Competitive Bidding Process and Selection of Independent Examiner In connection with the open competitive bidding process used to select the independent examiner, a total of 7 proposals were submitted. All bids were reviewed and evaluated for all data responsive to the RFP, not just the low bid. Price was one of many considerations. Bids received ranged from less than $50,000 to over $1 million, with the lowest and highest representing significant outliers. Westlake's bid pricing was in the median range when adjusting for the significant outliers. Once all bids were evaluated, Westlake was selected as the most qualified consultant relative to, but not limited to, the following high level selection criteria: 1) Understanding of the assignment 2) Knowledge and expertise a. Demonstrated experience in conducting broadly similar examinations b. Not-for-profit experience c. Basic knowledge of ICANN d. Geographic and cultural diversity, multilingualism, gender balance e. Suitability of proposed CVs 3) Proposed methodology a. Work organization, project management approach, timelines b. Suitability of tools and methods or work c. Clarity of deliverables 4) Flexibility, including but not limited to meeting the timeline 5) Reference checks 6) Financial value 7) Conflict of Interest => Additional information about the RFP<http://www.icann.org/en/news/announcements/announcement-22apr14-en.htm> => GNSO Review FAQs<https://community.icann.org/x/zbXhAg> Staff is available to provide the GNSO Council a more complete overview of how the competitive bidding/RFP process functions, including what information is required to be kept confidential for the benefit of the process' integrity. Review Methodology The methodology used for the GNSO Review followed best practices and professional standards for independence, proficiency and due professional care. The current GNSO Review achieved 178 completed 360 Survey responses and 40 one-on-one interviews, compared with an average of 71 survey responses and 60 interviews for prior Organizational Reviews. Information was collected through a variety of means - online 360 Survey with quantitative and qualitative aspects, one-on-one interviews that resulted in twice as many individuals interviewed as originally planned, extensive desk review of documents and in-person observations during three ICANN meetings. Additionally, Westlake participated in the majority of the 21 GNSO Review Working Party calls and 23 public sessions held at ICANN meetings and considered feedback provided by the GNSO Review Working Party as well as by others through formal public comment process and other feedback means. Washington, DC 20548 Dear Mr. Dodaro: On March 14, 2014, the National Telecommunications and Information Administration ("NTIA") announced its intent to relinquish oversight of Internet domain name functions to the "global stakeholder community." This proposed transition raises questions about NTIA's authority to transfer possession and control of critical components of the Internet's infrastructure to a third party. The Internet as we know it has evolved from a network infrastructure first created by Department of Defense researchers. One key component of that infrastructure is the root zone file, which the federal government currently designates as a "national IT asset."[1] Creation of the root zone file was funded by the American taxpayer and coordinated by the Department of Defense, and the file has remained under United States control ever since. Under Article IV, Section 3 of the Constitution, Congress has the exclusive power "to dispose of and make all needful rules and regulations respecting the territory or other property belonging to the United States." One question arising from NTIA's decision to transfer its Internet oversight functions to a third party is whether NTIA may relinquish possession and control of the root zone file-or any other similar component of the Internet that was financed and developed by the United States-without authorization from Congress. This concern was raised in 2000 by the Government Accountability Office ("GAO"), which questioned whether NTIA could relinquish authority over the root zone file and concluded that it was "unclear whether such a transition would involve a transfer of government property to a private entity."[2] The 2000 GAO report further detailed that the Department of Commerce advised the GAO at the time that "we have not devoted the possibly substantial staff resources that would be necessary to develop a legal opinion as to whether legislation would be necessary" to authorize transfer of the root zone file. Congress should be made aware of the legal status of the root zone file-or any other potential government property-before it makes any final decisions about whether to transfer the government's Internet oversight functions to a third party. Some observers and parties involved in the proposed transfer have asserted that the termination of NTIA's contract with ICANN would not result in the transfer of United States Government property.[3] Others believe that termination of this contract would result in government property being transferred to ICANN and point to a number of factors that would indicate that the root zone file and other contractual deliverables are property of the United States. Supporters of this position point to the fact that the United States acquired title to the root zone file because it was invented pursuant to Department of Defense contracts.[4] In addition, the United States has long claimed ownership or control over the root zone file. For example, President Clinton's Internet "czar" Ira Magaziner asserted United States ownership of the entire Domain Name System because "[t]he United States paid for the Internet, the Net was created under its auspices, and most importantly everything [researchers] did was pursuant to government contracts."[5] Additionally the Commerce Department's contract with ICANN explicitly declares that "[a]ll deliverables provided under this contract," including the "automated root zone," are "the property of the U.S. government."[6] And Verisign and ICANN contracts make clear that changes to the root zone file cannot be made without approval of the Department of Commerce.