Dear IPC Members, As Fab and I are not going to Marrakech, the IPC has one ICANN-funded travel support slot (in addition to IPC funded travel support slots) to allocate to an IPC member who is planning to attend ICANN55 in person. The IPC Leadership has been asked for a quick reply to designate the ICANN funded person. You will have to fill out ICANN Constituency Travel Forms, which includes providing ICANN with your banking information, and work with ICANN travel to arrange flights. ICANN assigns the hotel and pays a modest per diem. · Preference will be given those members who are actively engaged in the IPC and ICANN. · Recipients must attend all IPC/CSG/GNSO sessions including the GNSO weekend. Exploring the "Public Interest Within ICANN's Remit"

Discussions on this topic have been ongoing for some time now, and in 2013, the Strategy Panel on the Public Responsibility Framework <https://www.icann.org/resources/pages/public-responsibility-2013-10-11-en> was tasked with exploring defining this term and the separate but related topic of public responsibility. The Panel, informed by open discussions at ICANN meetings, webinars and through a public comment period, produced a report in May 2014, which proposed the definition of ‘public interest’ as follows: *“Ensuring that the Internet becomes, and continues to be, stable, inclusive, and accessible across the globe so that all may enjoy the benefits of a single and open Internet. In addressing its public responsibility, ICANN must build trust in the Internet and its governance ecosystem.”* While some welcomed the report and recommendations, it is evident that there is a desire and need to further explore what the term ‘public interest’ means within ICANN’s remit. In response to requests to prepare for such exploration (at a time when all have sufficient bandwidth to do so) staff have been compiling some initial resources and research on this theme. As per recommendations received during conversations on this preparatory work, these resources have been placed on a community wikispace on Confluence and can be located here <https://community.icann.org/x/epRYAw>. To facilitate discussion on next steps, a mailing list has also been created as a forum for dialogue and coordination, found here <https://mm.icann.org/mailman/listinfo/publicinterest>. Additionally, a request has been submitted to hold a High Interest Session at ICANN55 that will be collaboratively designed providing an informed and comprehensive base from which to initiate discussions on next steps. This will require global, multistakeholder, bottom-up discussion and ICANN wants to make sure that, when the time is right, there are enough resources and background research available. We all will need to understand the operational, legal, and fiscal parameters and limitations to any potential definition(s). We had 12 candidates for 7 spots and a tough choice. We thank all 12 for volunteering. Greg and I have been on several planning calls and we are taking suggestions for proposed topics. There will be slot for an accountability discussion. We have also suggested tackling GNSO election issues and identifying tough topics for which we can attempt to find common ground. ICANN Blog: Reflections on the WSIS+10 High-Level Meeting https://www.icann.org/news/blog/wsis-10-hlm#.Vnga0UtX06Y.email After a lot of hard work and collaboration, the world has just witnessed the successful close of the United Nations General Assembly High-Level Meeting, on 15-16 December, on the overall review of the implementation of the outcomes of the World Summit on the Information Society (WSIS+10 HLM <https://publicadministration.un.org/wsis10/GA-High-Level-Meeting>). This all started 12 years ago in Geneva, where representatives from around the world declared a common desire and commitment to build a people-centered, inclusive and development-oriented information society at the World Summit on the Information Society (WSIS <http://www.wsis.org/>). Two years later, this same group met in Tunisia for a second time where they confirmed a consensus statement called the Tunis Agenda <http://www.itu.int/net/wsis/docs2/tunis/off/7.pdf>, which among other things, created the Internet Governance Forum (IGF <http://intgovforum.org/>), the mandate of which was extended for another ten years at the WSIS+10 high-level meeting. Since 2005, different United Nations agencies, including the International Telecommunications Union (ITU), the United Nations Conference on Trade and Development (UNCTAD) and the United Nations Educational, Scientific and Cultural Organization (UNESCO), have been facilitating the implementation of aspects of the Geneva and Tunis WSIS outcomes, including the so called “Action Lines <http://www.itu.int/net/wsis/implementation/>.” One issue also outlined in the Tunis Agenda was the conducting of an overall review of the implementation of theseWSIS outcomes in 2015. The review process was initiated with a dialogue in early 2013, which