Draft NARALO statement on ALAC review

NOTE: This is a draft, produced as a result of interest expressed in my earlier query of this list. Even though it says "reached by consensus", that of course will not be the case if we do not reach consensus. Please -- SOON -- offer changes of any kind as well as any other comments. If at least rough consensus is possible, I would like to have a final version ready for presentation by Saturday night. If it sounds to strong, or not strong enough, or you just don't like the tone, etc. please suggest changes. - Evan --------------------------------------------------------- NARALO, by consensus agreement, urges ALAC to take every measure possible to encourage rejection of the report of the 2008 ALAC review by the ICANN board and other members of the ICANN community. The ALAC Review process has been flawed from the initial choice of review consultants, which we believe may have adversely affected the independence of the review itself. Such suspicions appear to be warranted by the complete lack of consideration of the needs of At-Large in the reviewers' draft recommendations. While the report indicates we were heard, we were clearly not listened to. The logic behind the recommendation to deny At-Large voting membership on the ICANN Board is puzzling; even in its best possible interpretation the rationale emphasizes rigidity over good and responsible governance. Not only do the ALAC review recommendations fail to progress the needs of ICANN's At-Large community, they take a significant step backwards by requesting that an even larger proportion of ALAC than currently exists be composed of unaccountable, non-representative appointees of the Nominating Committee. The result is a real and visible reduction of the voice of the community for whom ALAC is supposed to speak. Indeed, most of the report's recommendations appear designed to deny the vision ICANN originally had for At-Large, to reduce the influence of At-Large within ICANN, to reduce transparency, and to obstruct community outreach. The review fails totally to address the fact that ICANN's relationship with At-Large is bi-directional. What is at issue is not only what the community must offer to ICANN, but also what ICANN _owes_ to the community of Internet users who have neither financial nor academic interest in Internet operation. For these reasons, we call upon ALAC and other members of the ICANN community to challenge the recommendations of the current ALAC review, as well as the very frames of reference upon which they were constructed. We believe that such actions are required for the betterment of ICANN's public constituency. This statement was reached by consensus of NARALO members on June 20, 2008 after efforts to solicit opinion from its organizational and individual members.

Dr. Joe and all, Thanks for your input and opinion. Most of it I fully agree with. Indeed true that this problem isn't DNS itself, but how NAT is using randomizing port use. I also to a degree that DNSSEC can be a problem and if not fully implimented properly, can, and likely will be a significant maintanance as well as administration problem. But that is not a DNSSEC problem unto itself. I've done several DNSSEC implimentations that have low or no maint problems. Beau and all, Interesting article, thank you for pointing it out. Unfortunately Google.com is not human/user-friendly what so ever. Niether is ATT.NET, see: http://private.dnsstuff.com/tools/dnsreport.ch?domain=att.net&token=00804ef… Further the responsibility resides with of this long standing DNS security hole has been known for years, nearly a decade, it was right of Mr. Kiminsky to publicize it more forcibly so that users will be more aware and be armed with good and accurate information by which they can take measures to protect themselves accordingly, either independently or through their service providers accordingly. ICANN and the IANA along with ISC through one Paul Vixie could, and should have address this and many other less severe DNS security problems long ago when they were first made aware of the problem, but balked to a great degree in doing so. This was long ago discussed on the old and now defunct DNSO GA ML to which I have repeatedly given a URL link to, and have a retained full independent archive of. Sooner or later ICANN is going to have to face the legal music for this one! I and our members have had, and will always have a zero tolerance policy for those that act irresponsibly, or don't take corrective action for known or suspected technical related security problems when they knew better. Paul Vixie and others knew well in advance of this and other DNS security holes, and Paul is a very sharp fellow, so he knew this problem was there and didn't strongly enough recomend getting it fixed ASAP. I like and respect Paul allot, but he dropped the ball on this, and few others of this nature... As a side note, I thought the more important and relevant parts of this public comment were as follows: We note that the PSC papers touch on several of the key areas listed above, including long term stability, accountability, responsiveness and stakeholder participation. However, ensuring continued private sector leadership, increased contract compliance and enhanced competition are minimally addressed, if at all, in the Transition Action Plan. The Department believes that these issues require affirmative and concrete actions on ICANNs part, as it seeks to increase the confidence of the ICANN community in its structure, policy and decision-making processes, and, ultimately, its long term stability. In addition, as the PSC papers refer to a root-zone transition agreement the Department believes it is important for its views to be on the record. First, it is important to note that the IANA functions contract was not part of the JPA mid-term review and the Department views these as two discrete instruments. As the community is aware, the IANA functions contract covers the performance of a series of currently interdependent technical functions that enable the continued efficient operation of the Internet, including processing requests to change the authoritative root zone file. Implementation of changes to the authoritative root zone file are performed by VeriSign under the terms of a separate agreement with the Department. Dominik and all, If the below outlined report is correct, than it is clear that commercial interests have a significant advantage and the majority of power in the GNSO as Registries and Registrars are essentially commercial entities/businesses. Ergo no balance and essentially nothing has changed in the GNSO other than the "Names" of the specific representative groups. Further there is NO Independent Registrant representative in this proposed structure, and NO user-non-registrant reoresentative/ALAC. So I will now predict that there will be no significant change in the bahavior of Registries or Registrars and the abuses that have been occuring with increasing frequency will continue with even more increasing frequency. I will also predict here and now that with this proposed structure the IPC will get whatever it wants. In the interests of bringing some facts into this thread, I hope this clarifies: * neither the G or K root are operated by ICANN or IANA; * neither was offline in the last few days prior to the complaint; * the original person who observed problems with the K root spoke with the K root operator on another list and the issue was identified as likely local to the observer's network, not to the root server; * as for the claim that "the US Military like the Canadian military complex often gets attacks routed through the IANA", I have no idea what this means. Perhaps the complainant could explain precisely that they mean. Attached is a graph of the responsiveness of all 13 root servers for the last 48 hours, as tested from 69 testing points around the world. If it was predominantly offline it would show as a solid red bar. As you can see one such event occured for G root, but that was at 1600 GMT on Monday, after this thread had started. By looking at that in more detail detail on the second graph, we can see it was still up and answering, but was problematic reaching it from many test sites. (If it was offline it will be universally red all the way down the graph) kim

FYI: FCC Commissioner Urges, Don't Regulate the Internet

All, As has been my and our members contention for years, it's good and heartening to read a well reasoned and considered bit on whom should be managing Internet resources. However I believe that Comcast got it's just reward. Yet the pulling of the plug on Usenet is not reasonable as cleaning it up can and should be doable. However the Usenet groups that promote Child Porn should be shut down immediately! Such action does not predicate or require that ALL of Usenet have it's proverbial plug pulled... Yet recent events and lack of precipitous action on the part of ICANN and the IANA regarding DNS, has given many of our members to be yet again reconsider that perhaps some USG regulation on DNS and IP address management, is needed. Such management should come from professional Technical folks, not social science bureaucrats and/or activists of various bents. All, This should send a more significant message to the RIAA and as far as ICANN is concerned, the IPC a message that if the IPC is wise, will assist it in revoking the RIAA's membership, or council them in a harsh but necessary manner... Councilor Beckerman, and outstanding legal mind, has framed the situation in a reasonable and appropriate manner. One can only hope that ICANN's Bod and staff will take the hint...
