As this Sub Team is due to make its next/final report to the full WG next week (1 September), I thought I¹d write to follow up on the ³action items² noted after the last call we did on 12 August (below).
On Question 1, I believe that Christian and Kiran will send proposed language to this group for your review and, hopefully consensus.
For Questions 2 & 3, it was agreed that the Sub Team as a whole would likely need to further discuss its conclusions/recommendations. I will note here also that we have not yet discussed Question 4, though in that regard perhaps I can suggest that staff take a stab at summarizing them for your review. This suggestion is based on the fact that these represent a collection of comments that relate generally to our topic rather than specific responses to Questions 1, 2 or 3.
As such, would it make sense for the Sub Team to try to do a call to go over the above, perhaps on Friday 28 August or Monday 31 August, presuming that everyone will have had a chance to send and/or read the latest documents by then?

As this Sub Team is due to make its next/final report to the full WG next week (1 September), I thought I’d write to follow up on the “action items” noted after the last call we did on 12 August (below).
On Question 1, I believe that Christian and Kiran will send proposed language to this group for your review and, hopefully consensus.
For Questions 2 & 3, it was agreed that the Sub Team as a whole would likely need to further discuss its conclusions/recommendations. I will note here also that we have not yet discussed Question 4, though in that regard perhaps I can suggest that staff take a stab at summarizing them for your review. This suggestion is based on the fact that these represent a collection of comments that relate generally to our topic rather than specific responses to Questions 1, 2 or 3.
As such, would it make sense for the Sub Team to try to do a call to go over the above, perhaps on Friday 28 August or Monday 31 August, presuming that everyone will have had a chance to send and/or read the latest documents by then?

For the benefit of those who could not join us on the Sub Team call earlier today and to document next steps for this group, here are the “action items” that were agreed on by those on the call:
Approach to the Save Domain Privacy and Respect Our Privacy petition, comments and statements:
* Kiran and Christian will work on draft suggested language for the Sub Team in respect of Question 1. While everyone agreed that these comments show a huge wave of support for user privacy to be respected and against restricting privacy services based on the word “commercial” used as a distinction, there was no agreement that this general support is totally dispositive of the various specific issues and options that had been raised by the Working Group in our Initial Report. * ADDITIONAL NOTE: I went and prepared a general summary on the additional comments that accompanied the Save Domain Privacy petition i.e. the additional comments that the organizers sent in, containing specific comments from many of the signatories. I’ll circulate this separately, in the hope that this summary will be helpful as you finalize the Sub Team’s recommendations.
Treating Question 1 as a “threshold” question to Questions 2 and 3:
* It was agreed that this may not be possible, since some comments noted that the answer to Question 1 might depend on the answer to Question 2. It was suggested that Question 2 might in fact be a more appropriate “threshold” question, although that was not how it was framed in the Initial Report.
Next steps:
* Sub Team to discuss draft language from Kiran and Christian (next week?) * Sub Team to continue review of the summary analysis to Questions 1 & 2, and possibly also 3 as well
Please note that the WG Work Plan currently has this Sub Team scheduled to provide its final recommended actions on Section 1.3.3 to the full WG on 1 September (i.e. about two and a half weeks from now). Assuming you think that is a realistic deadline, this would seem to call for at least one call late next week or early the following week, prior to which hopefully you will have had the chance to review all the documents prepared by Lindsay and Terri, and the forthcoming proposed language from Kiran and Christian.

no, what I was trying to point out was that the EU has a complex regional system of inter-related laws. You cannot just pick the ones you like and ignore the other ones that are tailored to balance them. Furthermore, of course, they all sit under Charter of human rights. The more important point that I am trying to make is that you cannot reach in to govern content when ICANN does not have the remit to do so, that remains with national governments, The EU has acted in that regard, EU citizens do not need or want ICANN to enter that area of activity and the EU has been firm on that question since the inception of ICANN. Hi All, I've been reading the Question 2 summary and I don't understand it. With so few commenters, why aren't individual points identified with individual commenters? That is the practice done in the other subteams and for transparency purposes. For example who said we should use the EU Directive on Electronic Commerce? The definition completely contradicts a number of noncommercial protection provisions under US law - including that holding a garage sale in front of your house does not make your house commercial, and selling a bumper sticker for the Democratic National Committee does not make the DNC commercial either. Linking comments to commenters should be an easy step. Best, Kathy :

As this Sub Team is due to make its next/final report to the full WG next week (1 September), I thought I’d write to follow up on the “action items” noted after the last call we did on 12 August (below).
On Question 1, I believe that Christian and Kiran will send proposed language to this group for your review and, hopefully consensus.
For Questions 2 & 3, it was agreed that the Sub Team as a whole would likely need to further discuss its conclusions/recommendations. I will note here also that we have not yet discussed Question 4, though in that regard perhaps I can suggest that staff take a stab at summarizing them for your review. This suggestion is based on the fact that these represent a collection of comments that relate generally to our topic rather than specific responses to Questions 1, 2 or 3.
As such, would it make sense for the Sub Team to try to do a call to go over the above, perhaps on Friday 28 August or Monday 31 August, presuming that everyone will have had a chance to send and/or read the latest documents by then?

