Update on appeal filed under Section 3.7 of the Working Group Guidelines

Dear all, For your information, the second call between George Kirikos (who filed the appeal under Section 3.7 of the GNSO Working Group Guidelines) and Working Group co-chairs Phil Corwin and Petter Rindforth took place on Thursday 18 January. Also on the call were Paul Keating and Paul Tattersfield (Working Group members who supported George’s appeal) and ICANN Ombudsman Herb Waye (in an observer capacity). The recording and transcript of the call can be found on the Working Group wiki space here: https://community.icann.org/x/iAS8B. On the call, agreement was reached to take the suggestion of requesting a facilitator’s assistance to the Working Group. Staff has completed our action item from the call, which was to advise the GNSO Council leadership and Working Group liaison to remove the planned agenda item concerning Phil’s and Petter’s December 2017 request from the Council’s 30 January meeting agenda. We confirm that the Council’s agenda has been amended accordingly. We believe Phil and Petter will follow up with everyone on the mailing list. Thanks and cheers Mary and Steve

George: The co-chairs have developed a proposed path forward for WG consideration and feedback that includes a facilitated session. We are waiting on staff review to make sure that it is procedurally and logistically sound. Hopefully that will go out in the next 24 hours to all WG members. Is the recently published INGO Identifier List subject to revisions? https://www.icann.org/sites/default/files/packages/reserved-names/ingo-iden… A cursory look shows names like gong karp mosaic rare restored witness Gong is an acronym for Gradani organizirano nadgledaju glasan Karp is an acronym for The Korean Association of Retired Persons Moisaic is a branding for More Mosaic NGO & Mosaic International NGO Including rare, restored & witness doesn't sit well with the principal of coexistence. Dear George, This note is to confirm that staff will be going ahead to schedule the call between you, Phil and Petter soon, although it will not be before next week. Next Thursday is certainly a possibility, so thank you for the suggestion. As highlighted previously, the call will be recorded and the ICANN Ombudsman invited to attend as an observer. Response from Working Group co-chairs to George Kirikos' written submission

Dear all, This email is being sent by staff on behalf of Phil and Petter, co-chairs of this Working Group. As part of the procedural agreement that was reached on the call between George, Phil and Petter last Thursday 11 January (also attended by Paul Keating, Paul Tattersfield and ICANN Ombudsman Herb Waye as an observer), a deadline of 1800 UTC today (Tuesday 16 January) was agreed for Phil and Petter to respond in writing to George’s written submission from Thursday. Staff confirms that a written response was sent to George before this deadline. A copy of that response is attached for your reference. A further call has been scheduled for this Thursday between the parties concerned. As was done with the call last week, this call will also be recorded and the recording and transcript posted to the Working Group wiki space. The Length of this PDP and Bringing Things To a Close (was Re: Invitation to a call with the IGO-INGO Curative Rights Working Group co-chairs)

Hi folks, (1) For those concerned about the length of this PDP, I'd like to point out that it was proposed (by me) that we had fulfilled our mandate as of December 2014 (that's not a typo), see: http://mm.icann.org/pipermail/gnso-igo-ingo-crp/2014-December/000221.html http://mm.icann.org/pipermail/gnso-igo-ingo-crp/2014-December/000220.html when the *existing* workaround (assignee, licensee, agent) was documented. What have we really accomplished since that date, other than fill in the details related to that primary finding? (2) Much energy recently has been spent dealing with the "quirk of process" regarding availability of court access to registrants who want judicial review on the merits of the dispute. Anything we do in that regard *must* be within the scope of our charter. If you've not read the Appeal PDF that I posted 2 days ago: http://mm.icann.org/pipermail/gnso-igo-ingo-crp/2018-January/001035.html take a look at point 19 which starts near the bottom of page 11 (you can skip the rest, if you'd like). It takes less than 1 minute to read that point (it's less than a page long). If that point is correct, then all of that quirk of process discussion for registrants is *not* even within the scope of our Charter, and is properly directed to the RPM PDP (which can deal with the impact on *registrants* in the same manner as the Yoyo.email UK Cause of Action issue, which has essentially the same root cause, the role reversal of plaintiff/defendants). I repeat, the work of this PDP ***as it relates to IGOs*** was completed in 2014! Do we have a consensus on this? If so, wrap things up. Food for Thought: DMCA procedure at YouTube contrast with UDRP/URS

Hi folks, There was an interesting article published today about a copyright dispute involving "white noise" videos on YouTube: https://gizmodo.com/man-s-youtube-video-of-white-noise-hit-with-five-copyri… which linked to the dispute procedure that YouTube follows: https://support.google.com/youtube/answer/2797454 Of particular interest for the IGO PDP is the section on "Counter Notification Basics": https://support.google.com/youtube/answer/2807684 where importantly it says: "After we process your counter notification by forwarding it to the claimant, the claimant has 10 business days to provide us with evidence that they have initiated a court action to keep the content down." and it's the content creator who posts the relevant jurisdiction: https://support.google.com/youtube/answer/6005919 ""I consent to the jurisdiction of the Federal District Court for the district in which my address is located, or if my address is outside of the United States, the judicial district in which YouTube is located, and will accept service of process from the claimant." If a comparable procedure were followed in a modified UDRP/URS procedure, this would completely solve the "quirk of process" we've been tackling, i.e. where the natural role of plaintiffs vs. defendants (had the UDRP/URS not existed) gets reversed if a registrant is forced to seek redress in the courts. Instead, the trademark holder (or the IGO, or the complainant in the UDRP/URS) would be filing the lawsuit in court. This also solves the closely related "cause of action" issue in the UK courts re: Yoyo.email, etc. (and thus I posted the same article for discussion on the RPM PDP mailing list), which arises due to the same role reversal of plaintiff/defendant. Of course, it might be best to handle all these interrelated issues simultaneously (and that's why there's been support behind Zak's proposal that this "quirk of process" issue be handled via the RPM PDP, instead of "piecemeal" for IGOs only).
