Paul What do you mean 'close to the border'. I know I'm only a Participant, and not a Member, but I don't care if its deliberate or not. What matters is the EFFECT not the motivation. So I say it *IS* exclusionary. Since, to borrow a phrase, "I have to work for a living". With respect, I don't think it is fair to call the deadlines either artificial or designed to be exclusionary. In Dublin we got a very clear count backwards from what the WG has been told is an external deadline. I appreciate as much as anyone the way that the extremely awkward dates are bad for people (they're bad for me too). But the CCWG has made so much progress, and the IANA operational communities are all waiting on the output from this WG. This WG can flip over the table of the transition, of course; but I humbly urge everyone to consider the damage to ICANN and to this community if the transition fails on account of the missing accountability piece. For that matter it could be extended by a year and ended by mutual agreement whenever the proposal is approved and implemented. I think this is a matter of disagreement, and not a fact. If one accepts that, in good faith, the chairs have accepted that external deadline as real, then the internal dates are neither artificial nor designed to be exclusionary. I still think it is quite unfair to say the dates are designed to be exclusionary. I've seen absolutely no evidence that anyone in this group is trying to exclude anyone else, and I have to say that I've received only good-will interactions with respect to any remarks I have made despite having stood mostly as an outsider throughout the CCWG work. The external deadline _is_ artificial. Please provide any evidence to the contrary. I was on the ICG and we ruminated over these timelines for weeks. I know what the constraints are. A week to ten days over the New Year's period does not break anything. The loss of legitimacy and quality on the other hand are very likely to prove costly.

I have seen multiple reasonable arguments for adding 10 days to the current timeline to allow careful review by the lawyers and a real public comment period. I haven't seen ANY plausible argument about how this clashes with the US political constraints. The current estimates of how much time it takes the NTIA to approve it, subject to the oversight of congress, are very imprecise simply because the NTIA is not fully in control and needs to be conservative.
I still think it is quite unfair to say the dates are designed to be exclusionary.

Nigel I use "close to the border" to accommodate the possibility that our co-chairs, who are non-American, simply did not realize how utterly unrealistic that proposal is for a holiday meeting. I, for one, will not attend nor even consider attending and I'm on the borderline of urging my fellow Americans to boycott. As for the broader point about the rapid pace of what we are doing, I actually have a bit of sympathy for the co-chairs. They are under immense pressure to keep this moving from ICANN and NTIA and they (and others in the community) are possessed of the mistaken belief that there is something magical about our current time line, as if failing to meet it will turn us all into pumpkins. As to =that= aspect of it, I agree with you that it is quite deliberate; quite exclusionary; and quite unfortunate. To be candid, I would not object to the pace if I did not perceive that it was actually creating error -- error in process and error in substance. On the process side we have: -- Cutting comment period from traditional 40 days to 21 (for a report that will SIGNIFICANTLY diverge from the two earlier drafts in many ways, thereby increasing, rather than decreasing the need for thoughtful review by the community); -- Reducing comment period for non-English speakers to 9 days; -- Effectively eliminating ability of dissenters to formally voice objections by scheduling. These concerns are well stated, Paul. Personally, I have repeatedly voiced concern that haste will make waste -- that in a last-minute rush we will miss critical gaps or errors that will chew up more time down the line, or that cause the transition to fail. I cannot seriously believe that a 21-day comment period assures transition success but that a 9 or 19 day extension dooms it. I would be much less concerned if the third proposal was simply a refined version of the second, but is in fact a significant deviation, going from a member model that would have provided all the statutory powers of a California public benefit corporation to a designator model in which we seem to be relying on the threat of using a "nuclear option" of Board removal (individual members or the entire Board) via an escalation process that requires a very high level of community consuensus. There are also critical outstanding issues that remain unresolved at this late date. As we will have to live with the final adopted proposal for years or decades to come it is very important that we have a full understanding of whether it provides adequate accountability via feasible tools and processes. Institutionally, I have shared the revised timeline with the BC and asked for feedback regarding whether BC members believe it is adequate. To the extent that BC members have previously weighed in they have indicated a preference for a timeline of at least 30 days. Completely agree. Not to take away from the focus of this discussion but I recall raising a point before the board at Dublin about how the entire multistakeholder system has turned out to be extremely US and Western Europe centric. Meaningful and effective participation should be facilitated. On the substantive side we have: -- Put off development of the IRP ("the crown jewel" of our proposal) to a post-transition implementation team; -- Moved to finalize a draft report by TOMORROW 2359 UTC when there is still utter lack of consensus on two critical issues, viz: -- Role of GAC/ST-18 -- Mission statement of ICANN (the "other critical pillar") of our proposal.
Perhaps these concerns can be fixed in the drafting, but I doubt it. We are now perilously close to acting in a way that calls the fundamental legitimacy of our work product into question. The phrase in carpentry is "measure twice; cut once"
I apologize to the list for the somewhat angry tone of this note -- but the Thanksgiving call proposal is for me just the straw that breaks the camel's back.

Phil, That primarily refers to long-distance travel (planes and trains). In terms of local travel (i.e., driving and local mass transit and commuter transit), day of Thanksgiving is an immense travel day (and 90% of Thanksgiving travel is local travel). So, this will very much interfere with travel and preparation (cooking) on "turkey day" for many of us. I'm sure that our families will understand.... I support this request for a poll on the proposed timeline, as we may be losing touch with what members and are participants are saying in this working group. It isn’t only the expected work on holidays, but also the pace at which people are expected to read and comment on this work that is impossible. The unavailability of translations on this report until the very end of the public comment period is simply not acceptable as a method of operation. We need a revised timeline in light of the many concerns expressed with the timeline proposed by the co-chairs. Robin

In the Adobe meeting earlier this week there was wide support for extending the comment period to 30 or 40 days. I suggest a CCWG poll on (1) maintaining the 21 day comment period ending on Dec 21, (2) extending it to 30 days ending on Dec 30, or (3) extending it to 40 days ending on Jan 9.

I do have a problem with a timeline that does not allow proper review and public comment upon the proposal. Steve, with the greatest of respect, my experience has been over the years, that generally speaking 'Muricans pull the "Global Community" card only if and when it benefits them. It is the lack of notice, which makes this a problem, not whether it's a holiday. And, as this the rule rather than the exception, which has however been taken by many and often, this makes it intentional. As indicated on call #68, we have designed a detailed roadmap of key dates and milestones toward finalizing theThird Draft Proposal that we invite you to read and mark in your calendars.
In order to meet our 30 November deadline, it will be important that we all comply with this calendar of deliverables to ensure feedback and edits are incorporated into the Third Proposal in a prompt and appropriate fashion:

Hello, Assuming that the issue of holiday thing is out of the discussion. I believe a few days extension of comment period would not hurt. That said, it's also not compulsory that it be stated now and the Co-Chairs can always announce an extension of the comment period during the period itself. This was done in the past. Owning to the level of contribution that came in towards the mission statement(including that of board), it does seem the only major open item with quite unclear direction is stress test 18.
