Dear ATRT2 colleagues, Thank you again for a very fruitful meeting in Los Angeles. I don't know whether my timing is right but I give it a try. I already now want to announce that I will be happy to volunteer doing work on particular items on the list of Action Items distributed by Charla on March 16 following our meeting in LA. (see below): Item 4 Legitimacy: In line with my interventions in L.A, I believe it is important that the work of the ATRT 2 has a strong focus on the overall legitimacy of ICANN both inside the ICANN ecosystem (SOs and ACs) and outside (outreach, governments, larger internet community). Item 6 (and 19 if grouped together) Accountability of GAC operations: In line with my remarks above and my interventions in LA, an essential element in ensuring accountability to ICANN and the multistakeholder model in my view would be to enhance the legitimacy of GAC towards all governments worldwide. The goal should be a GAC that is seen as the natural forum for governments for discussions on public policy issues related to the Internet and DNS. Its dominant organization, the Internet Corporation for Assigned Numbers (“ICANN”), suffers from inadequate accountability. ICANN holds the exclusive authority to manage the Domain Name System (“DNS”) that enables the Internet to function as a global network, and that authority is exercised by a Board of Directors whose powers are virtually unconstrained. ICANN’s exercise of unconstrained power over the Internet DNS is associated with a conspicuous gap between the accountability ICANN needs and the accountability it delivers. ICANN needs sufficient accountability, at least, to honor its written commitments and to satisfy its stakeholders’ expectations. Unfortunately, ICANN’s performance falls short in both regards. This article proposes to resolve ICANN’s longstanding predicament by describing a strategy to strengthen its accountability from within. Because its accountability gap arises from the absence of any mechanism binding the ICANN Board to act within its authority and consistent with its commitments, ICANN should adopt a standard of accountability that holds its Board answerable through procedures independent of it and binding on it. The Board’s unconstrained powers present the issue of power beyond right, the quintessential problem for constitutional law. For that reason, traditional principles of constitutional government offer a promising means of placing the Board’s powers under effective control. The article concludes that a written charter enumerating and separating the Board’s powers, a declaration of stakeholder rights, and an independent tribunal with the authority to issue decisions binding on the ICANN Board should be adopted through a ratification process that includes representatives from every sector of ICANN’s global stakeholder community.

Hi, In some of the downtime during the meeting last week, I spoke about the ALAC paper on the Legitimacy challenge to ICANN that ALAC had released as a conversation starter. Travel arrangements for ATRT members

Hi, First it was a pleasure meeting face to face with you in LA these last few days. I think we have quite an exciting and busy 9 months ahead of us. I hope everyone's trip home was uneventful was as pleasant as it could be. I was also honored by the manner in which you decided to include me in the coordinating group of chair and vice-chairs. Thank you. Note: I am _not_ doing this as an activity of the chairs' group, but on my own as a long time volunteer worker at ICANN who happens to be a member of the ATRT at this point in time. I have continued my personal discussion on ICANN Staff's decision regarding the fact that members of the ATRT are being forced to accept travel arrangement at ICANN's cheapest possible economy fare standards. Hearing some of the travel horror stories you all went through, further convinces me that I am not doing the wrong thing. I beleive that ICANN, as an organization, does not treat its volunteer workers properly as a general case and that it disrespects them in many ways. I especially beleive ICANN is not treating this group with the right level of respect. And I beleive that the level of respect a group like this gets is an important indicator of the organization's respect for the process and the work it is doing. Not to mention that most of us are busy and need the ability to work when we travel and some are older and perhaps need a bit more consideration - without the embarrassment for getting a doctor's note that says we are older. As long as anybody, including the CEO of the NGO called ICANN, can travel in better than economy class, we should all be able to travel that way. The senior officers of this 'in the public interest' corporation should not travel in a better class than the community they are accountable to or than those at the core of ICANN who do the work that gives the organization its legitimacy. As I say, I have taken this on as a personal campaign. But wanted to be sure I was disclosing to the group that I was doing it and would continue doing it. avri
