Karl, Before we address the issue of "authority", or the lack thereof, let's put some of the pieces of the puzzle together first. (1) Neustar is party to a contract with the US DOC. (2) The base period of the contract was 4 years. (3) The contract included 2 one-year options. (4) The final option expires on 25 October 2007 In my mind the following questions arise: who is actually the manager of the .us TLD? The IANA lists NeuStar, Inc. Loudon Tech Center 45980 Center Oak Plaza Sterling, Virginia 20166 United States as the sponsoring party. So, is Neustar the ccTLD manager, or is the manager the US DOC via the NTIA? If NeuStar is the manager, will they continue to have management rights if the contract with the USG expires, or if the DOC names another entity to perform the back-end registry work? I have to admit that I'm not delighted with the way that .us has been managed... I point to the failures of the .us Policy Council, the loss of privacy rights in the .us namespace and to excessive governmental involvement in decision-making relative to this TLD. One thing is certain, the heavy hand of the U.S. Government will interject itself into ICANN/IANA matters before long and this TLD will continue to suffer. Please do not send Travel Queries to individual members of staff

Dear All: There are a large number of questions related to travel coming in to me personally. Please be advised that any email sent to me about travel personally henceforth is unlikely to be answered. As per the travel policy, and as I have also reminded everyone on many occasions, ANY correspondence about travel needs to go to travel-staff@atlarge- lists.icann.org so that it can be handled. May I draw everyone's attention to the following facts, which would allow you to help yourself in respect of virtually all the requests that are being sent to me personally at the present time: 1) If you have questions about your airline ticket of any kind, or wish to change your ticket, please refer those questions to the travel agent, American Express, or if you were allowed to book your ticket directly, with that travel agent. 2) If you have a question about the hotels, please contact them directly. 3) If you have a question about airport transfers, or the like, check the Travel Information page on the regional websites and/or the ALAC wiki; this will be kept updated. 4) If you want to change your itinerary, contact American express. Per the travel policy, any cost for doing so would be your responsibility. 5) If you want to change your hotel reservation, contact your hotel directly. ICANN meetings staff are not handling any changes of this type, and any costs of changing are up to you. We believe that the travel policy issued to you - which is also available on all regional websites - will provide answers to any question related to the above, as well as many others. Please refer to that rather than sending emails in the first instance. If you still have a question, then by all means do send it to travel- staff(a)atlarge-lists.icann.org. Please understand it is not that I don't like hearing from you, it is that we are trying to arrange a successful meeting for everyone and if you look to the self-service ways to get information, including a number of which we have provided for you, it will help you and also help us to ensure the best possible meeting for everyone. North American At-Large Hotel Information The Courtyard Miramar is the hotel for the North American and LAC Regional Attendees. ICANN will pay the room and tax only. You will be asked for a credit card when you check in for incidentals, and to cover any meals you may order. At-Large staff are checking whether or not breakfast is included in the room or not and we will update you as soon as we hear. Note that hotel room and tax for ALS participants cover the nights of 23 - 29 June only unless you have made arrangements to the contrary with ICANN staff in advance. You are welcome to stay before and after, but the costs of doing so will be paid by you when you check out of the hotel. Access to internet from your room is not included in your room costs and is not reimburseable after the event as the network at the meeting is free and available 24 hours per day. Code of Conduct Adopted by Consensus

The Operating Principles, as adopted, provide that "Rough consensus, as determined by the Chair, will generally be used within the NARALO to manage its current affairs (e.g. producing recommendations to ICANN)." (Paragraph 14). In the recent voting, members voted in favor of the Code of Conduct in roughly the same numbers and percentages as they voted on the OP. In the eyes of the Chair, we have rough consensus in favor of the Code of Conduct, and it is adopted and in effect immediately. (see link in footer below) By a copy of this message to Staff, I ask ICANN to post this as a final document on all relevant ALAC web pages and to update our mailing list footer accordingly. Bret

Excerpts from the transcript of the telephone conference: Male: So what will happen exactly one week from today? Bret: One week from today... Well, maybe we'll have 70% approval before that. If not, I think we're basically asking everyone who has not cast a vote to cast a vote between this call and Tuesday, June 5th. And if they have not cast a vote, I think that the note that we send to them is that we will consider them inactive for purposes of paragraph 15 of the Operating Principles. Bret: As I've been taking notes here, the action items are, in fairly short order we're going to take a look at the list and find out who hasn't voted and Nick is going to send follow-up e-mail messages to them reminding them to vote and giving them instructions on how to do so, and we're going to ask people to vote by a week from today and we're going to tell them that if they don't vote, we are going to consider them inactive for purposes of paragraph 15 of the Draft MoU... I mean, of the Draft Operating Principles. Another action item is to start work on the MoU, try to take account of what we've seen from ICANN, what we've seen on the list, and what suggestions Luc has made and others may have made, and come up with a revised version or versions on the wiki for the MoU. If we approve the Operating Principles then it will be a consensus approach to determining whether we approve the MoU and we'll try to figure out some way of humming 1:22:25 or voting or at least making our will known about how we feel about that. It would be wonderful if we can get it out by the end of next week so we could actually get people seated in Puerto Rico. I think that would be a wonderful thing to do but I'm not optimistic that we can get it done in a week, but let's see where we are. Is there ANY way that I can be of assistance in this "voting results lag"? As we can see from the above, this delay is causing further delays in the discussions we need to have around the MOU. Voting Tally on OP Principles

I am pleased to report that, according to my tally, detailed below, the Operating Principles have been approved in accord with Paragraph 15 ("These Operating Principles will take effect when adopted by not less than 70% of the active North American At-Large Structures"). With 16 Accredited At Large Structures, each with 2 eligible voting members, we had a potential for 32 votes. 26 votes were cast, and, according to our prior agreement, the 6 eligibles voters who did not vote were deemed "not active" for purposes of the vote. Of the 26 votes cast by At Large Structures, 20 were affirmative "yes" votes in favor of the Operating Principles (76%). Of the remaining 6 votes, 3 were express abstentions and 3 were negative. If we do not take account of the abstentions, the voting percentage (20 of 23 votes) rises to 87%. The approval paragraph of the OP provided that the vote was to take place among At Large Structures, which does not include the unaffiliated individuals who participate in the General Assembly voting. Both of these individuals voted "no." Even if we counted them, the OP would have passed (either by a 71% or 80% margin, depending on how we dealt with abstentions). By a copy of this message, I am alerting ICANN Staff to the fact that the Operating Principles for North America have been adopted and asking that they post these as final to the relevant ALAC web pages and update the footer on our mailing lists.
