If I am correct that it is currently timely to propose new POSSIBLE requirements, even if not associated with a particular document, I suggest adding the following. I have numbered them in accordance with the POSSIBLE requirement on which they elaborate or to which they respond (or provide an alternative). Since they do not arise from the EWG Final Report, I have for now substituted "xx" for "D1." [UP-xx-R11A] --- Legal Actions --- investigating possible legal claims arising from use of a domain name, including contacting registrant or its legal representative. [UP-xx-R14A] - Providing a public record of domain name ownership, accessible by the public for any lawful use. [GA-xx-R15A] - Accredited Requestors may pre-identify purposes that will apply to all or some of their queries over a specified time frame. [GA-xx-R37A] - Other than in exceptional circumstances, accreditation of users for access to data should take place in real time. [GA-xx-R50A] - A process for responsible sharing of gated data within an accredited requester organization, with its affiliates, with its clients, or with similar third parties must be created and enforced. [DA-xx-R17A] - All mandatory contact data elements for a particular purpose must be validated operationally before the corresponding registration is activated. [DE-xx-R30A]-The "designated role" for each purpose-based contact must be clearly defined and communicated to registrants and to persons/entities designated as contacts, as well as to requestors. Based on the Article 29 correspondence noted below (including the back and forth with ICANN), I think we can say that a possible requirement is that there should be a specified period of time for data retention passed the contract period that is consistent with applicable law. I also have a question generally about the Article 29 materials. As (if I understand it properly), the EU data retention regulations have been promulgated and go into effect in 2 years, should we be looking at those for possible requirements and/or should we note that the article 29 working papers possible requirements may be superseded by the regulations? Good questions Victoria. I suggest erring on the side of inclusiveness at this stage. In other words, including all possible requirements that should be considered in the near and longer term. When we deliberate we can consider timing more thoroughly.
