I: [ALAC-Announce] Meeting Invitation - Civil Society Engagement Approach: Call to discuss Implementation
I will be unable to attend the call, but I read the doc and I have one point that I believe is important. There seems to be a misunderstanding about ALAC and the ALSes: either myself, or ICANN staff, have it wrong. I see an ICANN staff comment saying: Been pointed out that some ALS represent business interests, some technical, some may consider their organizations multistakeholder, and of course some civil society, noting "Not for profit organizations that serve for profit/commercial interests would not be within scope" Now, reading the criteria for ALS certification, I see: If an organisation receives corporate or government funding or has members who are government agencies or for-profit entities such members are allowed, provided such members do not interfere with, direct, or otherwise affect the mission, purpose or operations of the organisation This, to me, means that no ALS would serve for profit/commercial interests, because that would be violating certification criteria. If any ALS has members that are representing either governments or for-profit entities, these must be in such position not to affect the mission, purpose or operations of the ALS itself. Therefore, the ALS, when certified, is guaranteed not to be promoting for-profit or government agendas. Can we have this straightened up once and for good? Alternatively, may I know which are the At-Large Structures that allegedly represent business interests? I agree with Robert about the meaning “”would not serve for profit/commercial interests”- Receive $ from associations or profit organizations or government to execute your mission, since the mission will be really executed and it is not a way of money laundry, is totally normal for the majority of organization in the civil society, no matter if the not for profit organization is formed by individuals or by other companies and organizations. SO: +1 the wording of staff sure needs to be corrected. I would have thought they are referring to the processes ALS members participate in. For instance some ALS members participate in regional technical meetings et all. Even if that is the intent, a rewording is still required.
Alternatively, may I know which are the At-Large Structures that allegedly “represent business interests”?
SO: Actually this should be looked into at At-Large level (aside this particular subject), there may be need for occasional audit to determine if certified ALS status has indeed changed to being for-profit as I expect that due diligence is usually done during initial application to ensure such is not the case. SO: +1 the wording of staff sure needs to be corrected. I would have thought they are referring to the processes ALS members participate in. For instance some ALS members participate in regional technical meetings et all. Even if that is the intent, a rewording is still required.
Alternatively, may I know which are the At-Large Structures that allegedly “represent business interests”?
SO: Actually this should be looked into at At-Large level (aside this particular subject), there may be need for occasional audit to determine if certified ALS status has indeed changed to being for-profit as I expect that due diligence is usually done during initial application to ensure such is not the case. Thanks for the document, Glenn. I understand that it is a complicated issue, but my point was just that I consider incorrect the allegation by ICANN Staff that we have in ALAC ALSes that are expression of commercial interests. This is contrary to the criteria for certification, and therefore, if such cases exist (which I honestly doubt), corrective action should be taken. As simple as that. And it is orthogonal to the Civil Society definition issue. However, since you raise the problem, I will add that if the question arises for defining who is “Civil Society” and who is not – that should be the “Uncivil Society” J - not just for At-Large Structures, but also for all other components of this new group. Besides, the title reads: “ICANN Civil Society and Non-Commercial engagement in FY16 [Civil Society, Non-Commercial, Academic and End-User Engagement in FY16]”. Honestly, I do not understand this suspicion about At-Large Structures, for which, incidentally, there is a fully auditable and publicly known certification process – which is not really the case in a lot of other components of the ICANN multi-stakeholder community. Long story short, it strikes me, as a reader of the document, that what I consider by and large the non-commercial user community is divided in two parts, one (the NCSG) that is considered orthodox ex-officio, the other one (ALAC) that is accepted in bits and pieces, and only after an autodafé. SO: +1 the wording of staff sure needs to be corrected. I would have thought they are referring to the processes ALS members participate in. For instance some ALS members participate in regional technical meetings et all. Even if that is the intent, a rewording is still required.
Alternatively, may I know which are the At-Large Structures that allegedly “represent business interests”?
