Colocation & Domains https://www.blacknight.com/ http://blacknight.blog/ Intl. +353 (0) 59 9183072 Direct Dial: +353 (0)59 9183090 Personal blog: https://michele.blog/ Some thoughts: https://ceo.hosting/ ------------------------------- Blacknight Internet Solutions Ltd, Unit 12A,Barrowside Business Park,Sleaty Road,Graiguecullen,Carlow,R93 X265,Ireland Company No.: 370845 From: Epdp-dt <epdp-dt-bounces@icann.org> on behalf of Rubens Kuhl <rubensk@nic.br> Date: Sunday 1 July 2018 at 07:14 To: "Austin, Donna" <Donna.Austin@team.neustar> Cc: "epdp-dt@icann.org" <epdp-dt@icann.org> Subject: Re: [Epdp-dt] California Consumer Privacy Act of 2018 I would hope that ICANN do things differently this time for a legislation with an effective date so well ahead, by not resorting to any emergency mechanisms, neither a Temp Spec or an EPDP. Thanks- All good points; I agree this particular EPDP needs a narrow scope As hinted at below, perhaps this new law is one whose impacts (if any) can be addressed through a traditional PDP. In the future I hope we become better at respecting and understanding the impact of national laws on our activities. Thanks Ayden. It's an interesting finding but my constituency considers that the EPDP should remain focused on the temp spec.
