Dear All, Please find below the notes and action items from today’s meeting. The notice in relation to action item #3 will follow shortly after this email. Best regards, Marika Notes / Action items EPDP Drafting Team meeting on 5 July 2018: These high-level notes are designed to help the DT navigate through the content of the call and are not meant as a substitute for the transcript and/or recording. The MP3, transcript, and chat are provided separately and are posted on the wiki at https://community.icann.org/x/2wA5BQ. Scope * Note that a number of specific comments/edits were put forward to the current language in the charter, in addition to a number of general comments that were provided on the mailing list. * Recognition that EPDP needs to be focused in its initial phases just on the Temp Spec, nothing more. Objective is to have draft Initial Report ready by ICANN63 to have process completed by May 25 2019. * Work on access model is also urgent and important, but cannot be done in the 8-9 weeks available to work on the Temp Spec Initial Report. Work on Temp Spec would help inform discussion on access, includes a number of gating questions that need to be answered first. * Once Initial Report on Temp Spec is complete, then it should shift focus to access and accreditation, informed by the work on the Temp Spec. * BC does not agree that accreditation should be part of the EPDP - for the most part that will be handled outside of ICANN's remit. Access is key, BC understands that there is a short time available, but does not want to put a false deadline on for the work on access. Leave flexibility to EPDP Team and not limit the discussion of the EPDP based on perceived notion that the work cannot get done. * IPC is of the view that access remains in scope as it is part of the temporary specification. See also comments submitted to the mailing list. * Everything should be considered within scope of the EPDP, but items in the annex should be addressed following the completion of the Initial Report on the Temp Spec related issues. * Need to define the use of the term 'Temporary Specification' does it include or not include the Annex when referred to. For the purpose of the EPDP WG Phase One, "Temp Spec" does not include the Annex. The Annex can be considered in Phase Two following the publication of the Phase One initial report. * Consider forming a small group consisting of Paul, Susan, Keith and Stephanie to look at the different comments / positions and develop an approach that may be acceptable to all. Action item #1: DT members to review google doc (https://docs.google.com/document/d/1x2k9e3w752j-C_Ix43A7HSDV2G-_zXlyzZozei4…) and include any input / comments that are missing. Ideally focus should be on comments/suggestions section instead of redline so that small team is able to try and reconcile the different positions in an updated version. Action item #2: Paul, Susan, Keith and Stephanie (with support from staff as needed) to work on scope language. Action item #3: Staff to recirculate list of google docs with different charter topics so that DT members can review in next 24 hours that all info is there. Friday 6 July COB is deadline for any further input. Membership Criteria * See input received in google doc. * Is current language to prescriptive? Donna has suggested a less prescriptive replacement - noting that appointing organizations are responsible for selecting members that they believe are best suited for the role. * Consider sharing possible dates/location for F2F meetings to allow members to plan accordingly. Location may also depend on membership composition. * Fourth bullet - how to define temperament? consider changing it to willing to work in good faith towards consensus? Or solution oriented? Update to 'treat' and 'respect'. * If members do not abide by EPDP Team statement of participation, Chair has the ability to limit participation. * Use of the term consensus refers to section 3.6 of the GNSO Working Group guidelines, not Consensus Policy. Consider including a reference to the Working Group guidelines. Action item #4: Staff to replace dot points language in charter with text suggested by Donna (with minor edits as discussed) Action item #5: Staff to share proposed call for volunteers & EPDP Team statement of participation with DT for review. EPDP Team Composition * See comments in the google doc. * Principle of inclusivity key. * Board has confirmed Board's preference for 2 Board liaisons. * Parity between CSG and NCSG participation is sought. * Possible compromise put forward by BC (2+1 per C in CSG and 6 +3 for NCSG) * SO/AC representation: consider going back to 1 + 1, with the exception of the GAC who would get 3 + 3. SO/ACs would be invited to participate but not required to do so. Could consider inviting to appoint member or liaison - as their preference is. Liaisons primary's purpose is to get information back to group - liaisons can listen or work, while members have to commit to work and sign up to the statement of participation. Key is to ensure that a member/liaison from another SO/AC can't block consensus because they can't reach consensus within their own group. Should making consensus be the perogative of GNSO groups only? ACs have their means to provide Advice to the Board. To the extent that you are not able to agree to the statement in full, other SO/ACs should assign a liaison instead of a member. * May need to explain what a consensus call is. Reference GNSO WG Guidelines on provisions concerning consensus call. * Need to define member/liaison/observer/alternate terms. * Consider using a form that is to be used if/when alternates step in. * Small team identified for scope discussion also aim to finalize number discussion. Action item #6: Follow up with GAC on the difference between members and liaisons and their expectations with regards to GAC participation. Action item #7: Small team to review membership # and aim to come to agreement on proposal to take back to full DT. Deadline - provide proposal by Wednesday 11 July at the latest. Leadership: * Current suggestion in charter is for EPDP Team to appoint two vice-chairs, some may have concerns about that suggestion. Small leadership team may be preferred - one vice-chair may be sufficient. * Consider removing issue to appointing two vice-chairs but leave it to the EPDP Team to decide? * Point iii) please delete "and trademark law". Not all agree with the deletion of this reference as knowledge in that regard may be of specific importance in relation to access. Action item #8: DT to provide input on leadership section so that any issues can be resolved as soon as possible. Other topics: Action item #9: Staff to review comments / edits on other topics and see if/how these can be addressed in the master document. Next Steps: * No email vote yet as discussions have not completed yet. Likely vote to take place during Council meeting on 19 July. Aim is to have ‘final’ charter to the DT by next week Wednesday. Edits to the charter