* Kiran and Christian will work on draft suggested language for the Sub Team in respect of Question 1. While everyone agreed that these comments show a huge wave of support for user privacy to be respected and against restricting privacy services based on the word “commercial” used as a distinction, there was no agreement that this general support is totally dispositive of the various specific issues and options that had been raised by the Working Group in our Initial Report. * ADDITIONAL NOTE: I went and prepared a general summary on the additional comments that accompanied the Save Domain Privacy petition i.e. the additional comments that the organizers sent in, containing specific comments from many of the signatories. I’ll circulate this separately, in the hope that this summary will be helpful as you finalize the Sub Team’s recommendations.
_Treating Question 1 as a “threshold” question to Questions 2 and 3_:
* It was agreed that this may not be possible, since some comments noted that the answer to Question 1 might depend on the answer to Question 2. It was suggested that Question 2 might in fact be a more appropriate “threshold” question, although that was not how it was framed in the Initial Report.

Hello everyone, As you may have seen from the Public Comment Review Tool compiled for this Sub Team, three commenters specifically highlighted the EU E-Commerce Directive (the BC, Unifab and John Nagle/Sitetruth). There may have been other references to it in relation to other recommendations or questions, but as I recall these are the three that were included in the Tool as directly addressing this Sub Team¹s topic. I should also note that each Sub Team was free to select the form of report/summary that they wished to use to present their findings and reports; as such, while some Sub Teams agreed to use a similar format, there was not a standard form prescribed. The documents you now see on this Sub Team¹s wiki page are therefore what was prepared, circulated and discussed between 4 August and now. _Approach to the Save Domain Privacy and Respect Our Privacy petition, comments and statements_:
* Kiran and Christian will work on draft suggested language for the Sub Team in respect of Question 1. While everyone agreed that these comments show a huge wave of support for user privacy to be respected and against restricting privacy services based on the word “commercial” used as a distinction, there was no agreement that this general support is totally dispositive of the various specific issues and options that had been raised by the Working Group in our Initial Report. * ADDITIONAL NOTE: I went and prepared a general summary on the additional comments that accompanied the Save Domain Privacy petition i.e. the additional comments that the organizers sent in, containing specific comments from many of the signatories. I’ll circulate this separately, in the hope that this summary will be helpful as you finalize the Sub Team’s recommendations.
_Treating Question 1 as a “threshold” question to Questions 2 and 3_:
* It was agreed that this may not be possible, since some comments noted that the answer to Question 1 might depend on the answer to Question 2. It was suggested that Question 2 might in fact be a more appropriate “threshold” question, although that was not how it was framed in the Initial Report.
_Next steps_:
* Sub Team to discuss draft language from Kiran and Christian (next week?) * Sub Team to continue review of the summary analysis to Questions 1 & 2, and possibly also 3 as well
Please note that the WG Work Plan currently has this Sub Team scheduled to provide its final recommended actions on Section 1.3.3 to the full WG on *1 September* (i.e. about two and a half weeks from now). Assuming you think that is a realistic deadline, this would seem to call for at least one call late next week or early the following week, prior to which hopefully you will have had the chance to review all the documents prepared by Lindsay and Terri, and the forthcoming proposed language from Kiran and Christian.

There may have been other references to it in relation to other recommendations or questions, but as I recall these are the three that were included in the Tool as directly addressing this Sub Team’s topic.
I should also note that each Sub Team was free to select the form of report/summary that they wished to use to present their findings and reports; as such, while some Sub Teams agreed to use a similar format, there was not a standard form prescribed. The documents you now see on this Sub Team’s wiki page are therefore what was prepared, circulated and discussed between 4 August and now.

Hi Terri, Per your request, let me share the agreement I think we came to in the subteam meeting teleconference today on Question 2. Question 2, as you know, is: "If you agree with this position, do you think it would be useful to adopt a definition of “commercial” or “transactional” to define those domains for which P/P service registrations should be disallowed? If so, what would the definition(s) be?" What I think Susan, Stephanie and I agreed (communicated on the phone and in chat) is that there is a *clear lack of consensus *in Subteam 2 as to how to proceed on the subteam's work and recommendation to the full WG. Certainly you and Kiran have expressed an interest in moving forward to define commercial and noncommercial. Stephanie and I expressed our strong concerns that such a process would be a huge waste of time for the subteam and WG given the clarity which over 21,090 commenters spoke on question one -- that these commenters *do not want to differentiate commercial and noncommercial uses *and want both commercial and noncommercial uses to have access to proxy/privacy registrations. If so, then there is no need to define commercial and noncommercial users or transactional uses. That is the lack of consensus I think we have, and appreciate if you could share this lack of consensus and different of opinion with the PPSAI WG in your discussion of Question 2 -- thanks!! On a personal note: In light of our discussion on the subteam call as to whether "should we have asked it [Question 2] differently," I have gone back through my notes and memories and realized that we absolutely asked it as best we could. We, in the WG, tried for months to try to define commercial/noncommercial/transactional and reached no conclusion, which is why we put it out for comment to those who chose to provide input. I don't think we can go back, undue or redo. If anything, this section of the questions received the closest wordsmithing and review before we released the Interim Report for comment. Our response was very interesting -- only a handful of commenters chose to offer us a definition of commercial or transactional -- the vast majority did not.
