Dear CSG colleagues, following a discussion within the ISP constituency on Whois Access I would appreciate your comments on a related draft motion to be brought before the GNSO council (see attached). Background is that I've grounded a council consent agenda item some weeks ago which was intended not to address furthermore Whois access as recommended by the RAP WG. The draft motion is to be seen as a proposal on how to cover this item in future. The RAA PDP seems to be the right environent for this since the issue of access is certainly one of the issues addressed in the RAA Final Issue Report. As we're expecting opposition from the CPH as well as the NCSG - based on different rationales - ideas regarding socializing and timing are also welcome. WG: SSR Review Team - Public comment period

I think we should discuss this at our next call on 24 April; all war encouraged to provide comments to the report. In addition we should discuss the topic "WhoIs Access". This is still pending at council according to the minutes of the meeting before San José: "Wolf-Ulrich Knoben requested that the proposal to end the work on Whois access should be removed from the consent agenda and should remain an item on the main GNSO agenda. He suggested that constituency/stakeholder members work with Staff to identify a path forward and that the topic be further discussed at the Costa Rica meetings. " The question is related to the WhoIs Service Requirements - Survey Working Group who took a decision not yet to investigate the WhoIs access topic. It would be in our interest if we could come up with options about how the council should deal with the matter in future. Ideas are welcome. Maybe together with providing some ideas Liz should be asked about staff's view. As I indicated today, this document reflects the state of negotiations as of 1 March, 2012, but has not been updated to reflect developments since Costa Rica. Preparation of any such update would involve additional efforts on the part of the ICANN & Registrar negotiation teams to agree upon the contents of the update, and would inevitably divert attention from the negotiations themselves. Motion to delay the 'thick' Whois Policy Development Process Whereas the GNSO Council requested an Issue Report on 'thick' Whois at its meeting on 22 September 2011 (see http://gnso.icann.org/resolutions/#201109) Whereas a Preliminary Issue Report on 'thick' Whois was prepared by staff and posted on 21 November 2011 for public comment (see http://www.icann.org/en/announcements/announcement-2-21nov11-en.htm) Whereas a Final Issue Report on 'thick' Whois was published on 2 February 2012 (see http://gnso.icann.org/issues/whois/final-report-thick-whois-02feb12-en.pdf) Whereas the Final Issue Report recommends that the GNSO Council proceed with a Policy Development Process limited to consideration of the issues discussed in this report, and the General Counsel of ICANN has indicated the topic is properly within the scope of the ICANN policy process and within the scope of the GNSO; Whereas the GNSO Council initiated a Policy Development Process at its meeting of 14 March 2012 (see http://gnso.icann.org/resolutions/#20120314-1) Whereas at its wrap up session on 15 March, taking into account the current workload of the GNSO community, the GNSO Council voiced support for a delay in the start of the PDP until both ICANN staff and GNSO resources are available to deal with this. THEREFORE BE IT: Resolved, the next step (creating a drafting team to develop a charter) of the 'thick' Whois PDP will be delayed until the first GNSO Council meeting after 30 November 2012.
