Fake Renewal Notices Report - Comment period
I call your attention to the report on Fake Renewal Notices. There is a comment period open until April 20th. http://www.icann.org/en/news/public-comment/fake-renewal-notices-report-21ma... Since this is a topic relevant to individual registrants, and since one of the recommendations suggests referring the issue to the ALAC, I believe it is essential that the ALAC issue a comment. The worst fake renewal sender is DROA / DROC / Brandon James. They are a real registrar located near Toronto who have sent me a stack of fake renewal letters several inches high. They've been in trouble with both the US FTC and the Canadian Competition Bureau. As far as I can tell, their goal is slamming. If the RAA lets them keep doing what they're doing, there's definitely something wrong with the RAA. That is why John is commenting on it now. ICANN has a reputation for doing NOTHING when it is aware of violations. I think there has been only one registrar they took action against, EVER! Since then, and prior to then, there had been letters said, which essentially said, "Go fix it." with no followup.

I think that the very fact that the issue comes up for public comment means that ICANN is slowly getting down to doing something about it. I am hoping that the transcripts from our Sunday session in Costa Rica will soon come on-line and you'll see how the discussion with the Compliance Department was rather lively. As you'll notice, we're putting the pressure and it is only when reminding ICANN again and again where it falls short of doing what it says it will do, that we'll get ICANN to do it. Olivier Well several of us have been pushing for this issue to be addressed at some level for the last couple of years. Fake renewals unfortunately appear to fall outside the current contract and consensus policy, though everyone would seem to agree that there is an issue and that it needs to be addressed. The key is finding a way to address "bad behaviour" without putting unwanted restraints / limitations on legitimate marketing.
