Proposed Agenda - IDN EPDP Meeting #6 - 16 September 2021

Dear EPDP Team, Please find below the proposed agenda for our meeting on 16 September 2021 at 13:00 UTC. For agenda item 3, please see the attached draft project plan. A couple of notes about the project plan, though we will discuss this item in greater detail during the call: The section that is most relevant to this group at this stage of its work is the “Group Deliberations” section where you will see Topics A-G. The “Current Duration” captured there should be reflective of the survey Edmon conducted with all of you on expected level of effort for each of the topics. The duration is based on business days and assumes this group will meet once a week (e.g., 50 days is equivalent to 10 weeks/10 meetings). Each of the Topics, A-G, is intended to follow a repeatable process, so they will all look identical in terms of structure/work process. You will see that under Topic A, all of the charter questions are captured under “Deliberate policy issues.” The same has been done for all of the other topics, but we have only expanded Topic A for illustrative purposes, in order to keep the attachment to a reasonable length. This work plan, once confirmed by this EPDP team, will be provided to the GNSO Council and serve as a commitment by this team; as such, the work plan should represent an achievable timeline, not an aspirational one. If there is interest in seeing the entire project plan in its entirety, we can provide the full length document (potentially as an Excel sheet, as an alternative format choice). Best regards, Emily, Steve and Marika Action item #1: RySG and ccNSO members on the IDN EPDP to check with their Stakeholder Group to see if there are any concerns about using the RZ-LGR for existing gTLDs (charter questions a1 and a2). Action item #2: Team to review Data and Metrics requirements in the charter and indicate whether any of the items identified are NOT necessary and/or which items are missing. Action item #3: In advance of the next meeting, in preparation for further review of A3, please review the SubPro Limited Challenge / Appeal Mechanism as well as the appealing via the integration panel in the context of the RZ-LGR. Action item #4: For those that have not done so yet, please review all the introductory materials and sign off via the google sheet (see https://docs.google.com/forms/d/e/1FAIpQLSfbXhd2L4oAb_Cn22FnjkSoDSj0K-HNcij…) Notes – IDNs EPDP Call – 9 September 2021 Welcome & Chair Updates 1. Workplan is under development, informed by the survey taken during the last meetings. Leadership and staff support team expect to be able to circulate proposed work plan before the next meeting and will set aside time next week for review and discussion. 2. EoI for Chair is still open until September 15. For those interested, please make sure to submit your application. 3. As the team goes through the topics there may be need to collect data and metrics, to inform team’s deliberations/decisions. This could result in having to park certain items until that data is obtained. Team may need to review / discuss what further data may be necessary. ICANN org has agreed to collect any necessary data. 4. Edmon has spoken to ICANN legal and BGC chair who did not express any concern about his chairing this group until taking up his position. Furthermore, if the group is interested, Edmon could be invited back as a Board liaison to this EPDP team. EPDP Team to indicate if there is support and/or concerns about this option. Begin deliberations on Topic A: Consistent definition and technical utilization of RZ-LGR * See charter * First question is whether EPDP Team is willing to accept RZ-LGR as the authoritative source to ensure a consistent approach for reviewing current and future TLDs. For existing delegated gTLD labels, does the Team recommend using the RZ-LGR as the sole source to calculate the variant labels and disposition values? This may require some research to determine whether this would cause any potential issues for existing gTLDs. * Maybe the question should be the other way around – is there any reason NOT to use it? * See also the mapping document – SubPro and the TSG recommendations are consistent in exclusively using the RZ-LGR. * Important to consult technical teams of registries and back-end providers. Suggestion to request the opinion of registries (both gTLD and ccTLD) as previous studies were conducted by technical experts, not registries. * Note that early request for input will take place, which will focus on general questions. Need to consider whether separate targeted outreach is needed, also factoring in that registries are represented in that effort. Those members may be able to bring back any relevant perspectives or input to the group as well. * Is it worth for the staff support team to undertake a bit of data gathering to see which, if any, gTLDs would be affected? * May need to continue with a2 until data has been gathered to respond to question a1? May need further info on potential inconsistencies as the questions in the charter question are hypothetical at the moment? * Probably three data