Misleading Slides (was Re: URS Practitioners Survey Results and Presentation for ICANN62)

Hi folks, In preparation for today's call, I reviewed the slides, and compared them with the "raw" results in the 2nd PDF. It's important to note that on the agenda page on the wiki (https://62.schedule.icann.org/meetings/699479) only the summary presentation is linked to, and not the raw results (which we received by email). The presentation is highly misleading (by omission), in particular for page 6, where it purports to neutrally summarize all the respondents to the survey. But, the actual survey question it's reporting was (from page 1 of the raw results) "In how many URS proceedings have you been involved as Complainant or its representative?" The related question (from page 2) "2. In how many URS proceedings have you been involved as Respondent or its representative?" was very clear that there was not a single response from practitioners who've represented Respondents." By omitting the actual questions from the survey, the presentation makes it appear (to someone who has not done a deep dive into the raw results) that this was a balanced survey of practitioners who represent both complainants and respondents to URS disputes. That could not be further from the truth, and so the results must be taken with a grain of salt. This was the equivalent of doing a survey of criminal attorneys, with all the responses from criminal prosecutors and without any responses from criminal defense lawyers. Furthermore, if we go to the raw questions, we had explicitly contemplated receiving input from those who'd only been involved in 1 or 2 cases (i.e. the "answer choices" for the first two questions were: 1 to 2, 3 to 5, 5 to 10, 10 or more, none). Yet, somehow in the implementation of the survey, it only "selected URS practitioners who had handled 5 cases or more" (page 5 of the presentation). This further skewed the results, and was inconsistent with the intent of the survey's questions. By the way, the survey claims to have "34 practitioners" on the "final list", but page 5 actually lists 36 in the right hand column. There's no explanation for that discrepancy. In summary, this appears to be yet another unrepresentative small sample, that is ultimately destined for the dust bin (along with the previously discredited INTA study). ICANN staff should add the PDF with the raw results to the agenda page, lest anyone be misled by this presentation. Notes: 1. Review Agenda/Statements of Interest: None. 2. Status of TMCH Data Sub Team Work -- The Sub Team is reviewing the draft questions developed by the AG. Now progressed through registry, registrar, TM/brand owner, and registrant surveys. On the upcoming call the Sub Team will be reviewing the potential registrant survey. -- AG will provide updated draft survey questions for the Sub Team to review. After beta testing, AG will launch the surveys and we expect to receive the responses by the Aug timeframe. 3. Status of URS Practitioner, Provider, and Documents Sub Team Work URS Practitioner Sub Team Update: -- Results are in. Survey went to 38 practitioners and there were 14 responses from practitioners handling more than 10 cases each. -- Sub Team has reviewed the results. -- Sub Team will send the results and presentation to the WG. -- Sub Team will provide a presentation to the WG in ICANN62. -- Co-Chairs are keen to see what suggestions come out of the survey results. URS Providers Sub Team Update: -- Majority of the survey results are in. FORUM needs to review some cases. -- Hoping to have all results in before we meet with the providers in Panama. -- Results so far are useful. -- Begin to discuss policy options in July/August. -- All providers can join in Panama. URS Documents Sub Team Update: -- Contingencies with Providers and Practitioners surveys. -- Places where that Sub Team identified direction from the full WG or from Rebecca's research. -- Looking at our work so far it has been trying to understand what documents and data could be collected. -- Next step is to see if there are any trends to look into. -- When the Documents Sub Team met with the plenary WG in April we provided a summary of activities including the 14 cases where an appeal was filed and findings from that. -- Met last week and reviewed additional data that relate to the different topics in our matrix. -- Sub Team needs to regroup to understand the details of that data. -- URS case information from providers, coding spreadsheet from Rebecca, queries of WHOIS of those domains: first area that we reviewed was a domain disposition snapshot; second, taking a quick look at where there were multiple cases filed against the same domain nam; third, response analysis (Rebecca's coding spreadsheet) -- 14 days or 6-month period; fourth, analysis of those cases where the claim was denied -- were able to subdivide those 59 cases between where a response was filed and no response was filed but the claim was still denied. -- Still more work to do and re-review our inventory and look at the questions and what was addressed or not. -- Package a deliverable for the full WG. -- Provide more detail in Panama, but very much preliminary. -- Hope to report back to the full WG by the end of July. WIPO retaliation -- danger for RPM PDP participants?

