U.S. Government follows up on “cooling off period” idea for ICANN employees

Dear Carlton , all Though ICANN is a private organization and could do whatever it want , at the same time it has a peculiar position as a “ regulatory” entity and as such higher level employees has access to quite confidential aspects of concurrent business and once out of ICANN joining just one of these companies with the knowledge of all in the market is quite an unfair situation and on my opinion would demand some quarantine of at least6 months as is normally demanded for high level government employees Vanda Scartezini Sent from my iPhone Sorry for typos On 29 Oct 2018, at 21:48, Carlton Samuels <carlton.samuels@gmail.com<mailto:carlton.samuels@gmail.com>> wrote: https://domainnamewire.com/2018/10/29/u-s-government-follows-up-on-cooling-o... ============================== Carlton A Samuels Mobile: 876-818-1799 Strategy, Process, Governance, Assessment & Turnaround ============================= _______________________________________________ At-Large mailing list At-Large@atlarge-lists.icann.org<mailto:At-Large@atlarge-lists.icann.org> https://atlarge-lists.icann.org/mailman/listinfo/at-large At-Large Official Site: http://atlarge.icann.org
Dear Vanda: I agree with you. That is, once we accept that ICANN is a regulator! [I credit the writer for being consistent in recognition.] Not our Uncle Sam though. He simply will not say it's so. In my corner of empire we describe this as wanting to eat your cake and cut your calories at the same time. -Carlton On Tue, 30 Oct 2018, 1:52 pm Vanda Scartezini, <vanda@scartezini.org> wrote:

Hi Vanda, Its a tricky situation if you consider the following statement at the end of the article which i tend to agree with.' One challenge I foresee is that ICANN sometimes hires people from the industry because of their specialized knowledge. It might be difficult to attract these people if they can’t return to industry companies. ICANN would need to compensate them for the restriction. I also wonder if employment laws in various states and countries would limit the ability to enforce cooling off provisions. There are never guarantees with Domain Name Business, for the businesses to thrive various factors such as Marketing, Pricing , customer service , reliability and trust come into play. Provided there is no conflict of interest, we should maintain the status quo. We risk over regulating and stifling innovation in the very industry we are trying to build. Hello Barrack, Am not sure any further compensation should be made, as I believe ICANN IMO already has a very attractive renumeration for her employees (especially the senior staff), and those restrictions consideration could serve as part of pay justifications as well. That said, I don't think a 6 months cooling off time will be ideal in this context (not for key principal officers), something within the range of 12 to 18 months may be more like it. Hi Seun, it was not LACNIC list, it was LACRALO list!, with automatic translation to Spanish for our region. I might agree a 6 month cool off period is desirable, more than that should endanger ICANN ability to attract people (or worst, in order to attract them should pay a premium, so the people can stay 1,5-2 years not working). SO: Sorry typo, I meant to say LACRALO (my RIR instinct kicked in there) ;-) I just filtered just to avoid a bounce response since I don't think am subscribed on that list.
