Agenda - Reconvened IGO-INGO Protections PDP Working Group (Red Cross) - 14 December 2017 @ 18:00 UTC

Dear all, Please find below the proposed agenda for the next Working Group call (scheduled for Wednesday 14 December at 18:00 UTC). As a part of the agenda review, please also review the attached files from the representatives of the Red Cross and staff. These were discussed at the informal session in Abu Dhabi and we will review these again for the benefit of the entire group. Both are examples to facilitate discussions for defining the finite list of identifiers to receive reservation protections as per the GNSO Council resolution and to also develop a formula for future changes as new National Societies are created by the IFRC. Attachments: 1. rcrc_list_example.pdf - As noted in a prior email, this was created by staff to provide a template of what the final output should look like for the finite list of identifiers. It in no way presupposes the final determinations of this group. This is based on principles from lessons learned in implementing reservation protections for those recommendations that were approved by the Board. The principles are that the definitive list be Reconcilable, Validated, and Free from Errors: a. Reconcilable - meaning that we clearly can articulate the 190 National Society names and their respective identifiers to be protected. The rationale for this principle is that in implementing the identifiers currently temporarily protected as a result of the Board resolution back in 2015, it was difficult for staff to determine whether the temporary list matched that of the recommendation as adopted by the GNSO Council. b. Validated - meaning that the definitive list is presented in a way to easily determine that variants of official identifiers meet the criteria of the reconvened group's recommendation (to be determined based on the continued deliberations). In implementing the temporary list, especially for those Society names that only contained non-Latin identifiers, they could not be matched back as being a part of one of the 189 (at the time) Societies identified per the WG's original recommendation. c. Free from Errors - as a part of the first two principles, that the listed identifiers are correct in their formal and usual names, especially those where non-Latin identifiers are concerned. In implementing the temporary reservation list, staff was later alerted to a few errors detected by Registry Operators. For example, the Russian National Society name, based on the list provided to staff, contained an error, where the generic work of "society" was reserved and not the formal or usual name of the National Society. 2. ICANN mock-ups 4 December 2017.pdf - This is an example provided by the representatives of the Red Cross. This is useful to help determine what the exact definitive list could be including asked for variants of usual names as based from formal names of the National Societies. It will also facilitate the development of a formula for when future National Societies are created by the IFRC and added to the reservation list. This formula is critical, especially for ICANN, as to avoid misinterpretations as to whether the new identifiers meet the exact criteria of the policy recommendations from this group. Dear all, For your information, please find below a statement that Mason Cole, a member of this Working Group, made during the Open Microphone session at the GNSO Council’s Public Meeting held on 1 November 2017 in Abu Dhabi. Staff would like to take this opportunity to remind everyone of Berry Cobb’s message to this mailing list, sent on 1 November following on the staff notes of the informal Working Group meeting earlier that day. Berry had sent an example table that he used during the meeting that attempts to propose a framework for developing the finite list of Red Cross identifiers to be protected: see his email and the table at http://mm.icann.org/pipermail/gnso-igo-ingo/2017-November/000105.html. Staff would also like to reiterate Berry’s request that Stephane provide an electronic copy of the handouts he brought to the informal meeting that also listed some examples of Red Cross identifiers. Stephane: if you can circulate that document to this mailing list at your earliest convenience, that in combination with Berry’s examples is likely to be very useful to the Working Group as it continues its discussions. The first regards the methodology around development of the list of Red Cross names that are to be reserved. The proposal is that “exact match” names of the organizations be reserved, as well as what are known as “common names.” For example — the American Red Cross Society as an exact name, and the American Red Cross or The Red Cross as common names. And as you know, each name is to be reserved in multiple configurations of language and IDN. There is a concern that there will be claims to what are termed common names far beyond what was initially speculated. There’s no criteria or standard for identifying a common name, so one presumably relies on the word of each provider. However, that opens the door to potentially exponential multiplication of the name list that may not be warranted in all cases. Or it could lead an organization to claim that an acronym constitutes a common name. The GNSO obviously supports the effort around formal names, as they’re unquestionable identifiers, but there should be concern about opening the process to numerous and potentially less unquestionably linked common names or acronyms. The second concern is the methodology for adding the names of new societies to the reserved list. The current proposal is that once a Red Cross organization is chartered, the GAC can make a request directly to ICANN staff for inclusion of that name on the list. Staff presumably would then notify GDD, who would instruct contracted parties to accommodate the new names. This is alarming on several fronts. 1) It impacts our contracts. 2) It puts the GAC in a position to instruct staff directly with regard to policy, with no GNSO involvement. 3) There’s little incentive for the GAC to withhold more from its wish list in such a scenario. It would be much more preferable for the GNSO to be part of the process on policy that eventually impacts our contracts. I believe the GAC, in its communique, reaffirm its Durban advice that Red Cross and IGO acronyms should be reserved permanently. So I urge the council to carefully consider these matters in the context of the Red Cross and IGO names. GAC Communique - section on Red Cross names

Dear all, The GAC Communique from ICANN60 has just been published, and contains a paragraph on our work. Note that it is not in the section that contains formal GAC advice, and does not contain a specific request to this Working Group; however, I thought you may wish to note the GAC’s remarks. The relevant text is: “Following its most recent advice adopted in the Copenhagen and Johannesburg Communiqués, the GAC welcomed the progress made by the GNSO's re-convened PDP Working Group on the Protection of IGO-INGO Identifiers in All gTLDs, tasked with re-examining the GNSO’s past recommendations on the protection of Red Cross and Red Crescent designations, names and identifiers – particularly of the names of national Red Cross and Red Crescent societies. REMINDER: Informal meeting about Red Cross Names at ICANN60

Dear all, This note is just a reminder that an informal meeting at ICANN60, to continue the group’s discussions on principles and criteria for determining the finite list of Red Cross names, has been scheduled for tomorrow - Monday 30 October, 13.30-14.30 Abu Dhabi time - in Capital Suite 19. If anyone was planning to call in rather than attend in person, please be so kind as to let staff know right away – as we mentioned, no AV facilities are being provided for these informal meetings but we will see what we can do to try to rig up something. International Movement of the Red Cross and Red Crescent? * For the National Societies - * What is a "usual name" (as proposed by the Red Cross in Stephane’s most recent email)? This needs to be clarified and understood - is there a formal list? The Council's direction was for a specific and finite set of names, with specified limited variants. * One possibility is to limit the list to "official (full) names" - in their respective national language(s); however, the concept of "usual names" can be refined, e.g. "commonly used". * No objection to including "usual names" as long as the meaning is clearly understood, and there can be a finite list (Note: By "usual" name this is normally the Society name without the word "Society" without the addition of the article "The"). * It may be clearer to use the phrase "official and commonly known names" instead; however, is there a way to ensure that this is specific enough i.e. a definitive list? Can we use something like the TMCH requirement of demonstrating "use"? Alternatively, for "commonly known", can we use the criteria in the additional draft principles suggested by the Red Cross? * Discussion to continue on this topic, and the additional suggested draft principles submitted by the Red Cross representatives.
