Dear Niels, At our last meeting , ANN and someone else tried to treat GAC and two other SOs namely GNSO and ccNSO in regard with respecting Human Rights quite differently to which I objected. The two supporting organizations provide re3commendations to ICANN Board based on their respective PDP developed. GAC provide Advice to the Board based on Public Policy issues . The treatment of these output by ICANN Board must be equal. In other words if they are examined against respecting, all three should undergo that criteria if not none of them. Consequently the text in the document must have equal weighting and equal status. I also do not understand one GAC member indicating GAC Advice should respect Human Rights, which I have problem on that, but that GAC member did not say that GNSO and ccNSO policies must also respect Human Rights. Thanks Kavouss. I am adding your amendments to the google doc. I think other members of the drafting team won't mind. I actually agree with your point, especially since I gathered from listening to the last call there was a general agreement that the Board is the final determination. So the same text as we have for the GAC advise should be in the other section. I think we might just put this paragraph somewhere up in that section to make the flow of the text better, but right now I put in on the place you proposed in the word document. Kavouss, I in fact said the opposite of what you are asserting and asked that the notes be corrected in this regard. GNSO policy-making and GAC policy-making should both be affected and Mark Cavell was simply confirming this principle. I think you misinterpreted both of us. I hope this is now clear. Hi Anne and Kavouss and all, I want to clarify that I added Kavouss suggestion so it won't get lost and we can decide on the call among the group whether we want to add this or not. It's a good point to clarify for the purpose of FoI anyway. I personally think all policy making + ICANN Board + ICANN org are affected by the Core Value. I agree all policy-making is affected. I also think that if we do not note in the answer to Annex 12 questions that there will be a need for balancing of Human Rights themselves (in addition to balancing of Core Values), then we are acting like ostriches with our heads stuck in the ground. Even the EU Court of Human Rights has to engage in a balancing act. This is normal and appropriate. There is in effect no real freedom of expression if rights of authors, artists, and indigenous peoples are not protected. And there is no right to speak anonymously on the Internet, in particular if that speech is commercial speech that hurts consumers.
