Draft preliminary report
All, Attached please find the current draft preliminary report for your consideration. As discussed on the call, IAG members would have one week to propose any changes including the addition of minority statements. Please submit your edits no later than 23:59 UTC on 17 September 2015. ICANN will then seek comment on the document on 24 September 2015. Please note some of the larger changes in the document: first, I removed all references to "consensus." My colleagues in policy support remind me that consensus only applies after public comment is taken into account. Second, I added James's full proposal to a new Appendix 2. Finally, I cleaned up the formatting. Thank you again for your input and participation. Please let me know if you have any questions or concerns about the draft. Hi all sorry I missed the last call, I had an unchangeable conflict unfortunately. In substance it looks good to me, I would possibly argue that there was quite broad support for the legal opinion trigger rather than “some”, while recognising that that support did not reach consensus levels but I don’t want to get into wordsmithing as I recognise that we are asking the important question to the public of wether they support such a process anyway. Nits: There appears to be a duplication of the ToC on page 2. Other than that looks good to go to me. -James On 9 Sep 2015, at 22:30, Jamie Hedlund <jamie.hedlund@icann.org<mailto:jamie.hedlund@icann.org>> wrote: All, Attached please find the current draft preliminary report for your consideration. Dear Friends and Colleagues: While thanking other members of the IAG and the ICANN staff for their work during the past eight months, I have to express my disappointment and disagreement with the report as it stands. To present this to the GNSO and the ICANN Board would fail both to address the implementation issues that have already been encountered with the existing policy and to present a balanced account of the arguments that have been developed during the IAG's work. I attach my comments on the proposed initial report as we have received it. ICANN is currently being challenged to be accountable to the Community. For present purposes the relevant Community are all the Registrants of all the contracting parties whose personal data is not being protected in conformity with applicable local law consequent on ICANN's contractual conditions, as applied to Whois. May I ask, once again, that ICANN and the IAG reconsider the content of the report. I shall determine my definitive position in this respect, thereafter. Hello Jamie, I have no substantive edits for the draft report. My only suggestion is that the full text of the current procedure should be included as an appendix to the report. I was going to suggest the same treatment for the policy but I see that the full text of the output of the 2005 PDP appears in section 3 (under "Process Background"). You might consider changing the heading of that section 3 to "Current Policy and Process Background." Thanks for your ongoing work on this review. No, Jamie, there are a number of amendments and additions in the body of the text. Since your version is in .docx and my edits are in .odt, track changes does not seem to work. (I do not know how to do 'red-lining') I suggest that if you do a 'compare documents' you will get the changes. Otherwise: Search for 'N.B.' and for 'applicable'' and you will get most of them. Christopher, I will do my best to identify your changes. Regarding your Appendix 3 and other requests to provide a minority statement, it does not seem appropriate to include these in a document on which public comment is sought. Rather, minority statements are incorporated into final reports. At that point, public comments have been considered and the group has identified where there is consensus. It would be appropriate for minority views to be submitted as public comment. If, after taking into account the universe of public comments, these views do not generate consensus support, they would be ripe for attachment to the final report as minority statements. Please let me know if you have any questions or concerns with this approach. Thank you. Jamie, all: I have a few comments/concerns about the recent round of changes proposed by Christopher. I had understood that the point of providing comments to the report was to ensure that the report adequately reflects the discussions that have taken place. However, a number of these new edits appear to be an attempt to reopen/continue discussions, and/or to insert minority (or single-proponent) views. In particular: * Objections regarding the underlying WHOIS policy are not appropriate for this report - we discussed this on calls in the past, and there was no agreement that such a view to presented as part of the AIG's readout - indeed, the opposite conclusion was reached. These changes are in the summary and Section 1.2. As a minority views which falls outside the mandate of the AIG, efforts to reopen to address perceived deficiencies in the underlying policy should be directed through appropriate policy development channels. * The editing of "local/national laws" to read "applicable laws" does not reflect the focus of the discussions of the group - which was solely on the laws of national territories, so this should be retained. This is carried through in edits to the wording of the alternative trigger, which changes "government agency" to "governmental (regional or national) agency" - again, we did not discuss or reach agreement on conflicts between contractual compliance and "regional" bodies. Furthermore, the difference between a "government" agency and a "governmental" agency is unclear. * It is inappropriate to tinker with the alternative trigger, Written Legal Opinion trigger and Contracted Party Request proposals at this stage - again, the point of providing comments to the report was not to reopen or continue discussions, but to ensure that the report adequately reflects the discussions that have taken place. For example, with regard to the alternative trigger: o the deletion of "enforcing" with interpreting and implementing" is inaccurate and does not reflect the proposal which was the subject of preliminary agreement. o There was no agreement that an agency charged with "interpreting and implementing" data privacy laws would satisfy the trigger. o The same comments are carried through to question 3 in the public comment section, and section 6.1 - Preliminary Recommendations. * In the "Objective and Next Steps" section, the reference to the possible lack of competence and objectivity of the GNSO again seems to be inserting a view into the paper is neither appropriate for this report, which is a majority report - not a compendium of all the views expressed on the calls thus far. * At the end of the "Background" section, the addition of language claiming that despite the procedure never having been invoked, "many concerns have been expressed to the effect that the procedure is inconsistent with applicable laws" - this language is biased, not reflective of discussions in the group and presupposes that the procedure is inadequate - which we agreed on the first call was outside the terms of reference of the AIG's mandate, and should not therefore be reflected as an editorial comment on the background of this exercise. * Section 5.2, second bullet - it is precisely the point of this exercise for ICANN to define what data protection authority is an acceptable authority - and in any event, these were the terms of the AIG's engagement, and one cannot revise that now. My apologies for not getting my comments in by now. I have been preoccupied with the birth of my first grandchild, and while I am dedicated to ICANN this has not been top of mind. Can you tell me what the deadline is for receiving a statement from me, which might be an appendix or a stakeholder view or a minority report. Frankly my priority is to have it included, although I do have sympathy for Chris's position re voting and minority views. Kind regards, Stephanie Perrin On 2015-09-17 14:37, Jamie Hedlund wrote:

