It's nearly always time for reconsideration. To believe otherwise is foolish and significantly unwise.
In any event, the sooner ICANN reconsiders and rectifies and/or actually fixes the frontrunning/domain name tasting problem which is still ongoing unabated, the less financial damages the suit from Chris will cost both ICANN and NSOL as well as other registries or registrars. Oh, and not to mention other follow on suits of similar nature...
