Regarding the proposed change to the comments as to Recommendation 14, I think this question would have to be rephrased to ask how the Recommendation fits within the Mission specified in 1.1 (a). The reason for this is that the big “carve-out” from 1.1 (c) is the “express scope of Section 1.1(a)”: [cid:image001.png@01D2C29B.53AF6A10] So it seems the question in the draft comment to Recommendation 14 would have to be “How is this recommendation consistent with the express scope of ICANN’s Mission as set forth in Section 1.1(a) of the ByLaws?” The draft comment currently says: “On the 10 April WG call, members of the CCT-RT provided additional context for this recommendation. According to the CCT-RT members, research findings indicate that end users expect to see a relationship between TLDs and the meaning of the string and/or usage of associated domains. It seems that the spirit of this recommendation is to create incentives to encourage that correlation, so as to promote user trust.” Section 1.1(a) of the ByLaws provides: Section 1.1. MISSION (a) The mission of the Internet Corporation for Assigned Names and Numbers (“ICANN”) is to ensure the stable and secure operation of the Internet’s unique identifier systems as described in this Section 1.1(a) (the “Mission”). Specifically, ICANN: (i) Coordinates the allocation and assignment of names in the root zone of the Domain Name System (“DNS”) and coordinates the development and implementation of policies concerning the registration of second-level domain names in generic top-level domains (“gTLDs”). In this role, ICANN’s scope is to coordinate the development and implementation of policies: • For which uniform or coordinated resolution is reasonably necessary to facilitate the openness, interoperability, resilience, security and/or stability of the DNS including, with respect to gTLD registrars and registries, policies in the areas described in Annex G-1 and Annex G-2; and • That are developed through a bottom-up consensus-based multistakeholder process and designed to ensure the stable and secure operation of the Internet’s unique names systems.