All, Thank you for the input. We need to figure out how to include other views without confusing the community as to which text has overall support from the IAG. One way to do this would be to include an appendix entitled “Other IAG member views” and then include each statement in the appendix. For example, Christopher’s Appendix 3 would be inserted in this "Other views” appendix as would Stephanie’s. Christopher’s edits to the body of the report that do not enjoy majority support or conflict with previously expressed views would not be included except to the extent that they appear in the “Other views” appendix. All,
Thank you for the input. Christopher,
I will do my best to identify your changes.

Christopher,
I will do my best to identify your changes.
Thank you.

Christopher,
I will do my best to identify your changes.
Thank you.
Best, Jamie

No, Jamie, there are a number of amendments and additions in the body of the text.
Since your version is in .docx and my edits are in .odt, track changes does not seem to work. (I do not know how to do 'red-lining')
I suggest that if you do a 'compare documents' you will get the changes.
Otherwise: Search for 'N.B.' and for 'applicable'' and you will get most of them.

Hi, For reference, the recently concluded CCWG PC had minority statements included. I think it may be good to include it in the report due for public comment so one could further determine level of support from the community on the respective minority statements. Cheers! Dear Jamie: Thankyou, Allen for attacking the word-processing! Very helpful. (NB I did not edit the table of contents, so there is some guff to delete up there.) 1. Regarding Appendix 3, that is not a minority report, it is a contribution to the report on the outcome of the discussions. From my point of view, Appendix 3 is more important than the rest of the draft preliminary report. I request that it be maintained. Not necessarily as an Appendix; it could form part of the Summary. 2. As long as ICANN has not proceeded to a vote of all members of the IAG, I do not recognise the current draft preliminary report as a 'majority' report. Indeed it would be rather odd if a majority, or even a minority, of ICANN stakeholders would endorse a draft report that conflicts with applicable law in a large number of countries. 3. I have a basic political objection to the use of the word 'national' in this context. ICANN staff and stakeholders are beholden to heave to the Articles of Incorporation which refer to 'applicable' law (precisely to this effect.) 4. I also have strong reservations about the repeated references to 'enforcement' which I have replaced by reference to e.g. 'competent authorities'. Indeed, to the best of my knowledge in most of Europe (30+ countries) the agencies responsible for the authoritative interpretation and implementation of data protection law are not the same as those responsible for enforcement. For the rest, I do not need to repeat myself. I shall return to these matters in Dublin as the occasion may arise.