Hello Marika, The BC has agreed upon adding the following to the draft charter. Add highlighted text to section j of charter Draft: j) Disclosure of non-public data to outside parties, including definition of terms in the Temp Spec, such as “reasonable access” j1) Should existing requirements in Temporary Specification remain in place until a Uniform Access Model is finalized? The BC requests that the Temp Spec Annex is added back into the EPDP charter and work on access be in parallel with all other work. Also include the following language concerning access to the scope of the ePDP charter. EPDP scope already includes developing policy for access, and for RDAP to replace Port 43. This scope should include policy development for tiered access via RDAP+, which could accept an accreditation token and purpose for query. This would allow legally-accredited entities to access non-public Whois if and when such accreditation is accomplished. The design of accreditation processes and legal clearance for those accreditation models would occur entirely *outside* of this EPDP. If and when an Accreditation model is cleared by appropriate legal authorities, RDAP+ should be ready to accept, log, and respond to these accredited access queries. The BC requests that we refer to a uniform access model as a generic term and does not refer to the ICANN org model Uniform Access Model. Membership Composition - All Stakeholder Groups Must Have Parity in Numbers

Dear all, I hope that I am mis-reading the table in [this section of the charter](https://docs.google.com/document/d/1I3LJkIN1Xdp8lW92fLq5d_bLgFv7gW…. From what I see, it has been proposed that the Commercial Stakeholder Group will have 9 members on the EPDP, whereas all other Stakeholder Groups will have 3 members. This is fundamentally unfair and we require parity. If this is not an error, I would like to know based on what rationale it was thought to allocate 9 membership slots to the CSG while all other Stakeholder Groups have only 3 members. At the NCPH level, it is essential that there be parity in membership numbers between the CSG and the NCSG. Thank you, Ayden Férdeline

Clarification proxy/alterates for EPDP meetings

Dear all, There appears to be confusion regarding the use of the proxy and or temporary alternate form for the upcoming EPDP DT meeting on the 5th July 2018 and indeed the following meetings. These are not GNSO Council meetings and therefore no proxy nor alternate can be put forward in case of an absence. Forms submitted for the EPDP DT will not be taken in account. Fellow EPDP DT members from the same constituency or stakeholder group can instead relay your position on your behalf in case of an absence, and you are encouraged to share your thoughts on the mailing list ahead of time. You are however very welcome to continue submitting proxy and temporary alternate forms for GNSO Council meetings (next one: 19 July 2018 at 12:00 UTC). CLARIFICATION: Announcement for Expressions of Interest for EPDP Team Chair position has been posted