[7] Congress has also been actively engaged in managing the root zone file. Recently, it enacted the Consolidated and Further Continuing Appropriations Act of 2015, which explicitly prohibited the Commerce Department from using federal funds to relinquish stewardship of the domain name system, "including responsibility with respect to the authoritative root zone file."[8] Given this history, we are concerned that NTIA might potentially relinquish ownership of some form of United States property. To inform the Congress so that it may take any necessary and appropriate steps regarding NTIA's planned transition of the IANA functions, we would like the GAO to conduct a review to address a number of specific questions. 1. Would the termination of the NTIA's contract with ICANN cause Government property, of any kind, to be transferred to ICANN? 2. Is the authoritative root zone file, or other related or similar materials or information, United States government property? 3. If so, does the NTIA have the authority to transfer the root zone file or, other related materials or information to a non-federal entity? Please include in this report a description and analysis of the relevant legal authorities and case law dealing with the transfer of United States Government property. Fellow IPC Members, I am extremely pleased to report to you that the Commercial Stakeholders Group and the Non-Commercial Stakeholders Group have jointly nominated Heather Forrest of the IPC as the Non-Contracted Parties House candidate for Chair of the GNSO Council. I think that this is a great moment for the IPC, the CSG, the NCSG, then NCPH and the GNSO. Our ability to work together and come to a common understanding (and a timely one) is critical not only for our interests but for the future of the GNSO and the multistakeholder model. As with any multistakeholder exercise, this was the result of a process; in this case, we see that the process can bring us all to a positive result. Congratulations, Heather! On to the election.... The NomCom is charged with recruiting and selecting a portion of ICANN's leadership. The NomCom is mandated to ensure that ICANN's overall leadership is diverse in geography, culture, skills, experience and perspective. The basic criteria is that selectees are people of integrity, objectivity, sound judgment, support decision-making within groups, work effectively in English, understand ICANN's mission and operation, are committed to its success, have experience in world affairs, contribute to cultural, professional and geographic expertise, and can work long and hard, generally as volunteers, for the global public trust. An independent body at the community's service Discussing the 2015 Nominating Committee results, Stephane Van Gelder, the Chair of the 2015 NomCom, shared the following: "As Chair, it is my honor, pleasure and duty to report that the 2015 Nominating Committee has completed the task assigned to it by the ICANN Community and made the selections shown above. By the close of the application period on 15 March 2015, the 2015 Nominating Committee had received 81 applications for the nine positions it was tasked with filling. Once this work was completed, the 2015 Nominating Committee was then called upon to select a replacement for the position of North American ALAC representative, following the resignation of its previous selectee to that position and received nine applications for that position. I want to thank the Nominating Committee members for working diligently through these two separate processes. It is rare that a NomCom gets called back to reselect for another position once its main slate for the cycle has been decided. This year's members had to withstand the added pressure of this late selection, whilst continuing to work as a group fully independent of ICANN's SOs, ACs and the Board. They rose to this challenge and completed their assigned tasks with aplomb and integrity. I could not agree more. The CCWG-Accountability deserves much applause for its tremendous and impressive work leading to the 2nd Draft Proposal, this most recent public comment period and for its commitment to bring this process to a successful conclusion. It hasn't always been easy. The Board has tried to act in good faith throughout this process, weighing the most appropriate and helpful times to contribute, and in what manner in this unprecedented community effort. The CCWG meeting in Los Angeles comes at a critical time. While it's easy to analyze the areas where consensus still needs to be reached, it is important to also recognize the many elements of the accountability proposal that have reached broad support. In studying the public comments, we agree with the CCWG that there are many areas of agreement and we look forward to contributing as a part of the community to refine and build upon the 2nd Draft Proposal to create the necessary enhancements to ICANN's accountability. It is more important to get this work done right than it is to get it done quickly. However, should the group not focus on the core accountability requirements to fill the backstop role of the U.S. Government, I fear that it will drive the transition towards delay or even possible failure after being so close to completion. A lot of work has been done by our community, in the CCWG and at the ICG, and the crafting of these two dynamic proposals has been a testament to the capability of the multistakeholder community – we must not let this moment pass. I am personally looking forward to using this time in Los Angeles to contribute constructively to the work of the CCWG and remain confident we will continue to enhance what we have built together. The report is ICANN's assessment of the effectiveness and efficiency of its implementation of the program, and is intended to help inform a community review team's assessment of the application and evaluation processes. This document is intended to share ICANN's perspective on the execution of the New gTLD Program, but as part of the review, ICANN considered feedback from the many stakeholders who played a major role in the program, including applicants, service providers and other members of the community. With the draft report now published for public comment, ICANN is seeking additional input from stakeholders.
