Dear Alejandro et al, I also compliment Carlos and the team for crafting ICANN's response to the GDC endorsement request. I note though, that there was no mention of the "2025 Auction Proceed Granting" to support the growth of the DNS system and the continuous evolution of the Internet in line with the GDC objectives. 2. As I mentioned before, the global leaders' agreement at the Summit of the Future on September 22 fulfills the 2nd track of the WSIS Tunis Agenda as contained in paragraphs 69, 70 & 71... "69. We further recognize the need for enhanced cooperation in the future, to enable governments, on an equal footing, to carry out their roles and responsibilities, in international public policy issues pertaining to the Internet, but not in the day-to-day technical and operational matters, that do not impact on international public policy issues. 70. Using relevant international organizations, such cooperation should include the development of globally-applicable principles on public policy issues associated with the coordination and management of critical Internet resources. In this regard, we call upon the organizations responsible for essential tasks associated with the Internet to contribute to creating an environment that facilitates this development of public policy principles. 71. The process towards enhanced cooperation, to be started by the UN Secretary-General, involving all relevant organizations by the end of the first quarter of 2006, will involve all stakeholders in their respective roles, will proceed as quickly as possible consistent with legal process, and will be responsive to innovation. Relevant organizations should commence a process towards enhanced cooperation involving all stakeholders, proceeding as quickly as possible and responsive to innovation. The same relevant organizations shall be requested to provide annual performance reports." 3. So, ICANN has nothing to fear about any take-over of its role as that was resolved with the successful IANA Transition of October 1, 2016. While governments have their multilateral rights to address global public policy issues (e.g. the draft Cybercrime Convention & the two UNGA resolutions on Artificial Intelligence), the opportunity to discuss these issues on an equal footing in a multi-stakeholder setting is already ongoing at the annual Internet Governance Forum. 4. Governments already have the UNGA/ECOSOC/CSTD to handle the international public policy issues pertaining to the Internet which they have demonstrated with the "Pact for the Future" with the GDC and the "Declaration on Future Generations." In doing so, what was lacking was the meaningful participation of other stakeholders in line with the Sao Paulo Multistakeholder Guidelines. This should be our expectation on the implementation of the GDC while organisations like ICANN continue to play their roles and responsibilities. As such, I do not see the GDC constituting any disbenefit to the continuous evolution of the Internet if we look carefully into the stated goal, the 5 articulated objectives, and the 13 enunciated principles. 5. We should expect GDC implementation by various stakeholders to be reviewed within WSIS Annual Review and the national, regional (NRIs), and global IGF as there is no capacity for any new institutional framework to review GDC. ICANN is already active in IGF and in the WSIS process. It simply needs to measure/align its programmes to the expectations of the GDC in the era of digital (formerly enhanced) cooperation as it reports on such progress during the next review. first let me commend Elizabeth Oluoch and Alexey Trepykhalin for this short, clear and solid paper. My comment is more on the broader picture:
1. ICANN should not insist too much in that it is a "good GDC kid" because "good GDC kid" is not necessarily an honorable badge. We more likely don't want many of the consequences and even content of the GDC for the Internet.
2. ICANN is not only a poster child for a multistakeholder approach (notwithstanding some caveats), but more importantly, a laboratory, an experience to be studied, from which lessons learned can be applied, mutatis mutandis, to other fields - BTW, not only digital. ICANN or some of its allies and I* cohort members should call for any progres to be made via the GDC to be based on careful study and adaptation from those lessons. One very important one is "one size does not fit all" and so, for example, more government involvement is needed in issues related to law enforcement (and we already have M3AAWG and APWG as examples of things that work), or less, in technical standards development work.
3. ICANN should clearly express concern for the effects of the GDC (and cybercrime convention and other stuff countries will try to bring under this umbrella) on the Internet in general, carefully avoiding mission creep but also clearly articulating what is about to be lost in openness, interoperability, etc. and which will make things difficult for the Internet to be for all while abiding by these core principles. There is a risk that an Internet governed under the GDC will stop being the open, interoperable, best-effort etc.. Internet we know and become more fragmented, less interoperable, eschewing the "dumb network" paradigm, less open, less universal reach, etc. and THAT is definitely a concern for ICANN. In particular the risk of fragmented technical standards, fragmente address and name spaces, etc. are of direct concern to ICANN.
