I am not at my computer so cannot email an attachment at the moment.
For clarity, it was not my paper, it was submitted by another WG member, perhaps LegitScript and/or Faegre/FWD Strategies. I would definitely encourage a look before making a determination about current legislation. It is an initial survey of just that, and while we had hoped it would encourage further dialogue, research and discussion, the opponents of the distinction largely ignored it.
It is referenced in the statement that we submitted to the initial report in favor of the transactional distinction and there is a link.

Hi Mary and All, Unlike Subteam 3, which is trying to interpret the meaning of the SDP comments as they apply to the Court Order v. Annex E issues, the meaning and application of the SDP comments here, all 10042 of them, is clear and directly applicable. Additionally, there must be ways to run word searches against the SDP supplemental comments added by many of commenters to see if they made any additional points relevant to our subteam's work.

As mentioned on the last WG call, staff had not included comments or statements from either the Respect Our Privacy template email or the Save Domain Privacy petition in the templates to date, pending WG agreement on how best to approach these. This past week, Sub Team 3 (for Annex E) has started considering the statements from both groups that relate to “verifiable evidence” for disclosure (Save Domain Privacy) and that information should not be disclosed without a court order (Respect Our Privacy).
Looking at the comments in question, the one specific point that would seem to be relevant to this Sub Team’s review is the statement from the Save Domain Privacy petition that supports “the use of privacy services by all, for all legal purposes, regardless of whether the website is “commercial”.”
As Sub Team 3 has already noted, the petition was signed by 10,042 persons, a number of whom also sent in additional comments specific to one or more of the statements in the petition.
If this Sub Team is going ahead with a call this week to review the documents to date, perhaps the question of where and how to consider the above statement can also be discussed then, or alternatively Sub Team members may want to weigh in via email to this list with their suggestions?

The Public Comment Review Tool doesn’t seem to include the 10,000+ comments from the Save Domain Privacy crowd. When will these comments be listed as comments 90 to 10,090 (or so) on our Subteam 2 Public Comment Review Tool? Seems like their comments in general are completely relevant to subteam 2, question 1 about whether we should break out categories of commercial transactions to bar proxy/privacy.

I went back and checked the source of the comment, just to be sure. The commenter basically answered the three questions that were posted on this Section 1.3.3, taking care to include the actual questions. The specific comment you highlighted came at the end, with no other specific reference or pointer to any other WG recommendation or question. That’s why I put it in the 1.3.3. Template even if it seems a bit out of place, so that the Sub Team can decide if it’s more appropriate to refer this back to the WG, e.g. as being a comment more associated with de-accreditation or transfer, or something else.

I have completed a summary of Question 3 responses utilizing the same format I used for Questions 1 and 2.
I found a comment that is not related to the question, which is why I believe we do need to review/analyze all of the comments received.
Mary -- Question 3 -- Response #8. Mandatory provisions should be included in an accredited P/P service provider’s terms of service, because the customer should be given some time to look for another P/P service provider. I would think giving them a week after being notified by the P/P service provider is enough time to look and apply for another. I would not think there would be any delays in getting another P/P service provider, so I would not be against going as low as a 48-hour grace period. This would give the customer enough time to protect their information.

Best, Kathy : Hi Kathy - staff will defer to the Sub Team and the Working Group's decisions but nevertheless we would say that at minimum the comments and responses to all questions would merit some collation and consideration, even if ultimately the consensus is that the outcome of a threshold question is such as to render other questions and responses thereto either moot or not requiring modifications to what's in the Initial Report, for instance.
As such, we would respectfully suggest that at least a preliminary sweep through these other questions and responses be conducted, so that as a Working Group we can document that the group did indeed review and consider all input received per the expectations of the GNSO's PDP manual.

Going back to Lindsay’s original email suggestion and given everyone’s
commitments and schedules, how does the following approach sound?
First, let’s get some volunteers to take on the preliminary review of
Questions 3 and 4 (which have many fewer responses than Questions 1 and 2,
which Lindsay and Terri have already covered). The summary/analysis can be
based on either Terri’s or Lindsay’s document formats. A possible “due
date” for these documents could be a week from now, i.e. Wednesday 12
August.
Secondly, the Sub Team can convene a call next week to discuss your
collective agreement on what recommendations to make to the full WG in
respect of Questions 1 & 2. Assuming that any additional entries to these
questions (based on the forthcoming staff collation of comments for the
WG’s recommendations #10-20) can be provided to you all by the end of this
week, perhaps this call can take place next Wednesday or Thursday?
Thirdly, a similar discussion/call on Questions 3 and 4, plus an overall
assessment of the Sub Team’s recommendations on all the questions, can be
scheduled for the week following, to give everyone a chance to review
what’s been done. The final consensus can then be compiled into a single
report for the full WG following this.
I hope the above suggestions are useful, even if they are merely a
starting point for this group to decide when and how best you’d like to
proceed, and who is to volunteer for what.