started in conferences hosted by UNESCO in February 2013 and the ITU in June 2014. The following year, UNCTAD was mandated to carry out a ten-year review of the WSIS outcomes that it concluded in June 2015. Along with many otherWSIS stakeholders, I had the honor of attending these preparatory events that ICANN contributed to. This past June, the President of the United Nations General Assembly (UNGA) appointed <http://www.un.org/pga/wp-content/uploads/sites/3/2015/06/010615_World-Summi…> two ambassadors - the permanent representatives of the United Arab Emirates and Latvia to the UN - to co-facilitate the WSIS+10 review process in New York. It was decided that the overall WSIS review would be conducted as a two-day high-level meeting of the General Assembly to take stock of the progress made in implementation of the outcomes and address areas for continued focus. The two ambassadors facilitated a successful process to bring together all members of the UN, as well as representatives from the civil society, the business and technical communities in order to produce a final Outcome Document <http://workspace.unpan.org/sites/Internet/Documents/UNPAN95735.pdf>. We were pleased to see that the Outcome Document shows that the issue of Internet governance no longer evolves around the question of whether it should be *multilateral* or *multistakeholder. *Instead it recognizes the “Internet as a global facility includes *multilateral, transparent, democratic and multi-stakeholder processes*, with the full involvement of Governments, the private sector, civil society, international organizations, technical and academic communities, and all other relevant stakeholders in accordance with their respective roles and responsibilities.” This is an evolution from the 2005 Tunis Agenda, which had spoken of “*international* management of the Internet”, and was specific that it should be “*multilateral, transparent and democratic.*” This is a reminder that the Internet is not centralized, and its governance model is polycentric. We were conscious from the start of the WSIS+10 Review process that early engagement and building relationships of trust with both governments and the inter-governmental organizations were needed forICANN’s productive input in the consultations. This was facilitated through the work of ICANN’s Government Engagement and Global Stakeholder Engagement teams. Our executive staff engaged in a dialog globally, with the appropriate ministries and governments, as well as with the Missions to the UN in New York and Geneva, the UN, and the other inter-governmental organizations. This engagement work was also coordinated with ICANN’s Governmental Advisory Committee <https://gacweb.icann.org/display/gacweb/Governmental+Advisory+Committee> ( GAC). On 15 December 2015, I was privileged to participate in the co-facilitator’s welcome opening panel <http://webtv.un.org/watch/general-assembly-cofacilitators-welcome-high-leve…> ofWSIS+10, where I was asked about the current and future governance of the Internet. I noted how everything we all do now is affected by the digital revolution, and the governance of the Internet is a constantly evolving and challenging task for all of us. During the WSIS+10 HLM, whether in conversations with heads of delegations from developing or developed countries, there was recognition of the evolution that ICANN and its multistakeholder community has undergone in the last few years, towards becoming a widely recognized global organization. ICANN is looking forward to work with all stakeholders, including the I* organizations, in the future deliberations and discussions, as defined in the WSIS+10 Outcome Document. Governments, private sector, civil society and technical community have shown on various occasions that we can all work together on important issues, relevant to the global Internet community, as we did in Sao Paulo at the NETmundial <http://netmundial.br/> meeting in April 2014. In the meantime, there will be significant work done in the United Nations and its agencies for the implementation of the future WSIS follow-up work in using Information and Communication Technologies to help implement the recently agreed upon Sustainable Development Goals <http://www.itu.int/net4/wsis/sdg/Content/wsis-sdg_matrix_document.pdf>. After speaking with ICANN Board Director Lousewies van der Laan, she added, “The Outcome Document is neither the end nor the beginning of a process; it’s only one step in a continuous effort to keep the Internet open, secure and interconnected. ICANN has been and will continue to be engaged in the WSISprocess. We at ICANN look forward to increased dialogue, understanding and cooperation with the people from the UN, its agencies and the missions, to make sure the Internet continues to develop with full participation of all stakeholders.” As we look to the future, the WSIS+10 Outcome Document will serve as a way forward for the next ten years until the next high-level meeting.