SO: Actually this should be looked into at At-Large level (aside this particular subject), there may be need for occasional audit to determine if certified ALS status has indeed changed to being for-profit as I expect that due diligence is usually done during initial application to ensure such is not the case. Hello all, as you know, I am a supporter of the Civil Society initiative. But reading the discussion here, I feel that there are indeed a lot of unanswered questions and I sense a real concern (even worry!) from many in At-Large that the initiative has the potential to weaken the At-Large community by dividing it, especially when it comes to policy issues. We all know that, as a group that incorporates non commercial, commercial, technical and academic communities, we often have different points of view than purely civil society organisations. Indeed, our priorities are sometimes different. I sense that in order to address all of the concerns that we have, our community needs a call with the leaders of this program, Adam Peake and Jean-Jacques Sahel. The currently proposed call on Wed 16 December is unsuitable for this concern as these are purely questions related to At-Large and interpretation will not be provided. (why?) My questions on any such conference call would be based on the imbalance caused within our community if the Civil Society Initiative went ahead without similar initiatives for our commercial, technical & academic At-Large Structures. 1. Are there going to be similar initiatives for Commercial, Technical & Academic communities? (reminder: I was told "yes" a few months ago - I'd like to know where we are on these) 2. Are At-Large Structures that are not classed as Civil Society going to be discriminated against? (in CROPP funding, in IGF workshops, etc.) 3. Is the ALAC itself going to be discriminated against as it is not 100% Civil Society? 4. Are any parts of the proposal aiming to have "Civil Society" come to consensus on policy related matters, irrespective of the current NCSG or At-Large boundaries? Indeed. I believe though that the only key issue is the presence or not of commercial organizations. "Technical" organizations should not be a concern, as there are such type of bodies not only in ALAC, but also in the NCUC, so that should not justify disparity of treatment. Just a couple of examples: - NIC Senegal (www.nic.sn) - Swathanthra Malayalam Computing (http://smc.org.in) both in NCUC without this being considered a problem. Same for academic institutions, like: - KAIST (http://www.kaist.edu/) - EDUCAUSE (http://www.educause.edu/) Let's be clear. I am in favour of an inclusive interpretation of the criteria for Civil Society. If we want to allow only the bodies that are strictly doing just advocacy for the public interest, we have to exclude indeed many of our ALSes, but by the same token we must exclude some part of the members of the NCSG as well, with the result that we will have to create a sort of internal filtering and verification mechanism, that will be a nightmare to implement and maintain. In my opinion, it is the role of the umbrella organizations (NCUC, NPOC, ALAC) to guarantee that their respective membership has activities that remain strictly in the non-profit domain, with the assumption that if the purpose is not making profit, the effect is to act for the benefit of the community. It is not an "advocacy" of civil rights per-se, and might well not match a strictly defined "Civil Society", but the effect is to work for the community not by talking, but by acting concretely. Which (but I might be biased by my background) has even more value and more effectiveness for the society at-large. Cheers, Roberto

But reading the discussion here, I feel that there are indeed a lot of unanswered questions and I sense a real concern (even worry!) from many in At-Large that the initiative has the potential to weaken the At-Large community by dividing it, especially when it comes to policy issues. We all know that, as a group that incorporates non commercial, commercial, technical and academic communities, we often have different points of view than purely civil society organisations. Are there going to be similar initiatives for Commercial, Technical & Academic communities? (reminder: I was told "yes" a few months ago - I'd like to know where we are on these) 2. Are At-Large Structures that are not classed as Civil Society going to be discriminated against? (in CROPP funding, in IGF workshops, etc.) 3. Is the ALAC itself going to be discriminated against as it is not 100% Civil Society? 4. SO: +1 the wording of staff sure needs to be corrected. I would have thought they are referring to the processes ALS members participate in. For instance some ALS members participate in regional technical meetings et all. Even if that is the intent, a rewording is still required.
Alternatively, may I know which are the At-Large Structures that allegedly “represent business interests”?
