Dear Colleagues, This is a reminder that the PP IRT will meet tomorrow, 6 Sept, at 1600 UTC. Please note that all edits proposed by Volker have also been supported by Theo, Sara, Chris, and Eric. Agenda: 1. Discussion Topic 1: Do you believe that the Privacy and Proxy Service Provider Accreditation Program Implementation Review Team should consult with the GNSO Council prior to proceeding to public comment due to one or more Policy questions surrounding the implementation of the Final Recommendations? * Background: Please note that ICANN Legal has advised that data processing provisions are necessary in PPAA (as proposed in Section 3.5.3.3 and Specification 8), though the current text may be edited based on IRT feedback. * Draft WHOIS2 Report: Also, please note that the impact of GDPR on PP was raised in the WHOIS2 draft report that was published yesterday for public comment, https://www.icann.org/en/system/files/files/draft-rds-whois2-review-31aug18-... (see p. 67-9). The report said that GDPR and other privacy regimes might reduce the apparent need for PP services, but that this impact would have to be assessed in concert with any future review of the effectiveness of the policy. The report also raised points related to fees and the time that was required for the recent Legal review. Amy, can you specify what are the "one or more policy questions" referred to in the survey monkey poll? You seem to be suggesting there is something in the Whois2 report that identifies these questions. If so, are we expected to have ingested the 176-page report in time to complete the poll by your Friday deadline? Hi Steve and All, Certainly. Apologies if this appeared to be an ICANN org acknowledgement that 1 or more questions of Policy have arisen at this stage. That was not the intent. The survey asks whether one or more Policy questions exist, in the IRT's assessment, because that's the procedural hook to refer questions to the Council once we are in the implementation phase. If there's not a Policy question, there may not be a basis for asking for Council guidance (this is my personal understanding of the process, not an official ICANN org position). The reference to the WHOIS2 report was additional background only-not a basis for the IRT to use in deciding whether or not the Council should be consulted at this stage. The report may be of interest given its reference to this project, including some of the topics we've discussed recently. I am not expecting the IRT to process this report between now and Friday. As member of the RT, please let me clarify. We were tasked with analysing the implementation of the recommendations of the previous RT on this topic and found that we were unable to assess the implementation as it, quite simply, wasn't there yet. Similarly, it was too early to assess the impact of GDPR on the use of the services. Hence the below reference that this should be a subject for future review. Our thoughts on this were that once the effectiveness of the policy comes up for review, this subject should be included in such a review. There was no intent by the RT to make this a prerequesite for the implementation that would delay the implementation work, to the contrary, we were all agreed that implementation should not face further obstacles through our report.