It has been filled with many ups and downs, good moments and challenging ones, and a year of incredible work, compromise, negotiation and collaboration among all stakeholders. With the end of the year only days away, it's a good opportunity to reflect on all that has been accomplished and consider what's in store for the year ahead. In March 2014, we began the work of facilitating the IANA Stewardship transition process, working with the community to ensure it had what it needed to conduct its work. Earlier this year, in May 2015, NTIA reached out to the communities working on the transition proposal to ask how much time they thought they would need to finalize and implement their proposals. Based on the community's feedback, NTIA announced the contract extension <https://www.ntia.doc.gov/blog/2015/update-iana-transition> in August from 30 September 2015 to 30 September 2016, a period of time that includes the NTIA review and approval process and the implementation forecasts submitted by the community. Secretary Strickling has emphasized <https://www.icann.org/en/system/files/files/transcript-transition-facilitat…> [PDF, 183 KB] the timing by which NTIA must receive the final proposals to allow sufficient time on their part. Working backwards from September 2016, and taking into consideration the NTIA review and the implementation time, the community has been working tirelessly to finalize their proposals in January. Also over the past few months, our implementation team, led by Akram Atallah, President, Global Domains Division, began administrative preparation for the necessary implementation actions, including identifying projects based on the current proposals, creating high-level timelines and engaging with the community to better understand their reporting and oversight needs. As communicated to the community, we estimate implementation to take a minimum of four months. In collaboration with the community we hold monthly calls <https://www.icann.org/resources/pages/transition-facilitation-2015-09-23-en> regarding any expected changes to the community timelines. This provides a useful opportunity for the community working together to keep each other appraised of how any of their work may impact the community-established timeline. After all the progress at ICANN54, both the ICG and the CCWG-Accountability have noted their expected time frames. The ICG finalized its work at ICANN54 in Dublin, and provided a status update and proposal document shortly after the meeting concluded. The group awaits confirmation from CWG-Stewardship that its requirements have been met by the CCWG-Accountability, who laid out <https://www.icann.org/news/blog/cross-community-working-group-on-enhancing-…> a rigorous timeline to submit its Work Stream 1 Recommendations at the end of January 2016, which included development of a new Third Draft Proposal, public comment period and Chartering Organization approval. The Board submitted initial thinking based on the summary report <http://mm.icann.org/pipermail/accountability-cross-community/2015-November/…>, and have already submitted their full public comments <http://forum.icann.org/lists/comments-draft-ccwg-accountability-proposal-30…> to help meet the timeline, and the Chartering Organizations and many members of the community have been working diligently to get feedback in as soon as reasonably possible. While keeping the CCWG-Accountability busy through January, the goals set out by the CCWG-Accountability balance the various timeline constraints, both inside and outside of the community. However, while timeline concerns should continue to be addressed within the CCWG-Accountability, we cannot risk the ability of ICANN to effectively do its job on Internet identifiers for the sake of meeting that timeline. Staff will continue to do everything we can to help the CCWG-Accountability complete its work in time for NTIA to make a decision this year. What will the next year bring? The community's work reaching the next stages will be underway, and we look forward to supporting the community and its work. We want to be clear that as the CCWG-Accountability weighs the input from this public comment period, we are supportive of the timeline the community lays out both from a staffing and a resource perspective. We thank the CCWG-Accountability for their tremendous effort to meet this conclusion in time for a transition in 2016. On 19 November, 2015, the GNSO Council approved a charter <http://gnso.icann.org/en/council/resolutions#201511> for the Next-Generation gTLD Registration Directory Service (RDS) to replace WHOIS (Next-Gen RDS) Policy Development Process (PDP) Working Group. This motion culminates a three-year effort to address concerns with WHOIS by creating a new policy framework capable of balancing diverse interests to meet today's needs for gTLD registration data. What's Next The GNSO Council is now proceeding with the Board-requested PDP, using the approved charter's <http://gnso.icann.org/en/drafts/whois-ng-gtld-rds-charter-07oct15-en.pdf> [PDF, 628 KB] 3-phase process to (1) establish gTLD registration data requirements to determine if and why a next-generation RDS is needed, (2) design policies that detail functions that must be provided by a next-generation RDS to support those requirements, and (3) provide guidance for how a next-generation RDS should implement those policies, coexisting with and eventually replacing WHOIS. In its motion, the GNSO Council directed that the call for volunteers for the PDP WG be circulated as widely as possible in order to ensure broad representation and participation in the Working Group. This call will be initiated by 4 January 2016 and will remain open until the WG convenes for the first time. At this juncture, it is anticipated that the WG may convene late January to lay the groundwork for an initial face-to-face meeting at ICANN 55. Only with the help of the entire community can this PDP WG achieve its goal of formally defining an appropriate purpose of gTLD registration data and establishing a new policy framework to enable permissible access to that data with improved privacy and accuracy. Background and Recent Progress Created in the 1980s, WHOIS began as a service to identify and contact entities responsible for the operation of a network resource on the Internet. Over the years, ICANN's requirements for gTLD domain name registration data collection, access and accuracy have undergone some important changes. Yet, after nearly 15 years of task forces, review teams, and studies, comprehensive WHOIS policy reform remains the source of long-running discussion and debate. In 2012, the ICANN Board launched the Expert Working Group on gTLD Registration Directory Services (EWG) to help redefine the purpose of gTLD registration data and consider how to safeguard the data, and to propose a model for gTLD registration directory services (RDS) to address accuracy, privacy, and access issues. Upon publication of the EWG's Final Report in June, 2014, an informal group of GNSO Councilors and ICANN Board Members collaborated to propose a Process Framework for structuring a GNSO PDP to successfully address these challenging issues. This Process Framework was adopted by the Board in 2015, along with a reaffirmation of its 2012 request for a PDP to be convened to define the purpose of collecting, maintaining and providing access to gTLD registration data. The Board also asked that the PDP consider safeguards for protecting data, using the recommendations in the EWG's Final Report as an input to, and, if appropriate, as the foundation for a new gTLD policy.
