While discussing the draft report on auctions during last week’s plenary, Jeff asked that the person who forwarded an example of irregularities with auctions to the WT leadership and staff, send that information to the entire list. Per Jeff’s request, I am now doing that. I forwarded an article co-authored Paul Livesay formerly from Verisign, and Jose Ignacio Rasco, from Nu Dotco, LLC http://www.circleid.com/posts/20161107_afilias_cynical_attempt_to_secure_a_w... What caught my eye was this paragraph. “The Applicant Guidebook prohibits all applicants within a contention set from discussing "bidding strategies" in advance of an auction — termed the Blackout Period. Violation of the Blackout Period is a "serious violation" of ICANN's rules under the Bidder Agreement, and may result in forfeiture of an applicant's application. Afilias committed such a violation, and should be disqualified. On July 22, just four days before the public ICANN auction for .web, Afilias contacted NDC again to try to negotiate a private auction if ICANN would delay the public auction. Afilias knew the Blackout Period was in effect, but nonetheless violated it in an attempt to persuade NDC to participate in a private auction that would net Afilias millions of dollars even if it lost.” Jonathan Robinson also posted in the Adobe chat a piece he authored - http://www.circleid.com/posts/20161028_dot_web_is_icanns_first_test_of_accou... While this group is a forward looking group and has no remit over this particular auction, these pieces do inform the WG that auctions may not have gone as smoothly as people think and we do need to take a hard look at the auction process going forward. Jeff et al, Regarding the “last call for input on SAC 090 matrix”, I don’t think that document can be finalized until SubGroup B has reviewed public comment. The reason is that there are still issues to be considered there and the WG should not be finalizing anything for “last call” until public comment on the issues has been reviewed and discussed and then shared with the entire Working Group. At present, the document represents “Interim Status as of the Initial Report before Public Comment”. By way of example, there is a change to the language on Recommendation 2 which discusses the SAC Recommendation 2 in relation to Special Use Domain Names. The change adds that the WG is considering how changes to these names should be “treated during the application window” as well as after delegation. The subject of changes to Special Use Domain Names post-application was not considered or discussed in Work Track 4 as far as I know. Separately, regarding SAC 90 Recommendation 4, I don’t think the issue is what the PDP WG thinks is meant by the word “complete this work”. Rather, the PDP WG needs to address the public comments on the Initial Report in order to respond to this Recommendation. I can talk to this on the call but I have a different issue with the term “last call.” My understanding is that there is or will be outreach to the SSAC to get clarity around a few items and until we get that, discuss it, and reflect it in the document I don’t think we can close it off. We may be able to table it until we get the clarity, but it shouldn’t be closed off.
