May I suggest the group dedicate some time to the long established Rights Protection Mechanisms (RPMs) for ".COM" which stated, Pre-ICANN; and in all the RAA's that followed, that ".COM" Domain Name Registrants have always been prohibited from Infringing others. Now quickly, I'll remind participatnts that when Louis Touton was doing his "volunteering" on leave from Jones Day, for ICANN, during the first round of NEW gTLD expantion, CentralNic's ~ *Domain Name = uk.COM* ~ never made the leap, during the ICANN Meeting in Japan. As such, CentralNic's Domain Name was; and remained under the In-House, Terms of Use, issued by Network Solutions / VeriSign in addition to the RAA of ICANN, at Section 3.7.7.9. This is a fact that Jones Day's Eric Enson as Cc'd will no doubt confirm. As will some of ICANN's other *well funded DNSO travellers [not Cc'd] *having "*served*" the "Trademark, intellectual property, anti-counterfeiting interests" since way back in 1999 will remember.
