"What's At Stake" gTLD conference

Is anyone from NARALO going to this conference? http://www.cadna.org/Whats-At-Stake/ It seems like a very useful approach with which we might want to associate ourselves. Yes, much of it involves major brandholders scared by the influx of gTLDs, but it seems that there is much common ground between that group's skepticism about the program and that of ICANN At-Large. Hello, all. Here is the statement on the .pr controversy prepared by Eduardo with comments by Garth and final revisions by me. Please read and give feedback promptly. STATEMENT OF THE NORTH AMERICAN AT-LARGE REGIONAL ORGANIZATION ON THE MISAPPROPRIATION OF THE .PR DOMAIN The North American At-Large Regional Organization wants to bring the ICANN community’s attention to a serious concern regarding management of Puerto Rico’s country code top-level domain, .pr, following a June 2011 lawsuit filed by The University of Puerto Rico against the domain’s manager alleging misappropriation of public funds and inappropriate ownership claim of the domain, among other allegations. Background In 1988, the U.S. National Science Foundation established a program to expand use of the Internet outside the United States by establishing a domain registration that would allow each country connected to the network to offer access the Internet through that domain. Within that program, the University of Puerto Rico, through its Gauss Research Laboratory in the Natural Sciences department, requested the domain ".pr" (institutional research number 8818283, "Support for the Participation of the University of Puerto Rico in the NSFNet”). This proposal was approved in 1989 and administration of the .pr domain was designated to the “Gauss Research Laboratory” with the university as manager. In 2006, the .pr ccTLD’s manager contacted the Internet Assigned Numbers Authority to request a name change in the sponsoring organization, from the University of Puerto Rico to a corporation with the same name, including the abbreviations “INC. i.e. Gauss Research Laboratory, Inc.” As a result of this change, Gauss Research Laboratory Inc. was permitted to remove the .pr ccTLD operations outside the university campus, as well as redirect any funds generated by domain purchases. Results of IANA Decision It is apparent IANA, in its decision, considered the request for a name change in the sponsoring organization to be an administrative task, not a re-delegation of the ccTLD. However, according to the lawsuit, the ccTLD manager took action as if a full re-delegation had been made, allowing him to move the operation outside the university. Critically, in 2007, Gauss Research Laboratory, Inc. filed a change in corporate status from non-profit to for-profit with the Department of State of the Commonwealth of Puerto Rico. Therefore, IANA’s decision effectively resulted in the hijacking of a public resource from a non-profit educational institution to a for-profit corporation. The NARALO is concerned the apparent “re-delegation” of the .pr domain represents a potential abuse of public trust and misappropriation of Internet resources. In addition, while the controversy over Puerto Rico's country-code domain may seem unusual, findings presented in the final report of the ccNSO Delegation and Redelegation Working Group (http://ccnso.icann.org/workinggroups/final-drd-report-02may11-en.pdf) clearly indicate it is not. NARALO applauds and supports the ccNSO working group’s desire, stated in that report, to “create an environment for making consistent and predictable decisions regarding the delegation, re-delegation and retirement of ccTLDs while enhancing accountability and transparency.” Therefore, at the 2011 ICANN meeting in Dakar, NARALO will present the facts and allegations in this case, as well as examples of similar cases, in hopes of prompting a multi-stakeholder discussion and approach to create such an environment worldwide.

