Niels: As usual, you bring up an important point. While ICANN activities may affect many human rights indirectly and directly, in trying to develop human rights guidance it makes sense to focus on specific human rights that are directly affected by ICANN activities. Some of these rights may be economic and social rights. But the problem is if we are going to demand ICANN take steps to protect respect and remedy its human rights impact, ICANN must be able to measure its effects upon human rights (as put forward in the Guiding Principles). But as of today, the metrics for human rights accountability are inadequate. We have plenty of metrics of government respect for human rights (as in political or civil rights). I call this supply side data on human rights. It is all based on the perception of experts (which makes me uncomfortable). In contrast, UNDP and other organizations have started multidimensional polling of people around the world, essentially asking them if they think they are "realizing" their rights. Should ICANN start with privacy and freedom of expression for the time being, or go a little wider and include some economic, social and cultural rights? Our draft paper has a bit of discussion on this point. It is reproduced below. I also thought it might be interesting to see the 31 indicators used by Ranking Digital Rights https://rankingdigitalrights.org/project-documents/2015-indicators/ - it is a set of more detailed indicators (around commitment, privacy, and freedom of expression) to be used to rank ICT companies and so these are more corporate footprint oriented rather than focusing on policy development per se. Best, Niels ______________ In the ICT sector, it is generally understood that the most prevalent human rights issues are freedom of expression and privacy. For example, Yahoo! states that the Yahoo Business & Human Rights Program was created to coordinate and lead its efforts to protect and promote free expression and privacy.[1] Likewise, the Ranking Digital Rights project plans to use 31 indicators focused on disclosure of policies and practices of ICT companies that affect users’ freedom of expression and privacy.[2] ARTICLE 19’s June 2015 paper on ICANN’s corporate responsibility to respect human rights examines freedom of expression and the right to privacy and data protection principles in detail in the context of ICANN’s operations. Others suggest that a broader list of human rights should be considered in the context of Internet governance. As mentioned already, the Council of Europe report suggested pluralism and cultural and linguistic diversity, as well as respect for special needs of vulnerable groups should be considered. Other sources suggest freedom of association, right to religion, and non-discrimination, as well as international human rights principles.[1] The Panel on Global Internet Cooperation and Governance Mechanisms, convened by the World Economic Forum and ICANN, suggests that human rights dimensions of Internet governance entails culture and linguistic diversity, security and stability and open unfragmented space, among others. Finally, the UNGPs suggest that all internationally recognised human rights should be considered in the impacts assessment process. This means as a minimum “those expressed in the International Bill of Human Rights and the principles concerning fundamental rights set out in the International Labour Organization’s Declaration on Fundamental Principles and Rights at Work” (Principle 12). Of course, it is possible that some of these rights are more relevant than others in the ICT context, and that only few may be triggered in connection with ICANN’s policy development process. The ICT Sector Guide mentions the rights to privacy and freedom of expression, government requests to ICT companies, and labor issues, as well as business relationships, particularly with suppliers. The decision on what rights should be addressed by ICANN will affect the scope and complexity of its human rights impacts assessment, and its reporting on matters related to its responsibility to respect human rights. Hello everyone, I am sharing with you a quick update of the call held by the subgroup on mapping, which happened last Wednesday, Sep 16th, so we can further discuss during our call today. Speak soon! Marília The subgroup is focused on developing a visual chart of ICANN's policies and operations that impact on human rights and on mapping opportunities for assessing HR impact on the policy development process (PDP). Participants: Rafik Dammak, Alan, Avri, Marília, Gangesh and Aarti - APC presented a proposal for visualization based on cartoons and on a campaign strategy for communication. - The goals of the mapping are two pronged: to enhance understanding and awareness among community members and to gather evidence for supporting discussions on human rights at work stream 2-Accountability, when we are supposed to further detail the high level HR commitment to be introduced in the bylaws. We discussed to have both mind mapping and cartoons. The former to initiate the work, while the latter can be the deliverable we can use for communication. The work will be collaboratively shared. Avri, Marilia and Rafik will support Alan on the work. - A strawman document assessing the opportunities to introduce HR issues at the GNSO policy development process is going to be shared by Marília and collaboratively discussed. - The next call will be scheduled by the subgroup and communicated to the list. Hello everyone, As you know after the CCWP meeting in Buenos Aires we have started two tracks of work, one of them focused on developing a visual chart of ICANN's policies and operations that impact on human rights and on mapping opportunities for assessing HR impact on the policy development process (PDP). This is a quick update of this work based on the call that we had today Participants: Rafik Dammak, Niels, Valeria Betancourt, Alan and Marília - We identified the relevant documents that will be used as a base to develop the map/chart. Dear all, I wanted to write a quick email to introduce myself and my colleague, Motoko Aizawa from the Institute for Human Rights and Business (IHRB). We are very pleased to be working with Niels on a follow up to Article 19's June 2015 paper on ICANN's corporate social responsibility to respect human rights. In 2013, IHRB developed the ICT Sector Guide on Implementing the UN Guiding Principles on Business and Human Rights for the European Commission, together with the organisation Shift. We intend to draw on this work as a starting point and explore ways it can be applied to help ICANN navigate its responsibility to respect human rights. We will be looking specifically at how ICANN can develop human rights impact assessments for policy development and approaches towards an ICANN CSR report, including a transparency report, as outlined in the UN Guiding Principles on Business and Human Rights. We are currently mapping existing examples of HRIA's, CSR reports and transparency reports that could be helpful for ICANN to apply to its policy development and operations. We aim to provide possible options and recommendations, which will assist with the development of human rights due diligence.
