Development of the Transition Implementation Plan - Role of the IRT

Dear Colleagues, In our meeting on Tuesday 4 August, we discussed the collaboration between IRT Members, Experts from Affected Parties and ICANN Staff on the development of the implementation details of the transition from thin to thick. In particular, we suggested that: * We keep with our earlier decision (late 2014) to merge the "Group of Experts from Affected Parties to work out implementation details of the transition" into the IRT Membership * ICANN staff and qualified experts from Registries and Registrars meet on a weekly basis to work out implementation details, possibly weekly, until an Draft implementation Plan can be presented to the community It is our understanding that some of you would like to contribute to this specific high intensity effort, while others would prefer to stick to the reviewer role of an IRT. As a consequence, going forward, we propose that two types of IRT meetings be organized with a view to allow each member of the IRT to focus his/her attention appropriately: * ³Consultation-focused² IRT meetings: dedicated to working out implementation details that will aid in drafting the transition plan. * ³Review-focused² or ³Regular" IRT meetings: to discuss status of the draft Overall Policy Implementation Plan (transition from thin to thick + consistent labeling and display), including any issues that may have emerged Unless there is strong opposition to this plan, we will soon be reaching out to the IRT with a proposed schedule of Consultation-focused IRT meetings. Dear IRT Members, On June 8, ICANN released for your consideration its ³Review of Law Applicable to the Transition of Data from a Thin to Thick Whois Model² memorandum for implementation of Recommendation #3 of the Thick Whois PDP Final Report (memo available here: https://community.icann.org/display/TWCPI/Documentation) On June 24, in our Working Session during the ICANN 53 meeting in Buenos Aires, we presented and discussed the analysis proposed in the memorandum (slides and recording available here: https://community.icann.org/display/TWCPI/IRT+Meetings) In order for ICANN staff to prepare the next steps of our Policy Implementation work, we would like to request that you share any further comments you may have on the Legal Review Memo by Friday 24 July at the latest (close of business in your time zone). This would allow us to organize the next IRT meeting accordingly, with a view to either discuss the memo further and/or to move on to working out implementation details with the group of experts from affected parties, taking into account the findings of the Legal Review Memo. Legal Review Memo for your consideration

Dear Colleagues, As indicated in our last status update, we have been working to finalize the legal review called for by Recommendation #3 of the Thick Whois PDP Final Report (http://gnso.icann.org/en/issues/whois/thick-final-21oct13-en.pdf) Today, we provide the attached "Review of Law Applicable to the Transition of Data from a Thin to Thick Whois Model² Memorandum. Although we were not able to meet the 1 June 2015 deadline for publication prior the ICANN 53 meeting (as per the Document Publication Operational Policy https://archive.icann.org/en/participate/draft-document-publication-operatio nal-policy-en.pdf), we are providing the Memorandum now in hopes of taking the opportunity of our working session in Buenos Aires on Wednesday 24 June to discuss it (http://buenosaires53.icann.org/en/schedule/wed-thick-whois-irt) If you require more than the 11 working days available before our next meeting to review the document, please let us know. We would work to schedule an additional meeting later. In any event, we will soon circulate an agenda and remote participation details for the 24 June meeting. Thick Whois Policy Implementation Status

Dear Colleagues, As you may know, since our last meeting at ICANN 52, two notable developments relevant for the Thick Whois Implementation have occurred: * the Registration Data Access Protocol (RDAP) RFCs were published at IETF on 25 March (http://datatracker.ietf.org/wg/weirds/documents/) * the Whois Clarification Advisory was published on 27 April (https://www.icann.org/resources/pages/registry-agreement-raa-rdds-2015-04-2 7-en) We have been actively considering how best to leverage these events in the interest of the Thick Whois Policy Implementation: * With respect to the implementation of the Consistent Labeling & Display part of the policy, we are seeking to focus synchronization with the roll-out of RDAP only, instead of both Whois Clarification Advisory and RDAP. We plan to introduce a revised implementation plan proposal during our next meeting. * Regarding the transition from thin to thick of .COM, .NET and .JOBS, we are finalizing the legal review memo and aim to engage shortly to discuss implementation details. We intend to organize a meeting with the IRT to discuss our proposals and next steps at the very latest during our next ICANN meeting in Buenos Aires (http://buenosaires53.icann.org <http://buenosaires53.icann.org/> ). In the meantime, we are considering the possibility to hold a preparatory conference call in early June (to be confirmed). Thank you in advance for your attention and your patience.