The point I was making, however, is that the statement should not just give the history, but some current status as well (although perhaps not at that level of detail). why don't you say that on the call...I will support it also, every non-profit org has to have a strategic plan and mission statement it trots around, ICANN is no different, but if you spoke directly to the issue of Gareth's wasted time participating last go-round, it might register on the I-meter...I'd do it but am not particularly aware of the specifics of what he was asked to do. Or maybe Gareth wants to. Regarding Monday's NARALO meeting

To me the ICANN Strategic Plan is a massive waste of time and energy, not just on the part of At-Large but of all of ICANN. In fact, at this critical time (i.e., US Government contracts up for renewal, changes at both CEO and Board Chair, and increasing pressure from governments to scrap the whole experiment), such an energy consuming exercise in "navel-gazing" simply calls public attention to the extent of which ICANN is out of touch with the community it is supposed to serve. I truly believe that the abandonment of this charade of creating laminated motherhood statements and diversion of energies to matters more pressing is urgently called upon. It doesn't help that, in all the time I have been involved with ICANN (which is longer than some but MUCH shorter than many) ICANN has never lived up to the aspirational plan, allowing staff rather than the community to really determine priorities regardlss of what the nice words say. We have witnessed this first hand, as most of last year's work within NARALO and led by Gareth on the last Strategic Plan input was merely shunted aside -- and now we're being asked to start all over again with no greater likelihood of success. Compounding the farce is the charging of this same staff with evaluating its own success. Whether you plan to participate in the upcoming ICANN meeting in Dakar remotely or in person, you're invited to a quick reminder of the background and current status of each major policy issue currently under discussion in ICANN. The ICANN Policy Staff will provide a briefing on Thursday 13 October at 12.00 UTC and Thursday 13 October at 19.00 UTC, summarizing policy issues across the different ICANN Supporting Organizations, namely the Generic Names Supporting Organization (GNSO), Country Code Names Supporting Organization (ccNSO) and Address Supporting Organization (ASO). Amongst other topics, updates will be provided on: * Uniform Dispute Resolution Policy Issue Report (GNSO) * Post-Expiration Domain Name Recovery (GNSO) * Recent WHOIS work * Study Group on Use of Names for Countries and Territories (ccNSO) * Framework of Interpretation Working Group for the delegation and re delegation of ccTLDs (ccNSO) * Joint DNS Security and Stability Analysis Working Group The two sessions are duplicates, scheduled to accommodate different time zones. Each session, scheduled to run for 90 minutes, will be conducted in English only. The meeting will be run in Adobe Connect with a slide presentation along with a dial-in conference bridge for audio. Participants will have the opportunity to ask questions at the end of each session. During the course of the webinar, questions may be submitted using the chat function of Adobe Connect. If you are not able to participate in either of the live sessions, the recording of the session will be made available shortly after the meeting. Operation Pangea IV

http://content.govdelivery.com/bulletins/gd/USDHSICE-147fd6 Pangea IV operations within the United States resulted in 92 seizures, consisting of 57,052 pills, including counterfeit Cialis and Viaga, with a manufacturer suggested retail price of $925,520. With 53 countries reporting their results to date, 13,495 websites engaged in illegal activity have now been taken down for. In addition, 45,419 packages were inspected by regulators and customs officials, 7,901 packages were seized containing more than 2.4 million illicit and counterfeit pills originating from 48 countries - including antidepressants, antibiotics, steroids, arthritis medicine, lifestyle drugs and diet pills. Seized pharmaceuticals are estimated to be worth $6.3 million. During the operation, 55 individuals were arrested and are under investigation for a range of offenses, including illegally selling and supplying unlicensed or prescription-only medicines. Some 36 search warrants were executed. "Operations like this highlight why international partnerships are such an essential weapon in the fight against trafficking of counterfeit pharmaceuticals," said ICE Director John Morton. "People who purchase drugs should never have to be put at risk because the product is fake, unsafe or untested." "INTERPOL's member countries and partners have shown through the success of Operation Pangea IV that the Internet is not an anonymous safe haven for criminals trafficking illicit medicines," said INTERPOL Secretary General Ronald K. Noble. "The main objective in Operation Pangea IV was to harness collective action across different sectors to assist authorities and stakeholders in INTERPOL's 188 member countries to shut down illegal pharmaceutical websites and identify the money flows and sources behind these illicit pharmaceutical products which represent such a threat to the health of the public. Our thanks go to the police, customs and health regulatory officials in the 81 participating countries.
