(see http://gnso.icann.org/issues/whois/whois-studies-chart-11feb11-en.pdf ) John and Zahid worked with staff on a resolution to commit funding for all remaining studies. After the SFO Council meeting, a small volunteer group met 4 times to discuss WHOIS studies resolution. Chuck Gomes led the discussion with Kathy Kleiman (PIR), Don Blumenthal (PIR), Liz Gasster (ICANN), Lisa Phifer (ICANN), and Steve DelBianco. Here's where we are now: Kathy and Don feel that the RFP for the Registrant Identification Study (Study 2) needs more definition on how registrants are classified as having 'commercial purpose'. I support another few weeks of this work, and can explain if needed. The registries are likely to support our 2 most important studies, with minor adjustments to the studies' scope. I'm talking about the Privacy/Proxy Abuse study (Study 3) and the Relay/Reveal study (Study 4). I support these adjustments. Attached is a modified version of John's Council motion regarding these studies, along with explanations. I recommend we support the amended motion. I also recommend we start lobbying rest of Commercial Stakeholders Group to support this. Kathy Kleiman will talk with her former colleagues in NCSG and we should also reach out to those Councilors and offer to explain. The registrars are unlikely to support, but we should offer to explain how this improves the studies and deserves their support. John's a logical choice for that outreach. -- see GNSO Project Status List as of 10-Mar-2011, at http://gnso.icann.org/meetings/pending-projects-list.pdf Channel 3. hi all, sorry this is so last-minute, but i don't think i'm going to be able to make this call today. mikey - - - - - - - - - phone 651-647-6109 fax 866-280-2356 web http://www.haven2.com handle OConnorStP (ID for public places like Twitter, Facebook, Google, etc.)

As discussed on yesterday's BC member call, this is "last call" on SSR. Please review and comment on our discussion draft in response to SSR (Security, Stability and Resiliency) review team issues. SSR Review Team (AoC) Set of Issues (Due 6-Apr) Adam Palmer's draft circulated 24-Mar. Mikey O'Connor circulated edits 25-Mar Awaiting reaction from members and Adam on Mikey's markup. The Review Team is seeking responses by 6-April, so today (24-March) begins our 14-day review period for this discussion draft. Please review and post your suggestions/edits as soon as possible. If there are no disagreements noted by 1-April, these comments will be adopted without a voting period, and posted to ICANN on 6-April. Thanks Adam, Mikey, Steve and others for drafting this excellent piece. I have but one issue with it. I suggest changing this sentence, which follows the numbering of the 3 issues: The BC recognizes the narrow scope of ICANN's technical coordination role, but this should not be relied upon to limit participation in coordinated efforts to combat malicious DNS activity. I do not think the BC should be recognizing any "narrow scope" of ICANN's role, at least not without defining what we mean. Instead, I propose this: ICANN's Bylaws require it "to ensure the stable and secure operation" of the DNS. Therefore, ICANN must view participation in coordinated, industry efforts to combat malicious DNS as absolutely essential to that mission. Yes, thanks to all. Mike R's new language needs one more word in the second sentence: "...efforts to combat malicious DNS activity..." I also have a small number of typo/grammar items elsewhere: Item 1 on page 3 - the comment text needs to start on a new line. Item 2 on page 3, last para - suggest changing "eliminating a compliance environment" to "reversing a compliance environment" [or some other word] Item 10, first para - correct SRR to SSR General: Use of both "Security, Stability, and Resilience" and "Security, Stability, and Resiliency." The title page and at least one other place in the doc use "resiliency," but most occurrences use "resilience." Does it need to be consistent? Finally, is the formal title of the review team "The Security, Stability and Resiliency of the DNS Review Team"? If it is, so be it. If it isn't, then could the title be changed to "Review Team on The Security, Stability and Resiliency of the DNS"? As it is, it sounds like a review of the "security, stability, and resiliency" of the "DNS review team." :) Jim Baskin Verizon ________________________________ From: owner-bc-gnso@icann.org [mailto:owner-bc-gnso@icann.org] On Behalf Of Mike Rodenbaugh Sent: Friday, April 01, 2011 5:41 PM To: bc-GNSO@icann.org Subject: RE: [bc-gnso] Last Call: BC discussion draft for SSR comments, to be filed 6-April Thanks Adam, Mikey, Steve and others for drafting this excellent piece. (see https://community.icann.org/display/gnsocouncilmeetings/Motions+28+April+201... ) John and Zahid worked with staff on a resolution to commit funding for 3 WHOIS studies. After the SFO Council meeting, a small volunteer group met 6 times to discuss WHOIS studies resolution. Last week, the group hosted Steve Metalitz to address any questions from IPC Councilors, who asked for a deferral on 7-Apr. Chuck Gomes led the group with Kathy Kleiman (PIR), Don Blumenthal (PIR), Liz Gasster (ICANN), Lisa