Hi folks, I draw folks' attention to the page at: http://www.wipo.int/amc/en/domains/challenged/ which had been a topic of discussion on this mailing list before. I was shocked to see that it has recently been edited to remove one additional case, namely the court case involving my own company (Leap of Faith Financial Services Inc.), defending the Pupa.com domain name. Attached are 2 PDFs, one generated today (June 7, 2018) and one generated a month ago (May 4, 2018). The Pupa.com case is the 2nd case in the May 4, 2018 PDF, but has been erased from the version from today. No other changes were made. I perceive this as direct retaliation by WIPO for my lack of support of Brian Beckham's candidacy for co-chair in this PDP. There can be no other reasonable explanation, given the timing of this removal. This retaliation by WIPO also says to members of this PDP that if they disagree with a position taken by WIPO, that there could be consequences, just as has happened here to my company. That is very dangerous. This petty action by WIPO reinforces my previously-stated opposition to Brian Beckham's candidacy as co-chair of this PDP, where I raised the issue of non-neutrality. It calls into question the entire legitimacy of future policy choices by this working group, if members of this PDP perceive that they could face retaliation too. Not really Volker. If you go down that path then you will have literally hundreds of cases where parties defaulted entered into settlements etc all of which is not useful in a jurisprudencial way. Again the idea of the WIPO list is to have a list of cases that are meaningful -- i.e. those that were litigated by participating parties to a decision. Those cases are useful to practitioners, complainants and respondents as they provide insights as to how courts view and deal with particular types of domain name cases. Such decisions help parties determine whether or not they should pursue a matter in the first place as it provides guideposts as to what the law might be on a number of specific issues (e.g. what is a fair use, how far does free speech extend over domain names, what is bad faith, what is reverse domain name hijacking, etc.). If you really feel like every case ever filed over UDRP decisions or domain names, regardless of the outcome, should be on a list somewhere, then you should have ICANN create such a list and have it on its website. See next step. Step 2 - There are two ways to import your schedule into Outlook: once you’ve added all your chosen meetings to “My Schedule” go to Export. 1. Possible Technical Bug in URS implementations

Hi folks, I believe I've uncovered a technical bug in the URS implementation. Does anyone here know the best method to report it? It might require a policy change (due to the ambiguity of the policy's requirements on providers) or updated documentation, as well as implementation changes by providers, in order to fix it. RPM Working Group June Schedule and Work Plan

Dear RPM Working Group members, On behalf of the RPM Working Group (WG) Co-Chairs, here is a preview of the work anticipated for June relating to the various data collection exercises with additional details in the attached table: Wednesday, 06 June: No Full Working Group meeting. Instead, the TMCH Data Sub Team will work with the Analysis Group on final questions for registries, registrars, trademark owners, registrants, and potential registrants. A second meeting is scheduled on 07 June if needed. Analysis Group will preview the proposed final survey questions to the full WG by 13 June via mailing list After pre-testing, Analysis Group launches surveys around 22 June on a rolling basis Wednesday, 13 June: No Full Working Group meeting. Two URS Data Sub Teams will meet to review the research of Prof. Tushnet: Providers Sub Team – 12:00 UTC Documents Sub Team – 17:00 UTC Both will consider how best to use the relevant URS data and will aim to present their recommendations to full WG on 20 June. Practitioners Sub Team will receive the Practitioners survey results by 11 June – Staff will assist in setting up a time to meet, review and organize them 12 or 14 June. Providers Sub Team should begin to review the Providers survey results on 13 June. Wednesday, 20 June: Full Working Group meeting: Presentations by Providers and Documents Sub Teams about their recommendations for the use of relevant URS data from Prof. Tushnet’s compilation. I wanted to follow up on this statement, which I’ve trimmed from Prof. Tushnet’s email, to reduce the message length. >>> My own takeaway from the research is that the URS is generally functioning well for easy cases, but there is a serious issue of lack of reasoning and thus lack of information in a significant subset of cases. Following up on a question asked last time, Alex separated the cases by provider and found that examiners only copied and pasted in ADR Forum. All ADNDRC and MFSD cases had at least some explanation provided. I hope that our STI/IRT members and maybe even staff, can pull more from their collective brains on this, but I here is my recollection of how the reasoning question went down (full disclosure: I was with Forum at the time and substantially wrote their RFI to be a URS provider). --STI created a “tapestry” of RPMs and created a “light/fast” URS that was for such straight-forward cases that the complaint and decision should just be tick-boxes. --community outrage at exclusive use of tick boxes so, --IRT said it must NOT be tick box-only. The Examiner must have a chance to make remarks. There was no community requirement that there be reasoning, merely the option. --Indeed, in light of the anticipated low fees, it was anticipated that the Examiners would do a quick review and if the complainant didn’t quickly win on its face, they should have the option to go back and file a UDRP for a deeper look. I request correction if I’m wrong, but, if I’m right, then we need to back up and determine: 1. What’s the harm in the level of reasoning in URS decisions currently (recall this is always our threshold question – what is broken)? 2. Would enforcing more “reasoning” solve the problem? 3. Is the WG prepared to re-assess the fees charged to parties if a more UDRP-level of work will be required? I have no opinion on the answers to the questions, but just wanted to remind everyone that a pretty bright, diverse group actually spent a lot of time debating tick-box vs reasoning and ended up deciding reasoning should be optional, so we shouldn’t *assume* that “the more reasoning, the better.” Best, Kristine
