Dear WG members, Please find attached the updated documents (first presented as Sub Team 1¹s initial report a few weeks ago) from Sub Team 1. For Question 1, the Sub Team decided to propose some updated language for the relay escalation process (shown in ³redline² in the document). For Question 2, the Sub Team has updated its report/document following the WG¹s discussion, and its recommendations are highlighted in yellow in the attached document. Please note that while both documents have been circulated to the full Sub Team, not all Sub Team members have had the chance to comment on the latest language. Nevertheless, as the group¹s agreed intent was to update the original report documents following Sub Team review and WG discussion, and in view of the long holiday weekend in the United States, these documents are being circulated for your review now. Follow up from WG call

Dear all, As noted on the WG call yesterday, a few commenters on Section 1.3.3 of our Initial Report provided suggestions on additional research or work that can be done, possibly as part of implementation, on the topic. These are: Business Constituency: - "The BC believes that consultation with consumer protection authorities and privacy advocates with experience in these issues can be particularly helpful. The BC agrees that the task is not to define what constitutes commercial activity itself, but identify a subset of practices for which it is a reasonable to insist on transparency [rather than be able to use P/P services]." Intellectual Property Constituency: - "IPC would strongly support identifying [existing provider policies that ban some commercial usages] as a best practice for service providers at a minimum. IPC recommends that the WG flag for priority consideration during the implementation phase of this process the development of an illustrative framework mechanism for how complaints that a particular domain name is being used to carry out online financial transactions for commercial purposes should be submitted, processed, evaluated, and acted upon." In addition to the above comments that were provided as specific responses to the questions the WG posed under Section 1.3.3, other commenters also provided additional suggestions for other parts of our Initial Report. As mentioned previously, these are listed in Part 4 of the WG Public Comment Review Tool, although some have also been referred to specific Sub Teams in cases where the additional comment seemed directly relevant to an issue being considered by a particular Sub Team. Dear WG members, Please find attached updated documents from Sub Team 2 for the WG call today. For your convenience, here is a summary of the changes that were made to the original documents that were first presented to the WG on 4 August: (1) On Question 1 (Should registrants of domain names associated with commercial activities and which are used for online financial transactions be prohibited from using, or continuing to use, P/P Services? If so, why, and if not, why not?) - * All previous summaries have now been combined into a single document, but the only change to the substance of the previously-reported analysis of the specific comments numbered #1-87 in the Public Comment Review Tool was to add references to specific commenters where previously only a general summary of comments was reported (these references are marked in red in the consolidated document). * A new section has been added that summarizes the Sub Team¹s analysis and conclusions of the comments received via the Respect our Privacy website and the Save Domain Privacy petition. (2) On Question 2 (If you agree with this position, do you think it would be useful to adopt a definition of ³commercial² or ³transactional² to define those domains for which P/P service registrations should be disallowed? If so, what would the definition(s) be?) - * The format and contents of the previously-reported analysis from 4 August remain unchanged; however, specific references to commenters rather than a general summary have been added and are shown in red * The initial reported analysis/conclusion has not yet been updated; instead, the Sub Team¹s latest deliberations on this question will be presented orally to the WG on the Tuesday call for further WG discussion.