As I understand it, the purpose of the call will be mostly

picked out those comments made by submitters that are directly

this Sub Team (even if the submitters made those comments in apparent
response to other questions/recommendations). I’ve highlighted the
additions in yellow in the attached updated Review Tool for this Sub
Team
- basically, there are four additional rows for Question 1 and two
additional rows for Question 2 (sorry, Lindsay and Terri - I can help
with
incorporating them into your existing summary documents if you
prefer).
It may be that there will be more such moves and additions as I
complete
the overall Review Tool for the remainder of the WG’s preliminary
recommendations. I’ll try to do that as quickly as I can this week,
and of
course will alert your group if there are to be further additions to
your
material. I’ll upload each update to the Sub Team wiki as well, so
everyone can see what the latest documents from everyone else is.

You can take a look at the current summary documents from Sub Team 1

Section 1.3.2): https://community.icann.org/x/zoZCAw. FWIW Sub Team 3
(for Annex E) is adopting a similar approach of dividing its work
into
“buckets” based on the questions, and having different people sign
up for
each “bucket”. For now, Sub Team 3 is using the template provided by
staff, though re-organizing into their “buckets”. They also plan on
preparing some statistics (e.g. X number of people answered No, Y
number
of people answered No with this specific condition, etc.) for their
report to the WG.
Please feel free to adopt whichever approach and documentation works
best
for this group. Staff will compile the final output from each Sub
Team
and organize them into a consistent format (which is why we hope the
staff-provided template will be useful!)

Given the extensive nature of the comments (especially for the more
general Question 1) and the fact that there are 7 members of this
Sub
Team, would it be a good idea for this Sub Team to divide the work
such that 3 people (for instance) can do the first sweep through
Question 1 (perhaps taking 25-30 comments each), 2 take on
Question 2
(dividing the comments in half), 1 person do Question 3 and the
last
person do the remaining general comments?
This could be the first phase, and each person could use the same
format to ensure consistency - whether that be the template
provided
or something like what Sub Team 1 (for Section 1.3.2) is doing, per
this week¹s report.
Following this initial phase, the Sub Team can then come together
(having read one another¹s submissions) to agree on recommendations
to be made by the Sub Team as a whole to the WG.
If this approach makes sense, perhaps we can take volunteers for
each
³sub part² so that there will be something to report back to the
full
WG with this coming Tuesday?

I am not at my computer so cannot email an attachment at the moment.
For clarity, it was not my paper, it was submitted by another WG member, perhaps LegitScript and/or Faegre/FWD Strategies. I would definitely encourage a look before making a determination about current legislation. It is an initial survey of just that, and while we had hoped it would encourage further dialogue, research and discussion, the opponents of the distinction largely ignored it.
It is referenced in the statement that we submitted to the initial report in favor of the transactional distinction and there is a link.

As mentioned on the last WG call, staff had not included comments or statements from either the Respect Our Privacy template email or the Save Domain Privacy petition in the templates to date, pending WG agreement on how best to approach these. This past week, Sub Team 3 (for Annex E) has started considering the statements from both groups that relate to “verifiable evidence” for disclosure (Save Domain Privacy) and that information should not be disclosed without a court order (Respect Our Privacy).
Looking at the comments in question, the one specific point that would seem to be relevant to this Sub Team’s review is the statement from the Save Domain Privacy petition that supports “the use of privacy services by all, for all legal purposes, regardless of whether the website is “commercial”.”
As Sub Team 3 has already noted, the petition was signed by 10,042 persons, a number of whom also sent in additional comments specific to one or more of the statements in the petition.
If this Sub Team is going ahead with a call this week to review the documents to date, perhaps the question of where and how to consider the above statement can also be discussed then, or alternatively Sub Team members may want to weigh in via email to this list with their suggestions?

The Public Comment Review Tool doesn’t seem to include the 10,000+ comments from the Save Domain Privacy crowd. Seems like their comments in general are completely relevant to subteam 2, question 1 about whether we should break out categories of commercial transactions to bar proxy/privacy.

I went back and checked the source of the comment, just to be sure. The commenter basically answered the three questions that were posted on this Section 1.3.3, taking care to include the actual questions. The specific comment you highlighted came at the end, with no other specific reference or pointer to any other WG recommendation or question. That’s why I put it in the 1.3.3. Template even if it seems a bit out of place, so that the Sub Team can decide if it’s more appropriate to refer this back to the WG, e.g. as being a comment more associated with de-accreditation or transfer, or something else.

