Level of support Council for Empowered Community - Community Forum
Dear all, Per yesterday’s meeting, you are requested to share your views whether or not the Empowered Community Administration (ECA) should request a community forum, and if so, to request a virtual forum or one during ICANN78. Closing date is Monday 25 September 23.59 UTC. This would allow Alejandra to consult and speak with her fellow ECA members, taking into account your views. Stephen’s view On yesterday’s call I shared with you Stephen’s views as he was traveling. I will use this opportunity to share his view again. As background, please note that Stephen is currently the approval action process manager and was the ccNSO rep on the ECA. “ As you have probably gathered, I am a big advocate of having an Approval Action Community Forum take place at the “next available” ICANN meeting should the Board take an action that requires Empowered Community approval. If for no other reason, it’s a community-wide show of respect for the Multi-stakeholder model, the Bylaws, and what we achieved as a Community in successfully executing the Transition from the USG. All need to be taken seriously and shown due respect or else erosion will begin to occurr. On behalf of the ECA, I managed the first ever Approval Action Community Forum where Chris came and led the dance with the Community on behalf of the Board. It was completely non-controversial, as I suspect these changes are as well, although I do confess, I have not studied them in depth. It does seem like such changes do deserve the requisite scrutiny so if we have a view in favour I will happily support that. (1) requires Decisional Participants to “promptly inform their constituents” of the delivery of such notices; and
(2) triggers an Approval Action Community Forum Period, to convene a Community Forum, which ends on the 30th day after the Approval Action Board Notification Date *(15 October 2023*) .
If the community (read ECA) intends to convene virtual Forum it needs to be convened and concluded during the period beginning upon the Approval Action Board Notification Date (15 September 2023) and ending on 15 October 2023.
If the ECA intends to convene an in-person session, it has to be convened during ICANN78

Greetings Alejandra and fellow Council members, I apologise for not making the call on Thursday –I could not establish a Zoom connection from my flight back from the APTLD Conference. With regards to the issue of a Community Forum –Make the Board explain to the Community writ large, in person, why they feel their proposed changes to fundamental Bylaws are worthy of the Community’s endorsement. Full-stop. There is still time to get this organised for Hamburg, It needs to happen as a matter of principal. I set the precedent for this; don’t break it now. Irina, The public forum can be scheduled outside of the regular schedule –an hour before the daily schedule formally starts. That’s what I did. I fought the battle to get the inaugural Approval Community Forum as part of the regular schedule time wise, but lost that battle. In retrospect, I think that was a good thing as it put ICANN Org in a position going forward of NOT being able to claim “Oh, so sorry, there is no room on the schedule for the Community Forum”, as they found a way to do it “out of band” then, and they thus can find a way to do it “out of band” going forward. The public forum can be scheduled outside of the regular schedule –an hour before the daily schedule formally starts. That’s what I did. I fought the battle to get the inaugural Approval Community Forum as part of the regular schedule time wise, but lost that battle.
In retrospect, I think that was a good thing as it put ICANN Org in a position going forward of NOT being able to claim “Oh, so sorry, there is no room on the schedule for the Community Forum”, as they found a way to do it “out of band” then, and they thus can find a way to do it “out of band” going forward.

Hi all, I am okay with calling for the Community Forum. While I have no strong preference for or against it, Stephen's arguments make sense to me. I wouldn't like the community to simply rubber-stamp the decisions all the time, and if we can request additional scrutiny, I support the spirit of such a request. Cheers, Tanya

In all honesty Alejandra, based on my experience, you will most likely either not hear back or get a reply along the lines of “do what you want to do.” The Board is fiddling around with Bylaws that are directly related to PTI/IANA. IANA is the core. It “IS” the keeper of the Internet. Full-stop. Not just the root zone, but AS numbers and hundreds of other registries, all of which need to be in place to keep the show running. ICANN Org is just icing on the cake. It could go away tomorrow and it’s absence would barely be noticed from an engineering standpoint. The global community would find a “home” for the IANA. It may well be the ITU, which would not be (in my view at least) a desirable outcome, but it would endure. It has to. I submit that the Community has an obligation to make the Board account for the changes they are proposing between the relationship between ICANN Org. and PTI/IANA, as benign as they seem to be. And the way to do that is via a Community Forum at ICANN78 in Hamburg. Best Regards, Stephen PS: Based on my experience, an Approval Action Community Forum is relatively easy to run/manage. As I recall, I came prepared with a few questions for Chris (who was on the Board at the time), and then turned things over to the Community participants who were present. There was nothing controversial about what the proposal was (I cannot even remember its details now, and I don’t have the energy to look it up); you have the same situation here. No fireworks. It’s the procedure around it all that matters. Chris, When Alejandra assumed the Council Chair from Katrina, she took over as the ccNSO’s ECA representative as well, so I have emeritus status with respect to the ECA. Now that the Board is fiddling about with Bylaw changes, there will be some necessary paperwork from the ECA back to ICANN, and the ECA itself will have to sort out who is going to produce it. I did all of it whilst I was the ccNSO ECA representative, as no one from the other SO/AC’s had any interest in the process. My slight worry is that, given the lack of engagement in the process elsewhere, by driving for a forum on changes which are clearly benign we undermine our ability to coalesce the icann community around a forum when it does actually matter.

