"strongly disincentivize private resolution of contention sets" Elisa, I believe there is no support in SubPro policy for disincentivizing private resolutions, only to disincentive applying just for profiting from private auctions. On the contrary, contention set resolution solutions such as Joint Ventures were explicitly added as allowed. I wonder if the actual request for the vendor was more nuanced than that ? Rubens

Thanks, Rubens! You are right that there is no policy on this, in fact, as you know there is no policy on private resolution, other than joint ventures, at all. However, there is GAC advice on the issue that asks for private auctins to be prohibited or strongly disincentivised. We expect the outcome of the research to also inform the Board’s response to this GAC advice. We will add this caveat to the plan. Best. Just a note that GNSO Council commented formally on this issue in its Second Clarifying Statement to the ICANN Board regarding certain pending recommendations. I believe the Statement said that neither Sub Pro nor the Council took a position on private auctions but I am not sure of the exact language. I think it would make sense for the IRT to be provided with that language in the Second Clarifying Statement if we intend to discuss this further.