I have completed a summary of Question 3 responses utilizing the same format I used for Questions 1 and 2.
I found a comment that is not related to the question, which is why I believe we do need to review/analyze all of the comments received.
Mary -- Question 3 -- Response #8. Mandatory provisions should be included in an accredited P/P service provider’s terms of service, because the customer should be given some time to look for another P/P service provider. I would think giving them a week after being notified by the P/P service provider is enough time to look and apply for another. I would not think there would be any delays in getting another P/P service provider, so I would not be against going as low as a 48-hour grace period. This would give the customer enough time to protect their information.

Best, Kathy : Hi Kathy - staff will defer to the Sub Team and the Working Group's decisions but nevertheless we would say that at minimum the comments and responses to all questions would merit some collation and consideration, even if ultimately the consensus is that the outcome of a threshold question is such as to render other questions and responses thereto either moot or not requiring modifications to what's in the Initial Report, for instance.
As such, we would respectfully suggest that at least a preliminary sweep through these other questions and responses be conducted, so that as a Working Group we can document that the group did indeed review and consider all input received per the expectations of the GNSO's PDP manual.

Going back to Lindsay’s original email suggestion and given everyone’s
commitments and schedules, how does the following approach sound?
First, let’s get some volunteers to take on the preliminary review of
Questions 3 and 4 (which have many fewer responses than Questions 1 and 2,
which Lindsay and Terri have already covered). The summary/analysis can be
based on either Terri’s or Lindsay’s document formats. A possible “due
date” for these documents could be a week from now, i.e. Wednesday 12
August.
Secondly, the Sub Team can convene a call next week to discuss your
collective agreement on what recommendations to make to the full WG in
respect of Questions 1 & 2. Assuming that any additional entries to these
questions (based on the forthcoming staff collation of comments for the
WG’s recommendations #10-20) can be provided to you all by the end of this
week, perhaps this call can take place next Wednesday or Thursday?
Thirdly, a similar discussion/call on Questions 3 and 4, plus an overall
assessment of the Sub Team’s recommendations on all the questions, can be
scheduled for the week following, to give everyone a chance to review
what’s been done. The final consensus can then be compiled into a single
report for the full WG following this.
I hope the above suggestions are useful, even if they are merely a
starting point for this group to decide when and how best you’d like to
proceed, and who is to volunteer for what.

As I understand it, the purpose of the call will be mostly

picked out those comments made by submitters that are directly

this Sub Team (even if the submitters made those comments in apparent
response to other questions/recommendations). I’ve highlighted the
additions in yellow in the attached updated Review Tool for this Sub
Team
- basically, there are four additional rows for Question 1 and two
additional rows for Question 2 (sorry, Lindsay and Terri - I can help
with
incorporating them into your existing summary documents if you
prefer).
It may be that there will be more such moves and additions as I
complete
the overall Review Tool for the remainder of the WG’s preliminary
recommendations. I’ll try to do that as quickly as I can this week,
and of
course will alert your group if there are to be further additions to
your
material. I’ll upload each update to the Sub Team wiki as well, so
everyone can see what the latest documents from everyone else is.

Hi Kiran and everyone,
You can take a look at the current summary documents from Sub Team 1
(for
Section 1.3.2): https://community.icann.org/x/zoZCAw. FWIW Sub Team 3
(for Annex E) is adopting a similar approach of dividing its work
into
“buckets” based on the questions, and having different people sign
up for
each “bucket”. For now, Sub Team 3 is using the template provided by
staff, though re-organizing into their “buckets”. They also plan on
preparing some statistics (e.g. X number of people answered No, Y
number
of people answered No with this specific condition, etc.) for their
report to the WG.
Please feel free to adopt whichever approach and documentation works
best
for this group. Staff will compile the final output from each Sub
Team
and organize them into a consistent format (which is why we hope the
staff-provided template will be useful!)

Given the extensive nature of the comments (especially for the more
general Question 1) and the fact that there are 7 members of this
Sub
Team, would it be a good idea for this Sub Team to divide the work
such that 3 people (for instance) can do the first sweep through
Question 1 (perhaps taking 25-30 comments each), 2 take on
Question 2
(dividing the comments in half), 1 person do Question 3 and the
last
person do the remaining general comments?
This could be the first phase, and each person could use the same
format to ensure consistency - whether that be the template
provided
or something like what Sub Team 1 (for Section 1.3.2) is doing, per
this week¹s report.
Following this initial phase, the Sub Team can then come together
(having read one another¹s submissions) to agree on recommendations
to be made by the Sub Team as a whole to the WG.
If this approach makes sense, perhaps we can take volunteers for
each
³sub part² so that there will be something to report back to the
full
WG with this coming Tuesday?
