Colegas, posiblemente algunos de Uds. ya han recibido la noticia y convocatoria que anexo, que nos pide aprobar las reglas con las que funcionará un grupo de trabajo para definir condiciones de rendición de cuentas de ICANN. Debemos normar el criterio con el que nuestros representantes deberán votar en el ALAC. Me encuentro obligado a expresar oposición a algunos aspectos sustantivos del proyecto y proponer una modificación: El documento es rico en reglas complejas, propias de una gran burocracia. No parece posible simplificar las reglas en el ambiente que prevalece pero expreso la solicitud de que se busque una simplificación. El punto sustantivo, sin embargo, va más allá aunque se basa en parte en esa observación: en ningún momento se considera que un incremento en las reglas de transparencia y rendicion de cuentas puede tener un costo en la operación y eficacia de ICANN en sus funciones sustantivas. Al funcionar así, la propuesta es contraria a los intereses de los usuarios de Internet y en particular de los usuarios del sistema de nombres de dominio, que con nuestros pagos por registros financiamos prácticamente todo el sistema. Lo que interesa primariamente a los usuarios es que el DNS resuelva de forma biunívoca los nombres de dominio, con altos niveles de rendimiento, y con extremas seguridad, estabilidad y resiliencia. En un segundo plano, aplicable sólo a un subconjunto de los usuarios, importa que los procesos de ICANN sean simples y predecibles, desde los ajustes menores a los instrumentos legales hasta la creacion de nuevos nombres de dominio. El barroco sistema de rendición de cuentas que se ha ido creando con los procesos de ATRT 1 y 2 es de suyo bastante complejo y costoso y produce distracciones de la tarea sustantiva. La nueva ronda que está por iniciar tiene todos los pronósticos de seguir añadiendo capas de complejidad. Por ello me permito hacer una sencilla propuesta: "añadir a los criterios que se considerarán, el impacto en la eficacia, eficiencia y costos de los procesos sustantivos de ICANN de cara a los usuarios de Internet". Espero que esto sea retomado en forma directa y sin las convoluciones con que una propuesta similar que hicimos durante la gran farsa de ATLAS II fuera transformada de la demanda de "contribuciones a la eficacia de ICANN" en "mayor escucha de ICANN a ALAC para que sus recomendaciones tengan eficacia". The charter includes, among other things, a problem statement, goals & objectives, scope, and proposed areas for work. The CCWG is expected to organize its activities in two Work Streams, consistent with the Revised Enhancing ICANN Accountability Process <https://www.icann.org/resources/pages/process-next-steps-2014-10-10-en>: *Work Stream 1*: focused on mechanisms enhancing ICANN accountability that must be in place or committed to within the time frame of the IANA Stewardship Transition; and *Work Stream 2*: focused on addressing accountability topics for which a timeline for developing solutions and full implementation may extend beyond the IANA Stewardship Transition. Next Steps Each ICANN Supporting Organization (SO) and Advisory Committee (AC) is expected to consider the proposed charter during its upcoming November meeting(s). Following the adoption of the charter, chartering organizations are expected to identify their representative members to serve on the CCWG (each chartering organization will appoint a minimum of 2 and a maximum of 5 members to the CCWG). In addition, a call for volunteers to join the CCWG will be launched, so that anyone interested in this effort may join and participate. The CCWG is expected to commence its deliberations in late November or early December. Additional Information The National Telecommunications and Information Administration (NTIA) has requested that ICANN "convene a multistakeholder process to develop a plan to transition the U.S. government stewardship role" with regard to the IANA Functions and related root zone management. In making its announcement, the NTIA specified that the transition proposal must have broad community support and meet the following principles: - Support and enhance the multistakeholder model - Maintain the security, stability, and resiliency of the Internet DNS - Meet the needs and expectation of the global customers and partners of the IANA services - Maintain the openness of the Internet. NTIA also specified that it would not accept a proposal that replaces the NTIA role with a government-led or an intergovernmental organization solution. During discussions around the transition process, the community raised the broader topic of the impact of the change on ICANN's accountability. The Enhancing ICANN Accountability process was finalized and posted on 10 October 2014, and can be found here <https://www.icann.org/resources/pages/process-next-steps-2014-10-10-en>. The scope of the Enhancing ICANN Accountability process is defined as ensuring that ICANN remains accountable in the absence of its historical contractual relationship with the U.S. Government and the perceived backstop with regard to ICANN's organization-wide accountability provided by that role, such as the renewal process of the IANA functions contract.
