Dear all, In anticipation for our call on Human Rights, here is the link to the merged document that I suggest we use to continue our work: https://docs.google.com/document/d/15t32Y7DyzGCAR21XT9koN9y2hNK_nAifuNZGwaFf... <https://docs.google.com/document/d/15t32Y7DyzGCAR21XT9koN9y2hNK_nAifuNZGwaFf...> What I did is to try to capture our discussions and agreements and merge the document with what Greg put together last time so we can build the explanatory note from there. A proposed agenda for tomorrow is: 1. Welcome and Roll call (2 minutes) 2. Review of draft bylaw wording (28 minutes) 3. Advance discussion on explanatory note (25 minutes) 4. AOB (5 minutes) Please feel free to suggest amendments to the proposed agenda. Best regards, León
Dear Leon, dear all, We have had a look at the proposed document and would like to suggest the following changes to the proposed Bylaws wording: - eliminate „fundamental“, as all human rights need to be respected; - add „…and other international human rights instruments“ as the UDHR does not cover all affected human rights; Thanks for considering this. Dear all, Unfortunately I wasn’t able to attend the call. In any case, as I have not seen any reaction to my email I have included our change proposals in the Google Doc. I agree with one of these proposals and disagree with one.
- add „…and other international human rights instruments“ as the UDHR does not cover all affected human rights;
I agree with this proposed addition.
- eliminate „fundamental“, as all human rights need to be respected;
I agree with the principle of this. I disagree with the proposed execution. I agree in so far as "fundamental" must not be used as a restrictive qualifier. However its removal would appear to act as a restrictive qualifer, and imply that human rights adhere to natural persons alone. We know (e.g. from Yukos -v- Russia) that legal persons also have fundamental (a.k.a. "human") rights. And the title of one of the most influential instruments (which, I am sure is included in reference to "other international human rights instruments" is :- "The European Convention for the Protection of Human Rights and Fundamental Freedoms". I therefore submit that the exact phrase we should use needs to be "fundamental AND human rights" (in preference to "fundamental human rights"). I trust this meets with approval?

I guess that would do for us, thanks! Jorge -----Ursprüngliche Nachricht----- Von: wp4-bounces@icann.org [mailto:wp4-bounces@icann.org] Im Auftrag von Nigel Roberts Gesendet: Montag, 21. Leon, I apologize that I have not had time today to work in the Google Doc before our meeting. As for the agenda, I think we need to discuss our process and method for review and analyze the public comments as they relate to the proposed Human Rights bylaw and any explanatory framework. This may be part of your agenda item 2, but we need to make sure to cover this point. Thanks! Greg On Fri, Sep 18, 2015 at 2:19 AM, León Felipe Sánchez Ambía < leonfelipe@sanchez.mx> wrote:
