I have to say I don't agree with that Com Laude framing of DNS abuse and it is not ICANN's framing, they obviously consider "intellectual property and trademark infringement" as DNS abuse. They also claim that law enforcement commercial and "other groups" don't want to make a distinction between technical abuse and content abuse which is false. The noncommercial group and some others have always advocated for limited and technical definition of DNS abuse. Fortunately, until now, ICANN has not overstepped its technical mandate to get involved with content regulation under the framework of DNS abuse. But there is a risk. DNS abuse is technical abuse of DNS at ICANN which is about pharming, phishing, malware and botnet. What DNS abuse is from time to time becomes the focus of certain stakeholders at ICANN as some may want to frame IP as DNS abuse (a security threat!) and encourage ICANN to regulate content. The Contracted Party House is having a conversation about DNS abuse. There was also a session that I attended about DNS abuse in 2019 which can give you clues about the conflicts and problems. https://livestream.com/icannmeeting/events/8844421/videos/198662650 There is this hype among some community members that DNS abuse is on the rise. It is contested that DNS abuse is uncontrollably on the rise, and we are all here after a year of COVID which led to a much higher use of the DNS and did not really blow up the Internet and was mostly resilient to serious technical threats. I don't know how resilient it was against the fake Gucci bags but that attack is not DNS abuse in ICANN terms. This is an interesting conversation. But the community has never come to a conclusion on what DNS abuse is which has unfortunately resulted in not having a fruitful conversation about how best address technical DNS abuse efforts at ICANN, considering its limited, technical mandate.
