This FUNDETIC Question
Deal All: I'm seeing these exchanges and under normal circumstances, would not have bothered to look. But I have some historical antecedents to mind. First, some declarations. I know no one in FUNDETIC. I understand it is based in Bolivia. This is the first Bolivian prospect for LACRALO. Let us be clear. We are very conscious that what we have here is the usual LACRALO political wrangling.....and calculations. But there are principles at stake here. Years ago, some of our colleagues raised questions as to whether The University of the West Indies was qualified to caucus in LACRALO. They were misguided then. They never read the manual, no pun intended. I won't go over the rules pertaining to ALS formation here; read them on the wiki. So, I will ask a few questions as input to an extended Due Diligence. Staff is encouraged to publish these responses. FUNDETIC appears to have two souls. One as a commercial operator delivering ICT-related services to customers in public and private sectors. The other appears to be a foundation offering specific ICT-based social services. I read this configuration as your typical not-for-profit organisation trading on goodwill. According to their website and all caution to Google Translate, here's the list of FOR FEE "SERVICES" offered: - Diagnostics Development Technology Infrastructure - Technical Assistance and Technological Advice - Management Development and implementation oriented Public Management Modernization - Consulting IT Specialist - Management of IT Project Financing to internal and external International Cooperation - Management, Project Development and implementation of social responsibility - Resource Management by interactivity - Ordering information and documentation file - Implementation of Cloud Technology Platforms - Organizational Development and Fundraising It appears FUNDETIC the foundation-looking entity provides social services, what I call 'good works'. Again, from the website: *"Program foundation Digital Volunteer Development Information Technology & Communication at Bolivia - 'FUNDETIC-BOLIVIA' seeks develop, promote and strengthen DIGITAL CULTURAL at home across using and implementing ICT using exchange of experiences between volunteers, children, youth, families and the wider community to enable new capabilities and skills transfer. Similarly seeks to promote intercultural opportunities, in order to strengthen interpersonal relationships, and both volunteers and children and youth FUNDETIC-BOLIVIA Foundation has a personal learning and growth."* FUNDETIC also appears to solicit and receive donations which are used to fund its good works and social services. It may even use some funds generated from business activities to do the same. If you read the details on the donations, FUNDETIC seems keen to follow certain rules for donations. This tend to suggest that there may be legal boundaries. Questions: 1. Is the Foundation a legal entity separate from FUNDETIC, the commercial operator? 2. Is FUNDETIC the foundation recognized under Bolivian law? 3. Is FUNDETIC the foundation funded by FUNDETIC, the commercial operator? 4. Does Bolivian law allow FUNDETIC the commercial operator to publicly solicit funds for it social responsibility programs? 5. Does the law compel reporting the use of those funds? 6. Is there any independent evidence of the kinds of social responsibility programs funded/supported by FUNDETIC? If any three (3) of these are answered in the affirmative, then FUNDETIC may not be barred from caucus with LACRALO.