When Alejandra assumed the Council Chair from Katrina, she took over as the ccNSO’s ECA representative as well, so I have emeritus status with respect to the ECA.
Now that the Board is fiddling about with Bylaw changes, there will be some necessary paperwork from the ECA back to ICANN, and the ECA itself will have to sort out who is going to produce it. I did all of it whilst I was the ccNSO ECA representative, as no one from the other SO/AC’s had any interest in the process.

The public forum can be scheduled outside of the regular schedule –an hour before the daily schedule formally starts. That’s what I did. I fought the battle to get the inaugural Approval Community Forum as part of the regular schedule time wise, but lost that battle.
In retrospect, I think that was a good thing as it put ICANN Org in a position going forward of NOT being able to claim “Oh, so sorry, there is no room on the schedule for the Community Forum”, as they found a way to do it “out of band” then, and they thus can find a way to do it “out of band” going forward.

Hi all Alejandra’s latest has moved me firmly into the camp of being in favour of calling for a forum. It’s always easier to have a challenging conversation when you’re used to having regular conversations. The more ‘practice’ of this format, and the more relationship building between the decisional participants that forms part of that work, the more likely it is that we will have the relationships and knowledge of each other we would need- if we ever have to deal with a more difficult situation. It also reminds me of the overall transition itself. If we had not taken the time through the process to build our inter-community and intra-community relationships, we would never have been able to come to the agreements that allowed the transition to happen. So I suggest when making the pitch for this forum, we include this logic in it. Alejandra’s latest has moved me firmly into the camp of being in favour of calling for a forum.
It’s always easier to have a challenging conversation when you’re used to having regular conversations. The more ‘practice’ of this format, and the more relationship building between the decisional participants that forms part of that work, the more likely it is that we will have the relationships and knowledge of each other we would need- if we ever have to deal with a more difficult situation.
It also reminds me of the overall transition itself. If we had not taken the time through the process to build our inter-community and intra-community relationships, we would never have been able to come to the agreements that allowed the transition to happen.
So I suggest when making the pitch for this forum, we include this logic in it.

It was completely non-controversial, as I suspect these changes are as well, although I do confess, I have not studied them in depth. Although held “out of band” early in the morning, that first forum had really solid attendance, which was heartening.”

Under the ICANN Bylaws, delivery of the Secretary’s Notices on 15 September: (1) requires Decisional Participants to “promptly inform their constituents” of the delivery of such notices; and (2) triggers an Approval Action Community Forum Period, to convene a Community Forum, which ends on the 30th day after the Approval Action Board Notification Date (15 October 2023) .
If the community (read ECA) intends to convene virtual Forum it needs to be convened and concluded during the period beginning upon the Approval Action Board Notification Date (15 September 2023) and ending on 15 October 2023. If the ECA intends to convene an in-person session, it has to be convened during ICANN78
EIther way, if the ECA intends to convene a Community Forum, support staff reuested to be informed by Wednesday 27 September 2023.

Dear All Yesterday the gNSO ECA representative reacted to my community forum consultation and he proposed to consider the virtual alternative. Today I explained the tight time constraint for a virtual setup and took the opportunity to inform the ECA about our willingness to have a Community Forum, preferably at ICANN 78 (potentially on Monday, Wednesday or Thursday at 8:00am). When Alejandra assumed the Council Chair from Katrina, she took over as the ccNSO’s ECA representative as well, so I have emeritus status with respect to the ECA.
Now that the Board is fiddling about with Bylaw changes, there will be some necessary paperwork from the ECA back to ICANN, and the ECA itself will have to sort out who is going to produce it. I did all of it whilst I was the ccNSO ECA representative, as no one from the other SO/AC’s had any interest in the process.

The public forum can be scheduled outside of the regular schedule –an hour before the daily schedule formally starts. That’s what I did. I fought the battle to get the inaugural Approval Community Forum as part of the regular schedule time wise, but lost that battle.
In retrospect, I think that was a good thing as it put ICANN Org in a position going forward of NOT being able to claim “Oh, so sorry, there is no room on the schedule for the Community Forum”, as they found a way to do it “out of band” then, and they thus can find a way to do it “out of band” going forward.

Under the ICANN Bylaws, delivery of the Secretary’s Notices on 15 September:

(2) triggers an Approval Action Community Forum Period, to convene a Community Forum, which ends on the 30th day after the Approval Action Board Notification Date *(15 October 2023*) .
If the community (read ECA) intends to convene virtual Forum it needs to be convened and concluded during the period beginning upon the Approval Action Board Notification Date (15 September 2023) and ending on 15 October 2023.
If the ECA intends to convene an in-person session, it has to be convened during ICANN78
EIther way, if the ECA intends to convene a Community Forum, support staff reuested to be informed by Wednesday 27 September 2023.

To which I reply: My experience suggests that it’s only the ccNSO that takes any of this seriously. And we have to. ASO doesn’t care at all; they never participated during my tenure as the ccNSO ECA representative. I doubt that has changed. GNSO is at war within itself continuously. They cannot be considered a consistent reliable player in this arena. During my tenure, ALAC was basically useless as well. I doubt that has changed. Thus in my view it is up to the ccNSO to hold ICANN’s feet to the fire on any matter that we can do so, no matter how un-controversial it might be. We do so not just for ourselves, but for the Multi-stakeholder Community writ large. The public forum can be scheduled outside of the regular schedule –an hour before the daily schedule formally starts. That’s what I did. I fought the battle to get the inaugural Approval Community Forum as part of the regular schedule time wise, but lost that battle.