points that would need to be gathered: 1) Are existing top-level domains valid based on the RZ-LGR? 2) Are variants that are identified determined via RZ-LGR and if not how are they different, 3) When variants are allocated to the rootzone LGR, were the self-identified variant labels taken into account? * What is the process for requesting staff to gather this data? Note that the charter already identified data that might be helpful, but also noted that if additional data was needed, the group should request this. There is a form that would need to be completed to request ICANN org to gather this data, outlining what data is needed and why. If an external vendor is required, budget approval may be involved. If the data needed was already identified in the charter, Team can just confirm the data would be helpful and staff support team would action it. * Would it be helpful to identify the overall data needs, or better / easier to do this as the group goes through the charter questions? Might be better to batch them, but helpful for members and participants to go through the charter and identify any required data in advance. * Reminder, homework assignment was for members and participants to identify whether anything was omitted in the Data and Metrics requirements in the charter. Team may want to consider looking at what is in there and sign off on it so that the staff support team can go ahead with collecting the data? Preferred approach is to keep on going through the charter so that the context is clear and specific data needed can be identified and linked to specific questions, but a batch approach may be used so that the data gathering process can already start and doesn’t have to wait until all charter questions have been reviewed. * What if there are inconsistencies with existing gTLDs? Either they have to fix it or team decides that use of RZ-LGR is not required in certain circumstances. May need to look at language on self-identified variants in the applicant guidebook (see (https://newgtlds.icann.org/en/applicants/agb) (pg 1-36). * May need to consider what harm would be caused by a potential inconsistencies. * A3 – Should the appeal process that was developed by SubPro be expanded to existing TLDs (Limited Challenge / Appeal Mechanism – see chart included in the SubPro Final Report on page 329)? On what grounds would the challenge be accepted or would the applicant succeed. Reminder for Team to review the SubPro recommendations on this topic (see also mapping document). Note also process build into RZ-LGR (see https://www.icann.org/en/system/files/files/lgr-procedure-20mar13-en.pdf) Team to consider if, when and how to call upon these existing mechanisms and how these would interact.

As noted on the call, as a standard step in the GNSO EPDP/PDP staff will draft a letter to SO/AC/SG/Cs asking for early input on the charter questions. The WG will have an opportunity to review the draft and provide feedback before this is sent to SO/AC/SG/Cs. Based on conversations to date, it appears that the charter questions are fit for purpose to include as written with the outreach letter. For now, the goal is to keep the work going without interruption. * Data & metrics – Everyone is encouraged to review the data and metrics part of the charter on page 19 and think about whether other data and metrics would be useful for the group to consider in deliberating on charter questions. This will be discussed further as the group gets into the substantive deliberations on the specific topics. 1. Begin initial review of charter questions (continued) – Topics C-G * Question regarding the exercise: Both Topics A & B came back with a estimation of a “medium” level or effort. Is this accurate? * This exercise is just to get an initial sense of the expected workload for the purposes of building an initial draft work plan for the group. The work plan will be delivered to the GNSO Council so that the Council can monitor the progress of the group, manage the process, and troubleshoot if there are issues that need to be resolved. The estimates do not need to be exact. * Comment: The working group should aim to create a work plan that is as accurate as possible with the available information. * If the working group needs to change more time than originally expected in the work plan, it will deliver a “project change request” to the GNSO Council. * Topic C: “Same entity” and the second-level: estimated level of effort: High = 10+ call hours: (4/20): 20%; Medium = 5 to 10 call hours (12/20): 60%; Low = < 5 call hours: (4/20): 20% * Comment: There may be cases where two different legal entities have rights to variants but suddenly only one survives, and two strings should belong to one of the entities. There may be legal implications that have not yet been investigated and will require some time from this group. * Comment: There are two tracks: One where you are changing the definition of an existing IDN implementation in a TLD and the names already exist and you make changes to the variant mapping based on the sources you choose. That is problematic when you have to decide one or the other based