Notice of Expiration of Rejection Action Periods for Board Approval of (1) FY22 Operating Plan and Budget and (2) FY22-26 Five Year Operating and Financial Plan

Dear Empowered Community Administration representatives, I am writing to confirm that, in accordance with the timelines and procedures set out in Annex D of the ICANN Bylaws, the 21-day Rejection Action Petition Periods pertaining to the (1) FY22 Operating Plan and Budget and (2) FY22-26 Five Year Operating and Financial Plan that were approved by the ICANN Board expired at 06:59 UTC. No Rejection Action Petition Notices (as defined in Annex D, Section 2.2(c)(i)) were received by the Empowered Community Administration within the prescribed timeframe. Therefore, under Annex D, Section 2.2(c)(ii), the Rejection Processes for the (1) FY22 Operating Plan and Budget and (2) FY22-26 Five Year Operating and Financial Plan are thus automatically terminated. The next step is for the Empowered Community Administration to deliver to the ICANN Secretary two notices certifying that the Rejection Processes have been terminated with respect to these particular Rejection Actions. ICANN will then post the Rejection Process Termination Notices on the ICANN website. As discussed on the SOAC Chairs’ call earlier this week, we have prepared Rejection Process Termination Notices for your review as requested (see attached). We note that the Bylaws (Annex D) require that the Empowered Community Administration’s notices be within twenty-four (24) hours of the expiration of the Rejection Action Petition Period. As such, staff will be happy to forward the notices on your behalf unless you have comments or concerns. Our thinking was to reference the fuller breadth of the Bylaws Article, to include term duration and limits etc., as well as to allow for the same standard letter to be used (as much as possible) for all the Director designations (whether appointed by the NomCom or a SO or AC.) Dear Empowered Community Administration representatives, Under the ICANN Bylaws, delivery of the Secretary’s Notice on 21 May: (1) requires Decisional Participants to “promptly inform their constituents” of the delivery of such notice; and (2) triggers the 21-day Rejection Action Petition Period, during which an individual may submit a petition to any Decisional Participant, seeking to reject the Board action. These 21-day periods for (1) FY22 Operating Plan and Budget and (2) FY22-26 Five Year Operating and Financial Plan both commenced on 21 May 2021 and will end at 23:59 PDT on 11 June 2021, or 06:59 UTC on 12 June 2021.