SO: Actually this should be looked into at At-Large level (aside this particular subject), there may be need for occasional audit to determine if certified ALS status has indeed changed to being for-profit as I expect that due diligence is usually done during initial application to ensure such is not the case. Here’s another way of looking at the definition problem. It is the role of ALAC to”represent” the interests of the ordinary Internet user, not civil society. I have an unconventional sense of what that means in terms of ALAC/ICANN’s engagement problem. Ordinary Internet users (that is to say individuals) are largely acting unconciously in a context where the definition of governance is changing. In brief, the governance of an ecology is not the same as command and control. In an ecology, the functions of governance are “distributed,” and that makes all the difference. The Internet’s existence is an expression of that change. The panic of nation states over control of the Internet is a sign that they are getting some of the message. The ordinary Internet user, on the other hand, may need some help to increase their consciousness of what it’s going to take to defend practices they already use. To me, that’s where ALSs and ALAC need to engage. Civil society is a construct that occurs in the context of balancing political power as if nothing had changed. In answer to the “what is civil society?” definition question, I have often quoted the argument of Martin Carnoy and Manuel Castells that global alliances of common interest among corporations and governments invented a construct called “civil society” to suit their purposes They said: “The other axis of the nation-state's reconfiguration is its attempt to regain legitimacy and to represent the social diversity of its constituency through the process of decentralization and devolution of power and resources. This translates primarily into revitalizing sub-state national governments (such as Scotland or Catalonia), regional governments, local governments, and non-governmental organizations. Indeed, the dramatic expansion of non-governmental organizations around the world, most of them subsidized and supported by the state, can be interpreted as the extension of the state into civil society, in an effort to diffuse conflict and increase legitimacy by shifting resources and responsibility to the grassroots.” ….. ….. “What emerges is a new form of the state. It is a state made of shared institutions, and enacted by bargaining and interactive iteration all along the chain of decision making: national governments, co-national governments, supra-national bodies, international institutions, governments of nationalities, regional governments, local governments, and NGOs (in our conception: neo-governmental organizations). From my perspective, the true role of civil society cannot be separated from the context of its dependent relationship with business and government. I buy Carnoy’s and Castells’ argument that the state in the digital age “is a network state,” where corporations and governments have invented a construct called “civil society” in order to “diffuse conflict and increase legitimacy.” The true work of civil society is not the delusional task of defending the public part of the public interest. It involves outsourcing of the responsibilities that the other two partners don’t want. But I don’t buy that “decentralization” is the means employed. What Carnoy and Castells missed is that networks are complex adaptive systems. The Internet supports systems that “distribute” functions, not systems that centralize (globalize), or decentralize. What I fear is any attempt to block the intention of its design. In my view of the nature of a digital age, the only possible stakeholder is the individual, or as ICANN’s euphemism puts it, the individual end-user. The primary challenge of the digital age is not privacy or security or even social justice. What is at stake is the individual’s autonomy to choose how to embody his or her self in the world. Although we are defined in social contexts, the Internet was designed to support a way of connecting in those contexts that makes the choices about connection intrinsic to the individual. I take it as a given that the Internet’s existence symbolizes new drivers of change that destabilize all existing systems. That includes the way that conventional political systems address the allocation of power, whether they act on the right, the center or the left. For example, alarm bells go off for me when the left-leaning advocates of social justice set up the straw dog dichotomy of multistakeholderism versus democracy. To me, what they are actually doing is defending the existing framing of political reality that justifies the continuation of their own existence. The false dichotomy they are stridently defending is a reactionary tactic that uses Internet Governance as a means to other political ends. The wonder to me is not that they would do this, but that other members of the framing it represents still rise to the bait. What I’m unhappy about is the state of “governance” itself, and I am working to make “governance” in open distributed systems work better. In those systems, the structural rules are intrinsic to all of their individual participants, not externally imposed as the conventional political systems still assume. In the longer run, external motivation is never effective in changing individual behaviour. The differences that make a difference in our behaviours are intrinsic to ourselves. The problem of outreach is not just one of bringing new nonprofit agencies into ICANN’s orbit. It’s one of turning outward to assist agencies that are supporting individuals in learning their way into a networked society.
Industry Associations in general, for instante Software or IT industry associations, will work for the benefit of such industry debating law, negotiating with governments etc though part of their mission can be protect internet users, I do not believe that we shall consider these a convenient ALSs for ICANN.
