Implementation of WHOIS Review Team Recommendations - Update as of 30 August

Dear Review Team Members, Staff prepared the attached update on the implementation of WHOIS Review Team recommendations. After you've had a chance to review this update, we will coordinate a call with the key staff involved in the implementation to address your questions. Staff would like to highlight several important points: * Staff is implementing based on the specific directive from the Board. While the Board agreed with the overall spirit of WHOIS RT recommendations, the Board did not accept every recommendation as written and provided explicit direction to staff for how to carry out implementation. Staff should be evaluated on implementation based on Board direction<http://www.icann.org/en/groups/board/documents/briefing-materials-1-08nov12…> (see Appendix for Board Action and Rationale). * Implementation is still in progress, as Board direction was provided in November 2012, less than 12 months ago. The attached update provides milestones and due dates as a road map for the various projects. Staff realizes the challenge faced by the Review Team, relative to assessing "the extent to which the Board and Staff have implemented the recommendations arising out of the other commitment reviews" stated by the AoC, while making recommendations on the substance of the implementation would be the job of the next WHOIS RT. Staff looks forward to a productive interaction with the Review Team. Larisa B. Research reference to recommendations not being implemented WS1

Dear all, According to our schedule for Proposed Observations or Recommendations for Discussion, I should do research for recommendations not being implemented. I have found the following remark from Adam Peake at our NomCom meeting in Durban page 25 - 26 in the transcript: "ADAM PEAKE: I'll ask my own question if I may. I'm interested to know how you're looking at accountability and review. I know there has been a lot of discussion about reconsideration and so on, but the part that interests me from the bylaws there is how you're considering the periodic reviews that should take place of the ICANN structures themselves. They don't seem to be audited. The input doesn't seem to continue. I would think that would be something that your committee might look at given the similarity in terms that you have in your titles there. And the Nominating Committee is a good example of that. There was a Nominating Committee [review?LFU]some years ago and there has been very little implementation. If you look at the GNSO review that happened where we saw a restructuring into contracted and non-contracted parties, the delegates that come from the GNSO to the Nominating Committee do not reflect the structure of the GNSO as it currently exists. So we have quite uncomfortable mismatches going on with what exists with the reality of how the organization works and then how the Nominating Committee reflects that, for example. And so we don't seem to have very much auditing and processing of what happens with this rather important part of accountability and review that is in the bylaws of ICANN. So I wonder if you would like to take a look at that. Thanks." Brian's answer: "BRIAN CUTE: Just a quick response to Adam. One of the things we have to deliver is a recommendation on the Affirmation of Commitments review process itself. We want to make sure that this review process and the three that precede it are improved going forward. In that light, we have heard some comments to the effect that we need to be wary of the organization and not reviewing itself to death. It's comments we've heard. So we're in listening mode. I think those comments tie in to the point you raise about it might be appropriate for this Review Team to look at the other review processes in that broader light." In order to shed more light on the issue one could contact Adam Peake and ask which NomCom review that is not being implemented or audited. It could also be a general recommendation that all reviews need to have a follow up on implementation of recommendation. Best, Lise

ATRT 2 Upcoming In-Person Meetings - Washington DC and Buenos Aires

Dear Review Team Members, I would like to clarify the particulars of your upcoming trips. Washington DC (Thursday, 19 September - Friday, 20 September) To accommodate your request for an additional meeting in Washington DC, while maintaining fiscal responsibility, staff will move forward with travel arrangements on an accelerated basis. The meeting will take place on Thursday and Friday (full days), with the specific agenda to be developed shortly. Participants will arrive on Wednesday, 18 September and depart on Friday night, 20 September, based on flight availability. Members planning to attend the Washington DC meeting in-person will need to finalize their travel arrangements by 5 pm PST on Friday, 30 August. Constituency Travel has already contacted you regarding your travel arrangements. If Constituency Travel does not hear from you before 5:00 pm PST Friday 30 August, they will assume that you plan to participate in the meeting remotely. This aggressive timeline is necessary given the short lead time for your selected meeting date and the high cost of airfares and hotel. Buenos Aires (Monday, 18 November - Wednesday, 20 November) Staff will work to have ATRT 2 sessions scheduled within the timeframe identified during the last Los Angeles meeting - Monday through Wednesday. Participants will arrive on Sunday, 17 November and depart on Wednesday night, 20 November, based on flight availability. While every effort will be made to accommodate in-person meetings with all requested groups, conference calls may be an option in some cases should staff run into scheduling difficulties with other groups. Constituency Travel will be in touch with you as soon as possible regarding your travel arrangements for this trip, and your response will be needed by 5 pm PST on Friday, 30 August. I hope that this information clarifies questions raised in previous communications. Please don't hesitate to contact me, Alice or Charla regarding these meeting schedules. Updated Inventory of Observations and Recommendations

Items to note: 1. The two items Jorgen had highlighted had already been included in the earlier version of the Inventory<https://community.icann.org/download/attachments/41899319/ATRT2+Inventory+o…>. a. Specifically, Recommendation #7 Finance Accountability and Transparency and #29 Outreach from Fiona's paper are reflected as Items # 34 and #28, respectively, on the Inventory. 2. New items #38-41 have been added as place holders for potential recommendations regarding SSR RT and WHOIS RT recommendations implementation. Please provide the wording of your observations and potential recommendations when you have it available. 3. Action Items | Responsibility | Schedule column, as well as Additional Information is continuously updated to reflect new information. 4. Specific staff follow up items from yesterday's meeting are: a. WHOIS update is being finalized by staff and will be submitted as soon as possible. b. Organization Chart has been requested and will be provided as soon as it is finalized and approved by Fadi within the next two weeks. c.
