An extended analysis of the source of the Department of Commerce’s claim to the root (i.e. not ICANN’s) may be found here: http://www.gao.gov/products/GAO/OGC-00-33R -- you will note that the question that the GAO reserves is not the source of the Commerce claim (about which it is pretty clear) but about whether or not Commerce has authority under US law to transfer that control to ICANN ….. I am told that the Department of Commerce General Counsel has drafted an opinion saying that the transfer may occur. But AFIK that opinion has not been publicly released.
