There were no objections to the consensus levels assigned to the proposed recommendations nor were there objections to the list of identifiers listed as an outstanding issue. Thus, those identifiers are included in the list of names to be protected. Once the PCF is posted on icann.org, I will send a link to the list. Note: as you will see in the redline, there are still a few outstanding items for the WG to consider when it reconvenes to consider the comments submitted and readies the report for submission to the GNSO Council. Hi All, As of last Thursday, there were only a few comments of support and no objections to the identifiers being reserved within the two issue categories below. I’ve updated the definitive list to reflect their acceptance (ex. removal of the yellow highlights) for the first issue category of the stand-alone terms. Where those identifiers were highlighted in yellow, I moved the English translation to a new Comments column to maintain the chain of custody, but they were deleted from Column 1 because there were only placed there as a reference to the translations requested. As a point of reference, Stephane sent to the list excerpts of National Legislation supporting the protections of the requested identifiers (https://mm.icann.org/pipermail/gnso-igo-ingo/2018-June/000159.html) As for the second issue category, I added the descriptive terms (“Organization”, “Association”, and “in”)(highlighted below in green) to the variant index. However, three remain (highlighted in red). The WG does not have a variant definition that would allow for these types of identifiers to be accepted in the future, should new National Societies be created. It’s easy to include/maintain these within this version of the definitive list as it is advanced to the Council. However, it lacks guidance to the IFRC, as well as ICANN Org and the GNSO, whenever new adds are invoked via the change process as outlined in the policy. Stephane mentioned on the last call about the need for flexibility for outliers of the variant index that may be requested. Therefore, I need the WG’s assistance to draft variant criteria. Please send suggestions to the list so that I can add it to the latest draft Initial Report. I will also add, that the process for new adds will flow from the GAC to the GNSO and ICANN Org for review prior to implementation. Is this sufficient for a review of any new adds and the opportunity to decline outliers that do not fit within the variant index? I’ve attached the latest version of the definitive list for your reference. I’ve also added the latest draft of the Initial Report. ACTION REQUIRED - Reconvened WG and Continued Consensus Call on Proposed Recommendations

Hi All Please find attached the proposed Initial Report of the Reconvened WG. This is the full report that includes required sections of Executive Summary, Background, and Deliberations of the WG along with the proposed recommendations that were sent to the WG last week in preparation for that meeting. Like prior versions of the draft recommendations, Thomas has maintained a preliminary consensus level of "full consensus" for the six recommendations. The task for members as a part of the continued consensus call is to announce any objections to the currently assigned consensus level by 19 June 2018 at 23:59 UTC. Absent any objections, the Initial report will be prepared for a 30-day public comment proceeding. Thomas is prepared to have this extended to the normal 40 days upon presentation to the GNSO Council of the Reconvened WG's status at ICANN62. In addition to submission of objections, if any, members are also instructed to provide any feedback or proposed edits to this draft report. Track changes are enabled. You can make your suggested edits in the Word doc and return back to me for import into the master document. Written suggestions are also welcome on the mailing list, and I can post the changes on your behalf in to the master. Lastly, we still have two outstanding items to resolves as it relates to the variant principles and the definitive list. National legislation on the protection of the designations/words "Red Cross" and "Red Crescent" designations

Dear Berry, dear Thomas, Dear all, (1) As agreed during last week's Working Group call, we have reviewed the legislation of the 21 countries/High Contracting Parties to the Geneva Conventions, which National Red Cross or Red Crescent Societies have requested the reservation of the words/designations "Red Cross" or "Red Crescent", and thus, as a variant of their usual or commonly used name. These include Afghanistan, Azerbaijan, Bosnia and Herzegovina, Brazil, Cambodia, China, Czech Republic, Finland, Kenya, Kyrgyzstan, Lithuania, Norway, Malaysia, The Netherlands, Palestine, Paraguay, Somalia, Sweden, Tanzania, Turkey and Ukraine. Once again, I would like to emphasize that all High Contracting Parties to the 1949 Geneva Conventions (196 in total) enjoy a formal obligation to protect the designations and names "Red Cross" and "Red Crescent" from all forms of unauthorized or improper use. […] In many jurisdictions, such protections apply directly in the domestic legal order without the need to adopt national implementing legislation. This is generally the case in States of the Civil Law tradition that are generaly qualified as "monist legal systems". For those States, the prohibitions on misuse of the names apply, in principle, directly in the national legal order. The situation is different in States of the Common Law tradition, which habitually require an international treaty norm to be translated into the domestic legal order through the adoption of domestic implementation legislation. These are generally referred to as "dualist legal systems". The supremacy of international law is generally considered to apply however in dualist legal orders and it is generally understood that a State cannot evoke municipal law as the reason for the non-fullfilment or for evading its international obligations. Without entering into the "monist" vs "dualist" debate, it should be noted that a majority of the 21 States on the list, would mostly qualify as Monist legal orders. (2) The attached list includes relevant extracts of national legislation in force in the above mentioned States confirming either or both i) the entitlement of the National Society in the country to make use of the designation or words "Red Cross" or "Red Crescent"; ii) the protections of the designations and names "Red Cross" and "Red Crescent" (by implication in the official national language or languages). We have not systematically included the translation of those articles in national languages, but these are available on our Website and national implementation database. In several cases, we were not able to find national legislation protecting the designations of the emblems, but only of the emblems themselves - this stands as an anomaly or as an omission by the national legislator. We would hence recommend however that the GNSO confirm the reservations of the designations/names "Red Cross" and "Red Crescent" for all 21 National Societies as one of their commonly used names - bearing in mind, at a minimum, the good faith duty for States to abide by their conventional obligations under the 1949 Geneva Conventions (even if national implementing legislation may be lacking). NB: For memory, we had provided in the past an extensive list (and extracts) of national laws from different States protecting the "Red Cross" and "Red Crescent" designations (including the United States, the UK, etc.).