Dear Colleagues I understand the announcement today regarding the EOI has caused confusion among some of you, primarily because the text used had not been considered fully and agreed by the Council. Given the time constraints that we are under to commence the EPDP, Heather, Rafik and I met on Thursday afternoon after the wrap up session and agreed that we would aim to publish the EOI today. Marika sent a note to the epdp-dt mailing list with proposed text and calling for input by UTC 18.00 on Friday 29 June. Ayden and I had some comments and these were taken into account and reflected in the announcement. Perhaps what we were unclear about was the inclusion of some of the additional text and Annex A—Chair Responsibilities and Expectations in the announcement. To the extent that there is concern about any of the text contained in the EOI could I ask that you respond to this email identifying the concerns and we will endeavor to make amends. Candidate Confidentiality

All Apologies for missing this discussion yesterday. I want to express my reservations about the agreement that the EPDP Chair candidate names be made public. I believe they should be confidential or, at a minimum, the candidates should at least have the option to decide whether they wish to have their candidacy made public. Given the subject matter of this PDP, I thought we might be a bit more sensitive to privacy. I’m also disappointed that the selection task falls to the leadership team. We established a standing selection committee for this purpose. I understand the concerns about being able to undertake the task quickly, but this same pressure will be on the leadership team as well. If the candidate names are public this also puts considerable pressure on the leadership team in terms of lobbying and claims of bias in selection etc. We may also have potential conflicts of interest arise and as there is only three of us this would leave the job to two. The SSC is more representative of the GNSO and has a methodology in place for selections as a result of the processes they’ve undertaken to date. Thanks Donna Sent from my iPhone 100

Working Methods

Hi all, I would like to request several revisions be made to the EPDP Working Methods please: 1) All meetings must be recorded and transcribed. Please revise this text from: In addition to the standard services provided to GNSO PDP Working Groups such as policy staff support, mailing lists and regular conference calls, including recording and transcription where needed (frequency and duration to be decided by EPDP team), the EPDP team will need appropriate support to: To: All calls of the EPDP must be recorded and transcribed, and said recordings and call transcriptions must be publicly accessible from the ICANN website. Standard support offered to GNSO PDP Working Groups, including but not limited to the provision of a wiki space, archived mailing lists, and conference call facilities, will be required. In addition, the EPDP will need appropriate support to: 2) Google Docs may only be used in conjunction with Google Vault. Please revise the text from: the EPDP Team should consider which tools provide the best flexibility to facilitate online collaboration, such as the wiki and Google docs. To: the EPDP Team should consider which tools provide the best flexibility to facilitate online collaboration, but it must do so in accordance with the principles of accountability and transparency that are so important to the GNSO. If Google Docs or other G Suite products are used, it must be used in conjunction with Google Vault, which logs data for archival purposes. Similarly, if other tools are used, they may be used only if they preserve information to a level that meets or exceeds eDiscovery standards in California, being the location of ICANN's headquarters. 3) Translation of executive summary and recommendations of the initial report for public comment, and of the entire final report, into ICANN's official languages. Suggested text: The substantive work of the EPDP must be translated into ICANN's official languages in order to provide non-English-fluent stakeholders with an equal level of access to review the work of the EPDP. While this law takes effect from 1 January 2020, given its similarities to the GDPR and the fact it has been adopted in ICANN's place of incorporation, I would suggest we should consider the impact of this piece of legislation on the work of the EPDP as well. Google Docs

Folks, As I mentioned before, it's possible to share a Google Doc for commenting instead of full edit privileges or only view privileges. Allowing drafters to comment makes for actual productivity, while sending e-mail updates does not. Allowing all editors don't usually work in groups of more than 3 indeed, but read-only is not the only option. Rubens

Membership Criteria - bullet # 8 (training)

Hi all, I would like to suggest that bullet point # 8 (training) of Membership Criteria be revised from: Commit to attend any provided introductory training courses, e.g., privacy, trademarks, registrar operations, DNS, etc. To: As this EPDP has been initiated in relation to a Temporary Specification invoked as a result of the European Union's General Data Protection Regulation (GDPR), members must possess a sound knowledge of data protection laws and practices, and an in-depth understanding of the GDPR. Members must commit to participating in regular and adequate training that builds this baseline of knowledge, and they must complete this training within 10 calendar days of it being made available, or their membership status shall become that of an observer until such time as this training is completed. I believe this bullet point should be narrowed down just to data protection law. If other training is required, these activities should be listed separately along with a justification for why they are critical to the work of this EPDP. Thanks! Best wishes, Ayden Férdeline
