Chair's Draft of MOU (Action Item)
Dear Colleagues, After reviewing the wiki updates over the last few weeks (Thanks, Darlene!) and the comments both on the list and on our two conference calls, I've tried to distill the comments into the attached "Chair's Draft." The document is in PDF format, converted from a Word document, and has line numbers next to all of the text. I personally find it helpful to have final discussions around words in documents when we can reference page and line numbers from a fixed common draft. I would ask you each to review the draft and, when you have additions, deletions or revisions, reference the language you're addressing by its page and line number. For example, "Can we change the word 'shall' on Page 2, line 24 to 'will'...." Nick, can you arrange to have copies of this printed for everyone who will be in San Juan? Many thanks everyone. Bret
Here are my comments, for what they are worth: Page 3, Footnote: Why would we WANT to move the onus of this from ICANN to the NARALO. Its not that I am necessarily opposed to this, I'm just wondering. Page 3, Line 29 - Change the period to a semi-colon. Page 5, Line 30 - Ending date of the agreement - I had thought that Nick (or somebody) suggested that we don't need that line as either party can cancel within 120 days. Its redundant. And that's it. Please remember that you have more leverage here and now, with ICANN's eagerness to get this last RALO MoU signed, than you will have at any time in the future. I think we owe it to the public to keep the beneficiary language in -- it's fine in the "purpose" clause where it is, but change 28-29 to "the Internet-using public" rather than the wimpy "Internet community." I would also strongly urge the re-inclusion of specific enforcement provisions: "Recognizing the substantial time and resources committed, the NARALO shall be entitled to specific enforcement of its terms, and to attorneys' fees in case of successful litigation." Remember, litigation is the only thing that has ever swayed ICANN -- it's often done so against the public interest, why not add a lever for the public too? --Wendy Bret Fausett wrote:
