Dear José, First of all, let me confirm what Tijani wrote, i.e. that we are talking about the Board seat #15, not the general ICANN Director profile. I agree with you that the word reflect is not the best option, while at the same time I consider understand a bit too weak: understand should apply to the points of view of all constituencies, not only about users. Maybe interpret could be a better choice. Anyway, I believe that the point you make is important more because of the general question, rather than the choice of a single word. This issue about the fiduciary responsibility of the Directors to the whole organization, and not to the constituency that has appointed them, has been an ongoing debate for many years. While the Bylaws clearly state the former, I have no doubt that, until the current mechanism of selection of Board members allows specific parts of the community to appoint their candidates, it would be naïve to believe that these different parts of the community do not establish their additional requirements for the candidates. For instance, all Board Directors that have been selected by the GNSO have a deep understanding of the activities and interests of the GNSO. Same for the ASO and ccNSO-selected Directors. The fact that ALAC is the only component of the ICANN community that selects Directors with a process that is based on an open call for candidatures should not end up in preventing ALAC to choose a candidate that has some direct experience of the activities of the At-Large community and give some guarantees to be able to understand and interpret its needs. If it is only for our seat 15, it is logical to include this specific background, but should not be take as mandatory. The lines: member must be able to reflect the users' point of view and interests in the debate..." maybe has to be change for "member must to be able to understand the users' point of view and interests..." P erhaps for my poor Ingles I take "reflect" incorrectly , but sounds like it need some experience. For my point of view no experience is needed. Kind regards José.- 2013/12/3 Tijani BEN JEMAA <tijani.benjemaa@planet.tn> Dear José, When the EoI (previously called SoI) was conceived for the first round by the ABSdt (I was one of the members), we designed the document for the Board director selected by ALAC (Seat 15) not for the general case. In fact we took the requirements used for the general case (ICANN Bylaws), we added the requirements used by NomCom to select a board director, and we then added the At-Large requirements. This document is not for the general case; its for the selection of the Board director selected by ALAC only. ---------------------------------------------------------------------------- ---- Tijani BEN JEMAA Executive Director Mediterranean Federation of Internet Associations (FMAI) Phone: + 216 41 649 605 Mobile: + 216 98 330 114 Fax: + 216 70 853 376 ---------------------------------------------------------------------------- ---- De : José Francisco Arce [mailto:josefranciscoarce@gmail.com] Envoyé : mardi 3 décembre 2013 12:13 À : Tijani BEN JEMAA (tijani.benjemaa@planet.tn) Cc : ICANN At-Large Staff; LACRALO discussion list; Roberto Gaetano; Olivier Crépin-Leblond Objet : Re: [lac-discuss-en] CALL FOR EXPRESSIONS OF INTEREST for the Board Director Selected by At-Large now open through 26 December 2013 Thanks Tijiani for the clarification. But I still think that we should have 3 different EoI, because if knowlege of at-large community is a general requirement to be a Board Member I can not imagine that all the current menmber of the borad have that backgraund, and for my point of view they do not have to have it. It is crazy to think that, so the actual documment for the 3 categories should be review. Maybe Olivier can add something that we are missing. My 2 cents José Arce 2013/12/2 Tijani BEN JEMAA <tijani.benjemaa@planet.tn> Hi José, Sorry for the late reply. In fact, the EoI is the duty of the BCEC, and this reply is a personal opinion. You know, the requirements that you mentioned was in 3 categories: · The requirements for the board members in the ICANN bylaws · The requirements for a board member used by the NomCom · And additional At-Large requirements I think that what appeared as a contradiction for you is the result of the combination of the 3 categories. Its true that a board member is supposed to serve for the benefit of ICANN as a whole, and not as a representative of a certain stakeholder, but you dont imagine ALAC appointing someone who doesnt know anything of the end users concerns and interests. I think that its normal that the candidate should be well aware of the At-Large affairs. While selected, this Board member will act as an individual for the benefit of ICANN, but with his/her background and his knowledge of the At-Large community. I know that we are runing out of time now, but I really see contradictions in the text which may confuse candidates and applicants. Kind Regards José Arce 2013/11/27 José Francisco Arce <josefranciscoarce@gmail.com> Dear all, I read the document and have some questions: 1) Regarding the first paragraph: member must be able to reflect the users' point of view and interests in the debate and decision making undertaken within the ICANN framework. The last two times LACRALO talked about this issue, and the last was in Buenos Aires meeting, with Fatima´s question to Sébastien Bachollet, the answer was the same: Once the candidate is elect, is a Board member without identifying a group, and does not have to explain to the community that vote for him/her, but the entire community at large. Even more the text included mentioned the requirement of background in Internet users' interests. Should this be a specific requirement? Or Should be only global requirements? And it seems there is a contradiction with the part: What does an ICANN Board Director do? Serve as individuals who have the duty to act in what they reasonably believe are the best interests of ICANN and not as representatives of the entity that selected them, their employers or any other organizations or constituencies; If this is my confusion, requested the appropriate apologies. 2) I know it is controversial subject, but the third paragraph defined what is At-large, and I want to know if there is consensus about this. I´ll appreciate a clarification Kind regards José Arce 2013/11/26 ICANN At-Large Staff <staff@atlarge.icann.org> Dear All, On behalf of Roberto Gaetano, Chair of the Board Candidate Evaluation Committee (BCEC), please find attached the Call for Expressions of Interest for the Board Director selected by At-Large (in English, French and Spanish).