on rights. The second is you introduce IDNs to an existing namespace and no names are registered in that IDN, so that is determined before all of that happens. * We might want data points on what existing registrations look like – how many would have a conflict if RGZ-LGRs are applied over them. * Topic D: Adjustments in registry agreement, registry service, registry transition process, and other processes/procedures related to the domain name lifecycle: estimated level of effort: High = 10+ call hours: (12/19): 63%; Medium = 5 to 10 call hours (4/19): 21%; Low = < 5 call hours: (3/19): 16% * Topics D & E are the administrative processes that are required. For D there are 8 questions covering a wide range of issues. Looking at the mapping document, a lot of it has been covered to some extent. * For this topic, we are not talking about writing the legal language in the Registry Agreement. This subject is just about the policies for what needs to change in these things. * We are only focused on the elements that need to change with respect to specific subjects that this EPDP covers. * Registry Transition Process is a potential for IDN conflicts if the RST phase does not accept the incumbent RSP's implementation of a language/script and requires the use of a new LGR (better defined but can contain conflicts such as new variant mapping, more or less code points and new or different context rules). * We are going to change some basic elements and need to consider all the dependencies on a procedural level. This may take time. * Clarification: The focus on this exercise is to estimate the time required for the Working Group to consider topics for policy recommendations, not necessarily timelines for each TLD process and specific Registry Agreements. * Topic E: Adjustments to objection process, string similarity review, string contention resolution, reserved strings, and other policies and procedures: High = 10+ call hours: (5/17): 29%; Medium = 5 to 10 call hours (9/17): 53%; Low = < 5 call hours: (3/17): 18% * Many of these topics were covered in SubPro. This group will be focused on considering what the SubPro WG has already looked into. We are not looking to second guess the results of that process. * There will be an IRT for SubPro. This group should coordinate with the IRT and review what it comes up with to make sure there are no holes. It is primarily an oversight function, and therefore may require less effort than some of the other topics. * On the other hand, this topic covers all procedures related to new gTLDs and will change the process for reviewing applications, so it may take a lot of time. * Topic F: Adjustments in registration dispute resolution procedures and trademark protection mechanisms: High = 10+ call hours: (2/17): 12%; Medium = 5 to 10 call hours (10/17): 59%; Low = < 5 call hours: (5/17): 29% * Comment: This is a complicated issue. It is possible for an intellectual property owner to have rights in the registered name but not variants or vice versa. Finding out legal implications and whether transfers can be ordered is difficult. This might take time even though there are only two questions. * This group might need to ask for help on this topic from other groups to inform final discussion. This is also a topic where additional data and metrics may be needed. * Putting this task of developing the work plan in perspective, we have likely overestimated or underestimated on some of these topics. It will likely even out. In a worst-case scenario, we have the option to go to the Council and adjust the timeline. * If we want to take a conservative approach, we can estimate on the high end of the ranges specified in the polls. * Topic G: Process to update the IDN Implementation Guidelines: High = 10+ call hours: (6/20): 30%; Medium = 5 to 10 call hours (10/20): 50%; Low = < 5 call hours: (4/20): 20% * Some uncertainty on this topic. * More might be brought our way under this topic. IDN Implementation Guidelines 4.0 have not been adopted. The Working Group may need to consider the path forward. * Comment: It is surprising that this topic came back as medium and so did Topic F. The representation of different expertise is not balanced on the call. The leadership team should take this into account as it builds the work plan. 1. Early outreach to SO/AC/SG/Cs * This is a standard step in the EPDP/PDP. The working group will ask SO/AC/SG/Cs for early input on the topics included in the charter. * This step is somewhat of a duplication of effort, since the groups have an opportunity to provide input through their representatives in the EPDP. * Based on conversations to date, it appears that the charter questions are fit for purpose for early outreach and staff can go ahead and draft a cover letter asking for early input on the charter questions (with charter questions appended). The WG will have an opportunity to review the draft document before it is sent. * If anyone has concerns with this approach, they should reply on list. 1. Begin deliberations on Topic A: Consistent definition and technical utilization of RZ-LGR * This item will be started on the next call. 1.
