Dear All: I have read these interventions with mounting dismay. First, because of the several lectures we have endured over time on 'democracy' and following 'rules'. Second, because of the continuing ignorance of LACRALO Rules of Procedure that these several interventions expose. Resolved: These upcoming GA proceedings shall go by the book. That book is the LACRALO Rules of Procedure. The LACRALO RoP is available in both English and Spanish. There are slight differences between the English and Spanish versions on account of lax interpretation. These are subject to motions to fix them from the Secretariat. Where there is doubt, the English version prevails. The relevant rules instructs: 1) That business be brought before the Assembly via motions in acceptable form and prescribed process 2) Motions must clearly state the question for decision by the GA 3) The Presiding Officer must state the question offered in the motion and must accept it 4) Motions must be filed within a specific period of time. These include motions to suspend existing rules. There is a set requirements for the Presiding Officer to follow in handling motions. It is a base requirement for the Presiding Officer to be competent in the rules of procedure of democratic meetings. If not, please do a quick primer from 'Roberts Rules of Order'. Giving the references about invoking United Nations General Assembly (UNGA) rules, it is clear that these are also little understood. Because if this were the case, we should be aware that: 1) LACRALO rules are a limited subset of UNGA Rules 2) the full UNGA Rules are even more onerous. There can no longer be excuses based on ignorance. I, for one, can no longer accept them. DEV: las ROP dicen AL MENOS 4 meses antes, no es taxativo y además hasta 48 horas antes se pueden presentar candidaturas. Si no se hizo el llamado fue porque se confirmo tarde la realización de la AG. Si se aplica esa teoría todos los plazos están vencidos. Pero en ningún artículo se establecen los mismos de forma taxativa. Y es la AG la que debe decidir ni el secretario ni el presidente tienen estas facultades de acuerdo a nuestros ROP y OP actuales. ALS Varios han expresado su apoyo para la elección de la LACRALO Presidente y la Secretaría para ser incluido en la agenda de la Asamblea General en Costa Rica.
Sin embargo, teniendo en cuenta la Regla 13 de las Reglas de Procedimiento ( https://community.icann.org/x/eQUt
13.1 La Secretaría preguntará a todos los ALS acreditadas si tienen la intención presentarse a las elecciones en la Asamblea General al menos dos meses antes de la apertura de la Asamblea General. Candidatura debe ser declarado y presentado ante la Secretaría por lo menos cuatro semanas antes de la apertura de la La Asamblea General.
13.2 Por lo menos cuatro semanas antes de la apertura de la Asamblea General La Secretaría enviará a todos los representantes acreditados de la lista de la ELA y sus candidatos. La lista de candidaturas podrá ser revisado si es necesario, sin perjuicio de otras reglas de calificación que pueden ser adoptadas por la Asamblea General.
13.3 La lista de candidaturas se cerrará y se cierra, al menos 48 horas antes de la apertura de la Asamblea General.
Así el artículo 13 es específico con respecto a la elección de LACRALO representantes que se requiere un aviso de dos meses antes de cualquier LACRALO Asamblea convocada para elegir a los representantes de LACRALO.
Teniendo en cuenta que el término de un año del Presidente y la Secretaría termina el 14 de abril 2012, la convocatoria de candidaturas debe haber comenzado antes a mediados de febrero de 2012 en la lista de distribución LACRALO, pero con la planificación de los acontecimientos LACRALO en Costa Rica, esta llamada no se hizo.
Por lo tanto, la SecretarÃa han determinado que, para que el las elecciones que se produzcan en la Asamblea General en Costa Rica, es necesario que: - La convocatoria de candidaturas para los cargos de presidente y LACRALO LACRALO secretarÃa comenzará el 3 de marzo de 2012. - Si una ALS desea llevar a cabo la elección del Presidente de LACRALO y la SecretarÃa durante la Asamblea General en Costa Rica, dos movimientos son OBLIGATORIOS la suspensión de la ROP y permitir que tal elección: 1.Una moción para suspender el artÃculo 13.1 de la duración de la Asamblea General deberá ser preparado y presentado a la SecretarÃa por cualquier ELA antes de 05 de marzo 2012 para su consideración por la Asamblea General de LACRALO. 2. Una moción para suspender el artÃculo 13.2 de la duración de la Asamblea General deberá ser preparado y presentado a la SecretarÃa por cualquier ELA antes de 05 de marzo 2012 para su consideración por la Asamblea General de LACRALO.
Ambas mociones deben ser consideradas y aprobadas por la Asamblea General para cualquier las elecciones que se produzca. Un fracaso de la moción de suspensión de la regla 13.1 significa automática fracaso de la moción de suspender la Regla 13.2.
El tiempo estimado para que examine las posibles propuestas y tener la elección del Presidente y la SecretarÃa es de 2 1/2 a 3 horas.
Tenga en cuenta que con un movimiento no suspender el ArtÃculo 13.3, los nombres deben ser cerrará 48 horas antes de la Asamblea General.
