Dear all, I am writing you in my capacity as person designated by the ccNSO Council to chair the Board Seat 12 nomination process as Katrina Sataki was one of the nominated candidates. As required under Section 7.2 and Section 10.3 (i) of the ICANN Bylaws, please accept this letter as formal notification from the Country Code Names Supporting Organisation Council (ccNSO Council) that the ccNSO Council has nominated for designation by the Empowered Community (EC), Katrina Sataki (Latvia, EU region) to serve an initial Seat 12 term on the ICANN Board of Directors. On behalf of the ccNSO Council, I ask that the EC designates Katrina Sataki as Director to fill Seat 12 on the ICANN Board for a three (3) years term beginning at the conclusion of the Annual General Meeting 2021.. Dear Empowered Community Administration representatives, I am writing to confirm that, in accordance with the timelines and procedures set out in Annex D of the ICANN Bylaws, the 21-day Rejection Action Petition Periods pertaining to the (1) FY21 Operating Plan and Budget and (2) FY21-25 Five Year Operating and Financial Plan that were approved by the ICANN Board have expired. Greetings Peg, Am I correct in assuming on behalf of the ECA and the Empowered Community SO/ACs that pursuant to the language in Annex D, Article 2.2(a) of the Bylaws, the 21 day Rejection Action Board notification date is 15 May 2020, and thus terminates 21 days later at 23:59 PDT on 5 June 2020 at 23:59 PDT based on the correspondence from the ICANN Corporate Secretary that you have forwarded to the ECA and SO/AC leadership within the hour? I raise this question as the date of the Corporate Secretary’s formal correspondence to the Empowered Community and the SO/AC leadership with regards to the Board’s adoption of the FY21 Operating Plan and Budget is today, 14 May 2020, my and your local time. I note that the delivery of the Corporate Secretary’s notice, as required under Section 22.4(a)(v) of the Bylaws, was delivered to the SO/AC leadership on 23:36 UTC on 14 May 2020. Recognizing the global reach of ICANN, I further bring to your attention that the delivery of the Corporate Secretary’s formal correspondence in this matter did not reach SO/AC leadership based in either Europe or Asia until 15 May 2020. So my question to you, on behalf of my implicit proxy on behalf of the Empowered Community Administration, is when does ICANN org consider the clock to have started for the 21 day Rejection Action Petition Period specified in Annex D, Section 2.2(b) with regards to the “Notice of Board Approval of FY21 Operating Plan and Budget” submitted by the Corporate Secretary dated 14 May 2020? Please advise soonest.