Phifer (ICANN), and Steve DelBianco. This group believes that the RFP for the Registrant Identification Study (Study 2) needs more definition on how registrants are classified as having 'commercial purpose'. I support another deferral of this work, and can explain if needed. The registries have said they will support our 2 most important studies, with minor adjustments to the studies' scope. I'm talking about the Privacy/Proxy Abuse study (Study 3) and the Relay/Reveal study (Study 4). I support these adjustments. Marilyn – Thanks for asking for our comment on the relaxation of price controls on the call today. I'm sorry that I was unable to get to a place that was quiet enough to respond. I'm at a conference and there was too much background noise. MM does believe that this is a legitimate and material concern for our clients. Further, I'm sorry that I had to leave the call early. If there are follow-up items or support that you need from us Elisa and I are happy to discuss via email. Just a follow-up on last week's BC member call regarding comments on SSR (Security, Stability & Resiliency) ICANN is gathering comments on its proposed 2012 framework for SSR See http://www.icann.org/en/public-comment/#ssr-fy12 This framework is presented as two slide decks — not a formal report like we're used to seeing. There are no community postings even thought the comment period closes 7-Jun. Just two replies from ICANN staff to registry questions. On last week's BC call, I suggested that the BC could modify our previously-adopted SSR document for this comment period and for discussion in Singapore. I noted that the BC posted comments on the SSR Review Team back on 6-Apr (attached). Marilyn volunteered, and it would be great if our other SSR experts (Adam, Scott, Mikey, and Leigh) could help. Would anyone have some time to quickly review our prior filing and adapt to the proposed SSR Framework slides? -- Steve DelBianco Executive Director NetChoice http://www.NetChoice.org and http://blog.netchoice.org +1.202.420.7482

During our 2-Jun call, I promised to review the GAC's latest comments<http://gac.icann.org/system/files/GAC%20Comments%20on%20the%20new%20gTLDs%20...> on the Applicant Guidebook<http://www.icann.org/en/topics/new-gtlds/comments-7-en.htm> for new gTLDs, looking for GAC items relevant to priorities in the BC position<http://www.bizconst.org/Positions-Statements/BC+on+Final+App+Guidebook+May+2...>. Rights Protection Mechanisms (GAC page 5): 1. GAC wants TM Claims and Sunrise services to go beyond exact matches. Clearinghouse RFP should solicit proposals on expanded matching, too. 2. TM Claims service should run indefinitely 3. "Use" should not be a requirement to get into the TM Clearinghouse database 4. Standard of proof for URS / PDDRP should be lowered to "preponderance of evidence" 5. "Loser pays" should apply at the threshold level of 15 domain names. Review and adjust RPMs 1 year after 75th new gTLD is launched (GAC page 6): GAC proposes a formal review of items 1, 2, and 3 (above) one year after the 75th new gTLD is launched. (similar to the BC request for a reduced batch size to assess and adjust the process) Compliance (GAC page 9): "GAC welcomes ICANN’s intention to enhance its Contract Compliance efforts and urges the Board to ensure that this effort coincides with the implementation of the new gTLD program." Applicant background screening (GAC page 9): GAC says screening process should look for violations of consumer protection / deceptive commercial practices. regrets for today's call. but here's a thought... the IRTP motion deserves our support -- i note that it's not "seconded" in the agenda. please don't let it fail for lack of a second. and vote for it -- it's an exact repeat of the recommendations of the working-group and represents two years of good/hard work by the WG and the community. see you in Singapore. mikey On Jun 13, 2011, at 7:41 AM, Steve DelBianco wrote:
During our 2-Jun call, I promised to review the GAC's latest comments on the Applicant Guidebook for new gTLDs, looking for GAC items relevant to priorities in the BC position.
Rights Protection Mechanisms (GAC page 5):
1. GAC wants TM Claims and Sunrise services to go beyond exact matches. Clearinghouse RFP should solicit proposals on expanded matching, too.
2. TM Claims service should run indefinitely
3. "Use" should not be a requirement to get into the TM Clearinghouse database
4. Standard of proof for URS / PDDRP should be lowered to "preponderance of evidence"
5. "Loser pays" should apply at the threshold level of 15 domain names.
Review and adjust RPMs 1 year after 75th new gTLD is launched (GAC page 6):
GAC proposes a formal review of items 1, 2, and 3 (above) one year after the 75th new gTLD is launched. (similar to the BC request for a reduced batch size to assess and adjust the process)
Compliance (GAC page 9):
"GAC welcomes ICANN’s intention to enhance its Contract Compliance efforts and urges the Board to ensure that this effort coincides with the implementation of the new gTLD program."
Applicant background screening (GAC page 9):
GAC says screening process should look for violations of consumer protection / deceptive commercial practices.
